52.212-2 -- Evaluation -- Commercial Items.
As prescribed in 13.106-2(b), the Contracting Officer may insert a provision substantially as follows:
Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The evaluation method used will be a Lowest Priced Technically Acceptable (LPTA) basis. An award will be made to the lowest evaluated priced proposal meeting or exceeding the acceptability standards for non-cost factors. Trade-offs are not permitted. The evaluation criteria are:
Technical Requirements:
The offeror must demonstrate compliance with ALL the Technical Requirements set forth in the Performance Work Statement (PWS) and its attachments, specifically Attachment 2- Specifications. The physical maps that are printed (post award) shall be tested for technical requirements set forth in Section 1.2.1 of the PWS (color target, low light conditions, overprint & knockout, and registration).
Technical testing shall occur in three phases:
1. Pre-Award: Technical evaluation conducted to meet the minimum requirements stated in PWS and Attachment 2.
2. Post-Award: Testing for the STIG in Mechanicsburg, PA IAW Section 5 of the PWS.
3. Post-Award: After DoD Security Technical Implementation Guides (STIG) testing is approved, the printer shall be set-up at the delivery location (Ramstein, Germany).
Once the printer is ready, the printer shall be tested for the color target, low light conditions, overprint & knockout, and registration.
*if at any time after the award is made to the lowest price technically acceptable offeror and it is found to be unacceptable due to it not being able to meet the PWS and minimum requirements set forth in Attachment 2, the Government reserves the right to terminate for Government Convenience at no cost and award to the next lowest offeror.
Price:
The offeror must submit a single unit price for each CLIN listed in the space provided for the unit price for Attachment 3. The offeror may use Attachment 3 or submit their own version.
Please note that is is required to have a unit price, total CLIN price, Total base year price and total price with all options.
Past Performance:
The offeror is NOT required to submit past performance. All past performance will be evaluated through the Federal Awardee Performance and Integrity Information System (FAPIIS), Past
Performance Information Retrieval System-(PPIRS) and Contract Performance Assessment Reporting System (CPARS)
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
