A. The purpose of this modification is to answer prospective offerors' questions and to revise the solicitation's performance work statement (PWS), proposal submission requirements, and bid schedule attachment.

B. Offerors' questions with the Government's answers follow:

1. QUESTION: Tender body Page 5 2 Waste removal phases first section last sentence

Quote: "When operating in a location or facility identified for service under this contract, the contractor is required to provide forklifts with specifications that meet the applicable permit requirements."

Remark. There are different ways to load waste on a truck. It might be lift gate and pallet mover, trucks with an installed crane, forklifts or others. In order to avoid discussions this wording should be held more flexible. In some places forklifts are not available or why should a company with the ability to load independent carry an extra forklift. Or waste quantities are sometimes quite small and to arrange a truck and a forklift is not economical. Please change.

RESPONSE: Only if it is needed will forklifts be required to be provided. We do not care how offerors load waste, and may use only the right tool for the job. It does not make any sense to bring a forklift if you have a pump truck.

The quoted language on page 5 is hereby changed to read “When operating in a location or facility identified for service under this contract, the contractor is required to meet the applicable permit requirements and to provide appropriate equipment to perform all tasks in a safe manner.” See replacement page for page 5 attached.

2. QUESTION: Page 6 Permits first section Please explain what a loading/unloading register means.

RESPONSE: It is something that the ship has when it is either off-loading or loading the waste being exported/imported for disposal.

3. QUESTION: Page 6 Responsibilities 2 Shipping documents Quote: “ii. The contractor shall prepare, complete, and provide copies of the appropriate shipping papers to the COR and designated, installation representative at least five (5) days prior to the removal of the waste from the installation.”

This clause may work for sites with waste management service CLINs. Especially the information given by units in training areas are quite often not correct and the documents need to be modifies always at the day of removal. To provide the documents 5 days prior will lead in a lack of flexibility and unsatisfied or incomplete missions. The documents will be generated at the removal after loading. Please remove from the contract body or change.

RESPONSE: The quoted language on page 6 is revised to read “ii. The contractor shall prepare, complete, and provide copies of the appropriate shipping papers to the COR and designated installation representative at least five (5) days prior to the removal of the waste from the installation when possible.” See replacement page for page 6 attached.

4. QUESTION: Page 7 ix Trans Boundary shipping documents

Quote: “The contractor shall prepare all notification documents and act as the “exporter” and “importer” of the waste.”

Because the services shall be provided tax and customs free the exporter must be the generating unit of the waste. Further more the Contract covers 26 countries To be an exporter you have to be registered in the

CONTINUED ON NEXT PAGE

country of export. Please correct. The government must be the exporter or give an alternative exporter which locally registered.

RESPONSE: The Contractor is the exporter and importer. No change.

5. QUESTION: Page 8

(v) waste report:

Does section B refer to CLIN N6650?

RESPONSE: Yes

6. QUESTION: Page 16 CLIN N6600 Identification of unknown liquids and solids requires according to the description 4 Special Services (b) IDENTIFY UNKNOWN WASTE... analysis of...

quote"... Total Metals (5) total pesticides, and (6)... " end of quote It is possible to analyze pesticides and there are some group analyses methods but it is not possible to give an analysis result containing every possible pesticide. There are a few hundred or thousand. We need to have a list of pesticides you want to have considered in the report otherwise it is not possible to give a reliable result.

RESPONSE: The customer will provide the test parameters up to 5 different pesticides at one time. The specific requirement will be given at point of submitting request. It is not a blind test.

7. QUESTION: Pricing General:

The use of one price list is surely possible. In the calculation it would be basically a mixed price which would cover all countries in a competitive way. Israel is based on its unique location a kind of closed market with a monopoly structure. Export is very limited and pending to a government decision. This causes a very high price range for Israel. To include Israel in the mixed price calculation for one price list it brings the risk for the bidder not to be sure about the quantities and causes a high overall price. So a waste generator in Estonia will have to pay a much higher price because the price is effected by the ten times higher prices in Israel. Please add a separate price list for Israel.

RESPONSE: The quantities for Israel are very small. Instead of the adding a separate price list for Israel, we are adding two new CLINs to account for the additional transportation costs for Israel, over and above the European transportation costs already included in the existing CLINs for disposal (in other words, a container surcharge). CLINs N6060A is for the additional transportation costs of hazardous waste from Israel to the final disposal facility when using a 20-foot container, and CLIN N6060B is for the additional transportation costs of hazardous waste from Israel to the final disposal facility when using a 40-foot container. See attached revised bid schedule (Attachment 1).

8. QUESTION: CLIN N6740 and CLIN N6745 Containers with valves are no longer allowed for spray cans. Please delete. Aerosols are covered under N6841 and 6842.

RESPONSE: CLINs N6740 and N6745 are hereby deleted. See attached revised bid schedule (Attachment 1).

9. QUESTION: N6850 Tri Wall Containers in this dimensions or similar are unfortunately not available in Europe.

RESPONSE: Offerors can purchase these from companies in Scotland, Ireland, or England.

10. QUESTION: N6930 The purchasing clins for packaging cover already all possible ways of packaging. Please explain or delete N6930.

RESPONSE: CLIN N6930 is for stuff like vermiculite or items used within packages that the generator uses and not the contractor.

11. QUESTION: N7015 describes tanks larger than 10,000 gallons. Tanks can be easy 1000, 000 gallons. Please fix a limit.

RESPONSE: CLIN N7015 is hereby changed to read “Tanks from 10,000 gallons up to 25,000 gallons.” See attached revised bid schedule (Attachment 1).

12. QUESTION: Page 46, paragraph (1)(iii) mentions that we must submit the completed PWS sections 'CONTRACT MANATER/ALTERNATE CONTRACT MANAGER/ON-SITE TECHNICAL REPRESENTATIVE' and 'CONTRACTOR REPRESENTATIVE'. Could you please define which are these PWS sections and what exactly is required by this paragraph?

RESPONSE: Paragraph (1)(iii) on page 46 is hereby deleted. See replacement page for page 5 attached.

It is also noted that paragraph (4) entitled Contractor Personnel on page 11 of the solicitation requires the contractor to provide a list of the names and telephone numbers of the contractor’s contract manager, alternate contract manager, and on-site technical representative (OST) to the COR. This list may be provided to the COR upon award, and need not be submitted with the proposal.

13. QUESTION: there is an additional question about bulk liquid pumping. Page 12 and 13.

Quote: It is at the contractor's discretion to use a tanker or container truck. The contractor shall supply the tanks or drums to which the bulk liquids are to be transferred.

There is no CLIN in the price list for liquid pumping but the contractor is required to provide containers for the pumped liquids. Since it is not clear what size of tank at which location there must be a CLIN for the pumping per qbm..

The wording for tank cleaning mentioners a CLIN N70120. Is this the pumping?

RESPONSE: It is up to the contractor to decide what is cheaper for him to either pump into a tanker or pump into drums. We do not provide either. We cannot tell them which to do. This cost is included in the cost of the waste. There is no pump CLIN. Use the waste CLIN. The Cleaning CLIN is added if requested, but we use the same CLIN that it would be if it was in a drum. That is why we have the trucks weigh.

14. QUESTION: Can you define the pick-up locations of Albania, Armenia, Austria, Azerbaijan, Cyprus, Bosnia and Herzegovina, Malta, Macedonia, Moldova, Montenegro, Slovakia and Slovenia?

RESPONSE: As previously stated in Amendment 0001, not all locations are known at this time, nor open. We provided locations for those sites that are currently open. For all other sites, we will provide addresses once the locations are secured and implemented.

15. QUESTION: Is there any information available on the quantities of waste in each pick-up point?

RESPONSE: Not all sites are being used yet. The sites are expected to open during the length of the contract and no date is given for each location. Thus, there is no inventory except what has been given within the CLIN list of total estimated quantities.

C. The solicitation's replacement pages for page 5, 6, and 46 are attached.

D. The revised version of Attachment 1, Bid Schedule, is attached. Offerors are required to submit a completed copy of the revised version of Attachment 1 with their offer.

E. The solicitation’s closing date and time is hereby extended until 10:00 AM local (Germany) time on 28 March 2016. All offers must be submitted no later than 10:00 AM local (Germany) time on 28 March 2016.

Offerors are also reminded to submit a signed copy of each solicitation amendment with their offer.
