1. REQUIREMENT: The Government intends to award multiple Blanket Purchase Agreement (BPAs) using Federal Acquisition Regulation (FAR) Part 12, Commercial Acquisition procedures for the delivery of several Multiple Element Gas Containers (MEGC) or International Organization for Standardization (ISO) Containers and their Chassis for Gaseous Helium compressed gas service. Delivery will be F.O.B. Origin. Exact quantities for the resultant BPAs are undetermined over the five-year period of performance as any CONUS or OCONUS DLA Energy customer known or unknown at this time will be supported under these BPAs. This requirement is being solicited as a 100% Small Business Set Aside. Only packages submitted by Small Business Concerns will be considered.

2. MULTIPLE AWARDS: The Contractor shall provide all supplies, management, tools, equipment and labor necessary for the delivery or MEGC/ISO Containers and Chassis. BPA Contract Awards will be made to all SB offerors determined to be capable of providing ATTLA certified MEGC/ISO containers and chassis in accordance with the solicitation. The Government is obligated only to the extent of authorized purchases actually made under the BPA. Delivery Orders/Calls will be the method for ordering as a result of this solicitation. All orders will be competed among the current BPA holders and are required to be signed by a warranted Contracting Officer.

3. Utilization of the BPA process will allow the multiple BPA contractors to provide specific pricing and conditions of each individual delivery (available quantity or production capacity specific to Government need) as they are solicited. The order(s) will then be placed utilizing their BPA contract with that/those BPA contractor(s) whose offer provides the best trade-off based between availability to meet the Required Delivery Date (RDD) versus the lowest price per standard cubic foot (at 70 degrees F) delivered per trailer for each requirement. If the best evaluated offeror cannot provide the necessary quantity by the stated RDD on the request, the Government will continue to award to each next best offeror until their production capacity or the Government's required quantity is met. The BPA contracts’ ordering period is estimated to be from 1 August 2017 through 31 July 2022.

4. The first known BPA call after award will be for 5 units with an RDD of 15 September 2017 and 5 units with a an RDD of 15 October 2017. Contractors shall provide pricing and availability for this first BPA call with their solicitation package. Refurbished units shall be proposed on a separate Line Item from New units.

5. FAIR OPPORTUNITY:

(a) In accordance with Federal Acquisition Regulation, Part 16.505(a)(8)and under the provisions of the

Federal Acquisition Streamlining Act of 1994, 10 U.S.C. 2304(c) (Public Law 103-55) and 41 U.S.C. 2252j(d), a protest is not authorized in connection with the issuance of an individual task or delivery orders except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract under which the order is issued.

(b) In accordance with Defense Logistics Agency (DLAD) Part 16, paragraph 16.505(b), OFFERORS ARE HEREBY ADVISED THAT: (i) the competition requirements of FAR Part 6 do not apply to placement of individual task and delivery orders; (ii) individual orders shall be placed in accordance with the selection criteria specified in the solicitation/contract; and (iii) complaints about the placement of individual orders shall be reviewed by the activity competition advocate.

(c) The delivery order Ombudsman is responsible for reviewing complaints from multiple award contractors and ensuring that all contractors are given a fair opportunity to be considered for the task/delivery orders in excess of $3,000, consistent with the procedures in the contract. However, it is not within the task/delivery order contract Ombudsman's authority to prevent issuance of an order or hinder an existing order

6. AIRLIFT CERTIFICATION. Each provided MEGC/ISO container, locked to its corresponding chassis, shall meet the Air Transportation Test Load Activity (ATTLA) certification for military airlift as a single unit. The contractor shall provide their MEGC/ISO Containers and Chassis designs and proof of approval of those designs by ATTLA in order to be awarded a BPA contract under this solicitation. Contractors that do not currently have ATTLA approved designs can respond to this solicitation with the approved designs and be awarded a BPA contract at any time during the five year period of performance of these BPAs.

7. PICKUP LOCATION: Delivery is F.O.B. Origin. Upon DLA Energy acceptance, a Government carrier will be dispatched to the contractor's facility to pick up the MEGC/Chassis for delivery to the helium fill point. (k) The Contractor shall conduct activities under this clause in accordance with applicable laws and regulations on the interception, monitoring, access, use, and disclosure of electronic communications and data.

(l) Other safeguarding or reporting requirements. The safeguarding and cyber incident reporting required by this clause in no way abrogates the Contractor’s responsibility for other safeguarding or cyber incident reporting pertaining to its unclassified information systems as required by other applicable clauses of this contract, or as a result of other applicable U.S. Government statutory or regulatory requirements.

(m) Subcontracts. The Contractor shall—

(1) Include this clause, including this paragraph (m), in subcontracts, or similar contractual instruments, for operationally critical support, or for which subcontract performance will involve a covered contractor information system, including subcontracts for commercial items, without alteration, except to identify the parties; and
