SP0600-10-R-0231, Amendment 0002

A. DLA-Energy has received the following questions concerning this solicitation:

1. Is the solicited requirement for the transportation of DLA-Energy owned fuel, or is the fuel to be supplied too? Can you please explain what the term means “this fuel is not capitalized” as stated in DLA-Energy internal instruction INT-B1.05-2?

* DLA-Energy has requirements for Contractors to provide the fuel at the delivery locations. The term “this fuel is not capitalized” means that DLA-Energy does not own the fuel.

2. What is the fuel storage pick-up point for the delivery to the FOB(s) of Marmel, Kunduz, Maimana and Spann?

* The offeror is responsible for deciding where to locate their intermediate fuel storage locations.

3. The special notes state that the CLINS 110-90, 111-90, 112-90, 113-90 shall be sourced from Western or Northern supply routes to Afghanistan. Do you mean that the origin of the JP8 or TS1(IAW amendment 0001) has to be from those countries or do you mean that we have to use those areas to enter into Afghanistan? I have the same question for CLIN 107-90.

* The CLINS located in the Northern region of Afghanistan, CLINS: 110-90 (Marmel), 111-90 (Spann), 112- 90 (Kunduz) and 113-90 (Maimana) which are all North of the Salang Pass need to be sourced/ transported from the North through the Hariton border crossing. Fuel can be sourced as far away as the Mediterranean Basin. Due to logistics concerning and associated with the Salang Pass, locations South of the Pass, CLIN:

107-90 (Fenty), are required to be transported through the Torkham border crossing.

4. Does DLA-Energy require potential Offerors to offer on all CLINS (locations)?

* No, the Offeror does not have to make offers on all the CLINS in the solicitation.

5. Is DLA-Energy more inclined to make award to the Offeror who has offered on all the CLINS than the Offeror who has offered on only one CLIN?

* DLA-Energy will award contracts to the Contractor(s) that offer the best value to the U.S. Government for each CLIN. A Contractor does not have to make offers on all the CLINS.

6. Does supply from North/South need to be supported by commitment letters like from Pakistan OMC’s issue letters or does DLA-Energy want to see firm contracts from trader or refinery? If both are acceptable, does one have more weight than the other?

* DLA-Energy requires commitment letters which confirm that the subcontractor will provide the product or transportation. If there is already a contract in place then that would be acceptable, too. DLA-Energy does not expect a Contractor to make a contract before a DLA-Energy Contract is awarded to the Contractor. A commitment letter and a current contract both have the same weight.

7. Is storage facility necessary other than border of Hariton/ Targundi, for example, middle of the border and destination?

* DLA-Energy cannot determine where the storage facilities should be located. DLA-Energy expects the Contractor to know where to place the storage facilities to ensure that the fuel can always be provided when there is a requirement.

8. Can two parties offer jointly?

* DLA- Energy awards a contract to one entity. So, if the two (2) parties represented one company then they could make one offer. If the two (2) parties were separate companies than one or both could make an offer and the awarded party would be the Contractor and the secondary Company would be the subcontractor. The U.S.

Government can make payments to one Company per contract only.

9. Will past performance of both parties be taken into assessment?

* DLA-Energy is primarily concerned with the Contractor that is seeking the contract. The Contractor will be responsible for its subcontractor’s performance. If the Contractor has never transported fuel for example, then it will need to list its subcontractors experience on the Contractor Performance Data Sheet.

10. How should the DUNS and CAGE codes be mentioned on the first page of the OSP?

* The Offeror must submit a signed copy of the first page (SF Form 1449) of the Master Solicitation. A signature is required in block 30a. Additionally, on that form in block 17a there is a spot for the DUNS number.

The CAGE code can be put next to the DUNS number or in the “Facility” code box.

11. Can DLA-Energy make payments to separate accounts. For instance, can CLINS 1 & 2 be paid in one account and CLIN 3, be paid in another?

* No, a Contractor awarded three CLINS would have one contract with DLA-Energy and therefore, all payments would go to one account only. It would be up to the Contractor to move money within the bank to any other accounts.

12. Can a subcontractor be the transporter only or can the subcontractor deal with the refinery or fuel procurement trader?

* A Contractor can set up its logistics operation any way that it would like to do so. DLA-Energy is only concerned with ensuring that the fuel will be provided when and where it is requested. Once a contract is awarded then it is the Contractor’s responsibility to ensure that the fuel is provided when and where there is a requirement.

13. For the Contractor Subcontractor Data Sheet (attachment 3), is it necessary to submit the required information for all subcontractors or just those subcontractors who will be providing services inside Afghanistan?

* The subcontractors who will be providing services inside Afghanistan only.

14. Is it possible to do the economic price adjustment for FOB Fenty based on the OGRA (Oil and Gas Regulatory Authority under the Pakistan Government’s Ministry of Petroleum) instead of PLATTS?

* Yes, any fuel sourced in Pakistan can use the OGRA for 7 June 2010.

15. Please stipulate exactly what is required by DLA-Energy when submitting an offer.

* The standard form 1449 which is the first page of the Master Solicitation. Fill in blocks 12, 17 and sign block 30a, fill in blocks 30b and 30c.

- All amendments which have been sent out with this Solicitation, we currently have two (2) amendments and they must be signed in block 15a, and filled in at blocks 15b and 15c.

- Send back the whole OSP package with everything filled in that needs to be. Make sure that you include all the attachments (3).

16. Can the fuel be delivered FOB origin vice FOB destination?

* No, this Solicitation has a requirement for fuel to be supplied FOB destination.

17. In the Solicitation, it is stated that the fuel for FOB Fenty (CLIN 107-90) must be sourced from Pakistan.

Does that mean the fuel must be from a Pakistani refinery or does it mean that the fuel must be transported through Pakistan?

* Fuel for FOB Fenty may be sourced from a refinery in Pakistan, or it may be imported and transported through Pakistan. The fuel is to enter Afghanistan via the Torkham border crossing.

18. Please confirm that Russian grade Jet A1, with additives (Def Stan 91-91 compliant – GOST 52050) is acceptable fuel for RC- North.

* The Solicitation is for JP-8 and TS-1(with additives in accordance with Amendment 0001) so, in order to offer on Jet A1, an Offeror will need to request an “exception” in their Offer Submission Package. DLA- Energy’s Quality Assurance will review the proposed exception and determine if the fuel will meet DLA- Energy’s solicited requirement. Please ensure that the exception to use Jet A-1 includes the additive requirements stated in Amendment 0001.

19. In this solicitation, it states that submissions proposing Armed Private Security will not be considered. It is understood that such security companies would not be admitted to the bases for the downloading of the trucks during delivery. How are Contractors to secure the safety of the trucks from Hairatan to each FOB? Can you provide any more information on the level of security that will be provided to the Contractor(s) in Afghanistan?

* The U.S. Military will not provide security, and offers to use armed private security are not acceptable to the Government. Contractors are responsible for delivering the ordered requirements and are responsible for all associated risk of loss. A Contractor may take any other security provisions that it deems necessary, as long as it does not include the use of any weapons.

20. Do the tanker trucks within Afghanistan still require an epoxy lining?

* Yes, the epoxy lining is still a requirement for tanker trucks delivering fuel to the military in Afghanistan.

21. How does an offeror get a CAGE code and a bidder code?

* The bidder code will be assigned by DLA-Energy after the Offer Submission Package (OSP) is received. It is best to get a CAGE code and DUNS number before you submit your OSP.

On page 14 of the OSP, items (l) and (m) discuss the DUNS number and the Central Contractor Registration and how to register. When you register your Company in the Central Contractor Registration, a CAGE code will be provided, if you do not already have one.

Additionally at this DLA website link you can find out about the code and how to get one.

22. Will there be an extension for submission?

* No, there is no extension planned for this Solicitation.

23. Please advise if DLA-Energy prefers JP8 or TS-1 with additives, to be delivered to FOB Fenty (CLIN:

107-90).

* DLA-Energy amended the requirement for the fuel in FOB Fenty to allow either product.

24. Please confirm projected quantity is for a two year period.

* No, it is not. This amendment revises the estimated fuel quantity and is for the 2 year period. Please see DLA-Energy INT-B1.05-2 and use this copy to make offers.

25. Will the contract include a provision for demurrage?

* No, there will be no demurrage paid on contracts resulting from this solicitation.
