52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

BASIS FOR AWARD: As stated above, the Contracting Officer may only award a contract to a responsive, responsible Offeror whose proposal conforms to the requirements of this solicitation and offers the best overall value to the Government. Any Offeror's proposal that merely offers to perform work according to the terms of the solicitation or fails to present more than a statement indicating its capability to comply with the terms without support and elaboration as specified in the instructions will be rendered non-responsive.

The evaluation shall be conducted utilizing Simplified Acquisition Procedures as permitted for certain commercial items under FAR 13.5. In accordance with FAR 13.106-2(b)(3), formal evaluation plans and establishing a competitive range, conducting discussions, and scoring quotations or offers are not required. The Contracting Officer intends to conduct comparative evaluations of offers. The Government also intends to evaluate responses and award without discussions. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

The Factors that shall be used to determine Best Value are Technical, Past Performance, and Price.

Non-price factors (technical and past performance), when combined, are approximately equal in importance as price. As such, the Government may award to other than the lowest price or most highly evaluated technical proposal.

These factors are further described below:

1. Technical:

The Government will evaluate the Offeror’s the resumes/Curricula vitarum of its proposed staff for education and experience appropriate for the requirements described in sections 1.4.7 and 5 of the PWS. In particular, the Government will evaluate higher a proposed staffing plan that includes individuals with case management experience serving military populations, particularly with the Army National Guard, and with experience with using the medical case management systems specified in the PWS.

The Government will also evaluate the Offeror’s Management and Staffing plan for its approach to employee supervision and lines of communication between the Offeror’s staff, on-site and home office supervisory and management personnel and the Government. The Government will pay particular attention to the Offeror’s approach to the supervision structure for its field employees in order to maintain non-personal services. In order to have on-site supervision available at all times, the Government’s preference is for one of the full time case managers to be the on-site supervisor or in-charge POC for the Offeror. The Government will evaluate the Offeror’s approach to staff retention for personnel proposed for this effort in order to minimize attrition. Finally, the Government will evaluate the Offeror’s planned approach to mitigate the impact of any employee losses during the performance of the contract. The Government will evaluate higher an Offeror whose proposed management and staffing approach demonstrates a strong approach to retention, supervision, and avoidance of personal services; with a preference for on-site supervision without the need for additional personnel.

2. Past Performance:

The Government will evaluate the Offeror's record of past performance in work relevant to the type as called for in the PWS. The Government will evaluate higher relevant positive past performance serving military populations, particularly with the Army National Guard. Offerors are advised that, in addition to the Past Performance information requested in the Submission Requirements, the Government may obtain Past Performance information from interviews/questionnaires tailored to the circumstances of this acquisition and/or any other sources available to the Government. Sources may include, but are not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Contractor Performance Assessment Reporting System (CPARS) and interviews with Government Program Managers and Contracting Officers.

3. Price:

The Government will evaluate the pricing proposed by the Offeror for fairness and reasonableness based upon competitive pricing, inclusive of all options, of the Offeror’s proposal with those received from other Offerors and with a Government calculated “should cost” estimate based upon the Offeror’s proposed staff skill set. The Government’s “should cost” estimate will be developed using the wage determination stated in the proposal applied to the Offeror’s proposed labor mix and utilizing market derived Government estimated indirect rates and weighted guideline profit percentages IAW DFARS PGI 215.404-71.

For purposes of evaluating FAR 52.217-8 OPTION TO EXTEND SERVICES, by submitting its proposal, the offeror agrees that the Government shall consider the price of an optional six (6) months of services under the terms of this clause to be one-half (1/2) of the total price of the current service and travel CLINs (CLINs x001 and x002, respectively) under which performance is occurring at the time the Government indicates its intent to extend services in accordance with FAR 52.217-8. An additional CMRA would not be required.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
