The Offeror is not required to complete the representation in this provision if the Offeror has represented in the provision at 252.204-7016, Covered Defense Telecommunications Equipment or Services-Representation, that it "does not provide covered defense telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument."

(b) Prohibition. Section 1656 of the National Defense Authorization Act for Fiscal Year 2018 (Pub. Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Quoter whose quotation, conforming to the solicitation, represents the Best Value to the Government, price and other factors considered. The following factors and basis for award will be used to evaluate quotations:

Basis for Award:

The Government intends to award a Firm-Fixed-Price (FFP) contract resulting from this solicitation to the responsible Quoter whose quotation represents the Best Value to the Government. The Government intends to evaluate quotations and award a contract without interchanges but reserves the right to conduct interchanges if determined necessary. The Government reserves the right to make no award at all. Quoters who do not quote the entire package requested will be considered non-responsive and their quotation will not be evaluated.

Evaluation Factors:

Quotations will be evaluated based on the following three (3) factors: Factor 1 - Technical Capability, Factor 2 - Past Performance, and Factor 3 - Price.

Relative Importance: Factor 1 (Technical Capability) will be evaluated on an Acceptable /Unacceptable basis. Among those Quoters determined to be Technically Acceptable, a best value tradeoff will be made between Factor 2 (Past Performance) and Factor 3 (Price). Past Performance is significantly more important than Price. As quotations become more equal in their Past Performance ratings, Price becomes more important.

Factor 1: Technical Capability

The Government will evaluate the quotation to determine if it meets the minimum requirements of the solicitation, including all salient physical, functional, and performance characteristics outlined in the Requirements Statement.

Acceptable: The quotation clearly meets the minimum requirements of the solicitation.

Unacceptable: The quotation does not meet the minimum requirements. Quotations rated "Unacceptable" will be removed from further consideration for award.

Factor 2: Past Performance

The Government will evaluate the Quoter's past performance to assess the level of confidence the Government has in the Quoter's ability to successfully perform the required effort. The Government may use data from the Supplier Performance Risk System (SPRS), the Contractor Performance Assessment Reporting System (CPARS), and any other sources available to the Government.

Evaluation Rating: Quoters will receive a confidence rating (e.g., Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence, or No Confidence). Note:

Quoters with no relevant past performance history will be assigned a "Neutral Confidence" rating and will not be evaluated favorably or unfavorably.

Disqualification Criterion (Terminations): If the Government's evaluation reveals that a Quoter has received a Termination for Cause or a Termination for Default on a federal contract within the past thirty-six (36) months, that Quoter shall be assigned a rating of "No Confidence."

Quotations receiving a "No Confidence" rating are ineligible for award.

Factor 3: Price

Price will be evaluated to determine if it is fair, reasonable, and balanced. The Government will evaluate the total evaluated price, inclusive of all equipment, installation, disposal, and shipping /freight charges.

Tradeoff Mechanism:

The Government is not strictly bound to award to the lowest-priced Quoter. The Government may award to a higher-rated, higher-priced Quoter if the Contracting Officer determines that the Quoter's superior Past Performance track record justifies the price premium, ensuring the highest probability of successful, disruption-free execution of the requirement.

(b) Options (if applicable). The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced.

The evaluation of options does not obligate the Government to exercise the option(s). (Note: If no options are included in the schedule, this paragraph is Not Applicable).

(c) Notice of award. In accordance with FAR 12.201-1(b), a quotation does not constitute an offer that can be accepted by the Government to form a binding contract. Therefore, the Government's selection of a successful quotation will result in the issuance of a written purchase order (SF 1449) to the successful Quoter. A binding contract is formed only when the supplier accepts the Government's offer, either by written acceptance of the purchase order or by substantial performance.
