Justification Under the Authority of the FAR 13.5 Simplified Procedures for

Certain Commercial Items 41 U.S.C. 1901

Justification for Other Than Full and Open Competition

FAR 13.501

2. Description of Action: (FAR 6.303-2(b)(2)) Bridge Action: Yes No Approval is being requested to continue the acquisition of services to support Military Freefall (MFF) and refresher/sustainment qualification training under Indefinite Delivery Indefinite Quantity (IDIQ) contract H92240-16-D-0007 through the unchanged ordering period ending 05 MAY 2021. More specifically, the contract has reached the maximum ceiling value of $5,000,000.00 while requirements continue. Therefore, increasing the ceiling value of this Sole Source, Firm Fixed Price (FFP), IDIQ contract to Skydive Perris remains the most appropriate method to procure existing requirements, reduce lead-times, and expedite future orders for training and operational requirements.

Per FAR 13.501, post on FBO within 14 days after contract award, or within 30 if based on urgency (unless a 5.202 exception applies).

The IDIQ contract is currently near the maximum ceiling value of $5,000,000.00 established under amendment P00006 dated 31 AUG 2020.

As such, additional capacity will be required. The ceiling increase will not exceed $700,000 in FY21 for the new total contract value of $5,700,000.00.

This contract modification will allow for sustainment of the MFF training requirements, refresher training, and parachute rigger support.

3. Description of Supplies/Services: (FAR 6.303-2(b)(3)) Services include professional Air Mobility Command (AMC) / Commercial Airlift Review Board (CARB) certified commercial carriers for parachute operations in California. Parachute operations include land and water drops (jumps).

The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision of contractor personnel, and services necessary to perform contracted ramp aircraft support for parachute operations.

4. Authority Cited: (FAR 6.303-2(b)(4)) This sole source acquisition is being conducted under the authority of the simplified acquisition procedures for certain commercial items at 41 U.S.C. 1901, as implemented by FAR 13.501(a).

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) This sole source modification to increase the contract ceiling value by $700,000.00 was estimated based on remaining requirements for this contract. Skydive Perris is the only vendor who can provide the required services without significant delay in urgent training requirements and without significant additional cost due to geographic location by reducing costs and ferrying fees associated with redirecting aircraft to be compliant with 14 CFR Part 91 protocols and current certification and safety requirements which allow mission essential training to continue.

The approval to increase the ceiling value is considered in the best interest of the Government as an award to any other company would conceivably increase the cost due to compliance with multiple post award certifications and safety requirements.

Additionally, there will be no change in the ordering period ending 05 MAY 2021. This IDIQ contract value increase will allow for continuity of support with Skydive Perris while ensuring proper safety and cost-effective training events until a new MFF enterprise contract is awarded.

6. Efforts/Actions to Increase Competition: (FAR 6.303-2(b)(6)) The notice will be posted with the solicitation as it cites a brand name.

A notice will be posted within 14 days of contract award (30 if based on urgency).

The notice was not publicized as required by FAR 5.2. If a notice was not publicized, the exception cited under FAR 5.202(a)(1) through (13) was: .

7. Market Research: (FAR 6.303-2(b)(8)) Skydive Perris is the only Contractor capable of supporting this requirement within the geographical area of Southern California. TAC-AIR (aka Skydive San Diego) has been reviewed and does not have the aircraft capacity to support this near term requirement.

Furthermore, any increase to frequency/utilization of TAC-AIR would directly impact the Navy Parachute Course (NPC) conducted by NSW Center. The Market Research Report will be updated and added to the contract file to support this action.
