About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a sole source contract issued by UNICOR, Federal Prison Industries, U.S. Department of Justice. The document seeks a 1-year Indefinite Delivery/Indefinite Quantity (IDIQ) contract with Arakelian Enterprises (DBA Athens Services) for trash service at the UNICOR Terminal Island Recycling Factory in San Pedro, California. The contract is valued at $40,000 and is being awarded solely to the current trash vendor for the Federal Correctional Institution (FCI) Terminal Island, based on security concerns raised by the facility's top security official who wants to limit the number of vendors accessing the grounds.
The sole source justification is predicated on the vendor already being under contract for trash services at the adjacent prison facility, with the security official determining that utilizing the existing vendor minimizes potential security risks. The JOFOC will be posted on SAM.gov for 14 days, and the Terminal Island Recycling Factory plans to collaborate with the Bureau of Prisons (BOP) in future procurement to better understand and incorporate security requirements into the solicitation process. The contract covers fiscal year 2026 and is being awarded under Federal Acquisition Regulation (FAR) 6.302-1 authority, which allows for contract awards when no other supplies or services will satisfy agency requirements.

U.S. DEPARTMENT OF JUSTICE
UNICOR, FEDERAL PRISON INDUSTRIES
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLE SOURCE
AUTHORITIES CITED: FAR 6.302-1 No Other Supplies or Services Will Satisfy Agency Requirements.
Field Requisition #: 1031786902 Solicitation #: n/a
1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING AUTHORITY
ORIGINATING THE J & A.
UNICOR, SERVICES BUSINESS GROUP (SBG)
Terminal Island RECYCLING FACTORY 1299 S Seaside Ave San Pedro, CA 90731
NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.
UNICOR Terminal Island Recycling Factory in California is requesting a Sole Source Award Justification, for a 1-year Indefinite Delivery/Indefinite Quantity (IDIQ) contract, to be awarded to Arakelian Enterprises (DBA Athens Services, LM3WM6J6Z2L6) for trash service at the Unicor Terminal Island Recycling Factory.
The Unicor Recycling Factory is ancillary to the BOP prison facility at FCI Terminal Island. Captain Z. Hacker at FCI Terminal Island is the top security official at that location which covers both the prison and the factory. Captain Hacker has determined that limiting the number of vendors coming and going on the grounds is in the interest of safety and security of the institution. This security concern is heightened since trash is hauled outside of the perimeter fence. Therefore, this JOFOC is giving reason why trash service at FCI Terminal Island Recycling Factory is being limited to whichever vendor is contracted for trash at that location. Arakelian Enterprises DBA Athens Services currently holds the trash contract at FCI Terminal Island under 15B61426P00000020 which covers fiscal year 2026.
Estimated Dollar Value: $40,000.00
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED MEETING THE
AGENCY’S NEEDS.
This service has historically been fulfilled utilizing the BOP contract for trash service at the FCI Terminal Island factory. This JOFOC attempts to continue the past practice.
3. DEMONSTRATE THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE
AUTHORITY CITED.
The BOP has a current trash contract in place and the Captain is limiting vendors on the grounds. As we are ancillary to the prison, and we have trash, we will be utilizing the current trash vendor for this location.
4. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIONAL SOURCES AS IS PRACTICABLE, INCLUDING
WHETHER A SAM.GOV ANNOUNCEMENT WAS OR WILL BE PUBLICIZED AS
REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES.
This JOFOC will be posted to SAM.gov for 14 days.
5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.
FCI Terminal Island is under contract for this service. FCI Terminal Island solicits these services.
6. DESCRIPTION OF THE MARKET SURVEY CONDUCTED AND THE RESULTS, OR A
STATEMENT OF THE REASONS A MARKET SURVEY WAS NOT CONDUCTED.
There are other trash services available on the market, however, only one is already under contract and on the grounds of FCI Terminal Island.
7. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION, SUCH AS:
The use of other than full and open competition is for FCI Terminal Island Recycling trash service only.
8. LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION.
None
9. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE
OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES IS REQUIRED.
The Terminal Island Recycling Factory will look forward and plan with the BOP to understand their security requirements. Those requirements can then be solicited knowing that the service will be needed for both the prison and the factory.
10. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS
ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S
KNOWLEDGE AND BELIEF.
As contracting officer, I certify that this justification is accurate and complete to the best of my knowledge.
