directed by Executive Order 14074: Advancing Effective, Accountable Policing and Criminal Justice Practices to Enhance Public Trust and Public Safety. Pursuant to the Federal Information Security Modernization Act, Federal Government, as implemented by OMB Circular A-130, the use case for these services must be FedRAMP Authorized. Axon is uniquely qualified to provide these services to the OIG, Office of Investigations because the supplies or services required are available from only one responsible source and no other type of supplies or services will satisfy agency requirements because they are the only provider that is FedRAMP Authorized. The unique or highly specialized qualities are Body-Worn Camera(s) (BWC’s) are audio and video recording devices worn by law enforcement officers as part of their work attire to document what they see and hear as they perform their duties. OIG/INV requires the ability to ingest, manage and share BWC video captured during law enforcement operations. OIG/INV has a strict requirement for BWC video ingest to a FedRAMP JAB Provisional Authority to Operate P-ATO evidence collection system for BWC video/audio evidence. Digital Evidence Management System/Software/Solution(s) (DEMS) Bundle is software used to store, manage, secure, share, redact and protect digital evidence, most typically in the form of video, photo, and audio records.

OIG/INV requires a DEMS in the form of Software as a Service (SaaS) which is hosted in a vendor provided cloud environment. The SaaS solution must be currently FedRAMP JAB P- ATO Authorized with an Authority to Operate (ATO) rated for impact level moderate. The Axon Software as a Service (SaaS) allows for secure management, access and sharing of digital evidence. Axon Evidence is the only software that includes FedRAMP Authorized solutions that allow for Citizen Digital content request/ingest and AI powered Redaction. Axon Evidence can also store and support various forms of third-party data and can ingest evidence collected from the mobile phone application, Axon Capture. Lastly, Axon Evidence allows for secure case sharing with current Axon Evidence partner agencies as well as the Executive Office of United States Attorneys (EOUSA). DOJ-EOUSA has standardized on Axon Evidence for their BWC

DEMS.

4. The authority and supporting rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the supply or services.

This acquisition is conducted under the authority of the FAR 6.3, as implemented by FAR

6.302 (41 U.S.C.3304) and substantiated by the following:

FAR 6.302 1 “Only one responsible source and no other supplies or services will satisfy agency requirements.” See 41 U.S.C.3304(a)(1).

5. A determination by the ordering activity Contracting Officer that the order represents the only source available consistent with FAR 6.302-1.

The Contracting Office determines that the anticipated price(s) will be fair and reasonable based on previous purchases paid for similar supplies and services by other federal agencies. By signing the justification, the Contracting Officer decides that the price to the Government is expected to be fair and reasonable.

6. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Additionally, the office has conducted extensive market research, at this time no other company meets OIG requirements. Research included of reviewing of the FEDRAMP dashboard for qualified vendor within the space, The Federal Risk And Management Program Dashboard (fedramp.gov), OIG-EX/IT mandates, specifically, Information, and Information Systems that states vendor/contractor shall comply with all security requirements, including but not limited to the regulations and guidance found in Federal Risk and Authorization Management Program (FedRAMP). Extensive consultation with the Council of Inspectors General on Integrity and Efficiency (CIGIE) Body Worn Camera Working Group, this working group in collaboration with the Department of Justice provided guidance on the initial Body Worn Camera Agency requirements to comply with Executive Order 14074. At this time, Axon's service is the only known vendor to meet these requirements. A yearly survey will be done of the marketplace to ensure that new products are not missed and that if there are new products they will be fairly evaluated and will be reviewed

7. Any other facts supporting the use of this justification.

Pursuant to the OIG Office of Information Technology, Information Security Policy, Cloud Security, the SaaS (Software as a Service) solution for Digital Evidence Management System must be FedRAMP Authorized. Axon's current FedRAMP status, Axon’s FedCloud achieved FedRAMP Authorization with a JAB P-ATO at the Moderate Impact Level on April 2nd, 2019. The authorization confirms that Axon’s FedCloud has been reviewed and approved by the U.S. Department of Defense, U.S. Department of Homeland Security, and the General Services Administration. The authorization enables Federal agencies to streamline their own internal authorization processes of Axon’s FedCloud Services, which includes its Digital Evidence Management System (DEMS). Any other body warn camera model would be unusable in the OIG environment given the parameters listed above. Additionally, the Federal Risk and Authorization Management Program (FedRAMP) is a government program managed by the General Services Administration. It was designed to provide a standardized system for assessing, authorizing and continuously monitoring cloud products and services. Interested offerors must provide a Cloud Service solution that meet the FedRAMP requirements in order to be considered for this requirement. OIG requires the use of a FedRAMP certified vendor to capture and maintain Body Worn Camera video and associated evidence.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

For the reasons set forth in paragraph 3, there are no plans at this time to compete future contracts for the types of supplies covered by this one manufacturer justification. If another potential source emerges, an assessment will be made at that time to determine whether future competition is feasible.
