SOLE SOURCE / BRAND NAME JUSTIFICATION AND APPROVAL FOR PURCHASES NOT EXCEEDING THE SIMPLIFIED ACQUISITION THESHOLD FAR 13.106-1(b)(1)
1. In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the Online Legislative Research Service on DNAR20019 is available from only one source, and competition is precluded for the reasons indicated below. There are no substitutes available. Some other online legislative services exist, but none as comprehensive as CQ online. One such service is Thomas that is free, however, it is only a search tool for bills, reports and other publicly available documents. Thomas does not provide a news service with daily articles about congressional actions or any other qualitative information that is essential for LPA staff members to perform their jobs efficiently. On many occasions, it has been several days before the Library of Congress receives the same information to post on Thomas (usually not until after bills are filed for floor action), that is available in real-time from CQ. Two other online services are Lexis-Nexis and GalleryWatch.com. None of the CQ content is available through Lexis-Nexis, which does not specialize in legislative tracking but rather primarily has news and legal information regarding existing law, not what Congress is doing on a daily basis. GalleryWatch is a small service run out of Texas that primarily relies on other sources for its information. Unlike CQ, which has 125 reporters covering the Hill around the clock, GalleryWatch has no Hill reporters.
2. This acquisition is restricted to the following source:
Company:
CQ Roll Call, Inc.
Company Address:
77K Street, NE, 8th Floor
Washington, D.C. 20002 Company Point of Contact and Phone Number:
3. The Online Legislative Research Services is estimated $47, 856.00. The period of performance for these services is 01 October 2011 to 30 September 2012.
The Online Legislative Research Services are required for LPA’s Legislative Affairs mission.
4. Specific characteristics of the Online Legislative Research Services limit the availability to a sole source is this company is the only one that provides this comprehensive service. Only this suggested source can furnish the requirements, to the exclusion of other sources, because they are the only company that provides this service. The service required is Licenses/subscriptions for unlimited access to all Congressional Quarterly commercial legislative and news research databases for 5 users for a 12-month period beginning immediately upon the expiration of DSCA’s current subscription to maintain continuous and uninterrupted access to the online service for DSCA LPA users. The Congressional Quarterly licenses/subscriptions must include unlimited access to the complete range of highly specialized legislative and news research databases available through Congressional Quarterly.
5. Check and fill in all that are applicable:
· The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. CQ online legislative and news research service provides the most authoritative and comprehensive collection of legislative, news, business and public records available. With it comes the best and most thorough coverage of day-to-day Hill actions and many unique tracking alert tools that keep LPA staff members apprised of ongoing actions in a timely manner. CQ covers all defense hearings and usually has transcripts available online within a day or two (rather than a week or more on the House and Senate committee websites). CQ provides articles regarding congressional events of interest on a real-time basis, usually within an hour or two of an event concluding (bill markup, committee hearing, floor vote, etc.). E-mail alerts with these articles are sent throughout the day and LPA staff members are able to provide such information to DSCA leadership and others as needed. Also customized alerts can be established for key words and legislation to notify LPA staff members whenever there has been action on any issue of interest. CQ provides in-depth training as an integral part of their service.
· A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:
<Insert description>
· These are "direct replacement" parts/components for existing equipment.
· Other information to support a sole-source buy:
CERTIFICATION
I certify that statements checked and information provided above are complete and correct to the best of my knowledge. In accordance with FAR 13.106-1(b)(1),the processing of this sole-source justification precludes the use of full and open competition.
