AMENDMENT OF SOLICITATION/MODIFICATION OF CONTRACT

Amendment of Solicitation No. SOL-669-16-000005 Amendment No. 01

1. Standard Form 1442, Block 10, the requirement for performance and payment bond is changed to read

“An Irrevocable Letter of Credit in the penal amount of 100% of the contract price shall be submitted to

U.S Government after award but before issuance of Notice to Proceed.

2. Standard Form 1442, Block 12A and 12B is changed to read “THE CONTRACTOR MUST FURNISH

AN IRREVOCABLE LETTER OF CREDIT WITHIN 15 CALENDAR DAYS”.

3. Standard Form 1442, Block 13.B. is changed to read: “An offer guarantee is not required”.

4. Standard Form 1442, Block 18 is changed to read “The offeror agrees to furnish any required Irrevocable

Letter of Credit”.

5. FAR 52.228-1 – BID GUARANTEE (SEP 1996) listed on pages 70-71 of the solicitation is hereby deleted in its entirety.

6. FAR Clause 52.228-11 – PLEDGES OF ASSETS (JAN 2012) listed on pages 71-72 of the solicitation is hereby deleted in its entirety.

7. FAR Clause 52.228-15 – PERFORMANCE AND PAYMENT BONDS – CONSTRUCTION (OCT

2010), listed on pages 76-77 of the solicitation is hereby deleted in its entirety. Offerors are still required to provide an Irrevocable Letter of Credit as stated in pages 72 through 76 of the original solicitation.

8. Section L.9.2., Price Proposal, is changed to read:

Paragraph 4) As an annex to the Price Proposal, the Contractor must submit a certified letter from a lending institution ensuring that, upon contract award, the lending institution will issue an “Irrevocable

Letter of Credit” as specified in Section I.

6) The cost of the “Irrevocable Letter of Credit” shall be included in the price. The Contractor shall not charge any indirect costs or fees on the cost of the “Irrevocable Letter of Credit”. The cost is a separate line item that is added after all other costs have been calculated.

7) The Page limitation for Evaluation Criteria has been increased to afford offerors sufficient space to clearly describe works to be completed in each facility. To this end, Section L.8 INSTRUCTIONS

FOR THE PREPARATION OF THE TECHNICAL PROPOSAL is changed to read as follows:

To assure timely and equitable evaluation of proposals, Offerors’ technical proposals must be submitted in the following format must follow the instructions contained herein:

Standard Form (SF) 1442

The Offeror must complete and submit Standard Form (SF) 1442, “Solicitation, Offer, and Award”, with blocks 14 through 20C completed, with an original signature of a person authorized on behalf of the Offeror to sign the offer.

Branding and Marking Plan

Representation and Certifications

1) Technical Approach (100 pages)

The Offeror must address how it intends to implement all of the tasks indicated in section C and consistent with the deliverable table in section F.6 such that the desired results are achieved and the overall project goals realized by the end of the project’s life. At the minimum the Offeror’s technical approach shall include the following:

Clearly describe how offeror it intends to implement all of the tasks as indicated in section C consistent with the deliverable table in section F.6 such that the desired results are achieved and the overall project goals realized by the end of the project’s life.

Clearly describe how all construction works will be completed within the performance period considering the complications associated with working in rural Liberia including: the limited annual constructing periods, limited local access to construction materials, relative scarcity of skilled construction works-man, limited pool of competent local contractors and the logistical challenges of working across seven counties.

Clearly describe what lessons learned if any from related projects, both locally and international can be adopted to improve efficiency under SHINE.

Clearly describe how the offeror will enhance local contractor’s capacity development during the implementation of SHINE while at the same time maintaining project quality and deliverable schedules.

Clearly describe how the offeror will coordinate and collaborate with multiple project beneficiaries, USAID, and relevant GOL ministries and agencies, considering the complexity and diversity of stakeholders under this project.

Clearly describe any major challenges/risks to the achievement of the project goals, and how these challenges will be mitigated.

Clearly describe and outline all underlining assumptions, implementation strategy and construction methodologies.

2) Experience (10 pages)

The offeror shall provide a summary description of up to five (5) relevant projects implemented over the past ten (10) years similar in nature to the works described in Section C. The project summary is to include a brief description and identify the capacity of the firm that worked on the project, the risks associated with execution of the work and how those risks were mitigated. At least three (3) of these are to include recent projects performed concurrently within the last 10 years. The project summary shall also include the extent to which local sub-contractors were utilized during the project implementation. Project information on each project

CONTINUATION PAGE – Page 4 of 5 presented shall include: Project name, contract number, and location; Type of contract, date of completion and/or percentage of completion, name of customer, agency, or firm; Offeror’s specific role in the project;

Project description in sufficient detail to demonstrate the similarities with this project(s); and point of contact information for the customer, agency, or firm.

3) Key personnel (5 pages)

The offeror is to submit information for proposed key personnel that address all the requirements identified in

F.8 Key Personnel. The key personnel information shall be presented as a summary of each proposed personnel achievements, qualifications and experiences on relevant project in the past. Further details on key personnel shall be presented in Resumes, as annexes. The resumes shall include the title, duties, and responsibilities of the individuals and examples of project experience. Examples of project experience shall include the capacity the individual served on each project, dates employed on each project, and monetary size of each project.

4) Project Management Plan (5 pages)

The Project Management Plan is to describe how an offeror intends to manage the project throughout the construction period with emphasis on how a quality product will be produced, on schedule, and who will be responsible for overseeing and doing each phase of the work. The offeror must provide an overall Project

Management Plan that describes the organizational structure, staffing, and sub-contracting plan (if any) that the offeror will utilize to achieve the objectives and tasks listed in the Statement of Work. The Management

Plan must align with the offeror’s technical approach and deliverable table provided in section F.6 of this

RFP.

The offeror must describe the proposed financial, procurement and project management tools which will be adopted to implement the project considering the logistical, schedule, and technical challenges associated with construction project delivery in Liberia.

5) Past Performance (10 pages)

(a) The offeror shall provide past performance information for each project listed by the offeror under Factor

2: Experience. Recent and relevant projects are those projects completed or substantially completed** in the past 10 years that are comparable in size, scope, and complexity with this project.

** Substantially completed is defined as having completed more than 90% of the project work at the time of proposal submission.

(b) The offeror (including all partners of a joint venture) must provide performance information for itself, the contractor teaming arrangements, if any, and each major subcontractor in accordance with the following:

1. List in an annex to the technical proposal up to five references of recently completed contracts or orders of the most recent and relevant contracts for efforts similar to the work in the subject proposal.

The most relevant indicators of performance are contracts of similar size, scope, and complexity.

2. For all contracts listed above complete the attached Past Performance Cover Page (Attachment J.6), provide a list of contact names, job titles, mailing addresses, phone numbers, e-mail addresses, explanation of relevance to the proposed acquisition and a description of the performance to include:

• Scope of work or complexity/diversity of tasks,

• Primary location(s) of work,

• Term of performance,

• Dollar value, and

• Contract type, i.e., fixed-price, cost reimbursement, etc.

(USAID recommends that you alert the contacts that their names have been submitted and that they are authorized to provide performance information concerning the listed contracts if and when USAID requests it.)

(c) If extraordinary problems impacted any of the referenced contracts, provide a short explanation and the corrective action taken (FAR 15.305(a)(2)).

(d) Describe any quality awards or certifications that indicate exceptional capacity to provide the service or product described in the statement of work. This information is not included in the page limitation.
