GENERAL INFORMATION:

This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The National Park Service contemplates award of a firm fixed price contract as a result of this combined synopsis/solicitation to the vendor. This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P8124Q0054. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2024-05 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

The acquisition is in support of Mojave National Preserve.

This is a 100% Total Small Business Set Aside. The North American Industry Classification System (NAICS) code is 211130 – Natural Gas Extraction. The small business size standard is 1,250 employees.

Award Selection Process:

Per FAR Part 13.106-2(b) evaluation will be conducting by comparative evaluation of offerors. This solicitation is not stating nor required to state the relative importance assigned to each evaluation factor and/or sub factor (FAR 13.106-1(a)(2)).

1. PRICE.

2. TECHNICAL: Provide a project narrative that demonstrates how the Prime Contractor will successfully meet the needs of the statement of work. Narrative shall describe how the Prime contractor plans to directly superintend the work during the performance of the contract until the work is completed and accepted. The superintendent(s) shall demonstrate managing the projects quality control, safety, and schedule in accordance with the statement of work. Superintendent shall demonstrate they have the authority to direct subcontractors on the behalf of the prime contractor and can make real time changes if there is a non-conformance issue. See attached Statement of Work (SOW) demonstrating required superintendent duties. If the prime contractor is subcontracting the vault toilet pumping services, the technical approach shall demonstrate adherence to the SOW requirements for an onsite superintendent to manage the work directly at the Park location noted in the SOW. Quotes that copy and paste the language directly from the specifications without a comprehensive analysis may be rated less favorably.

3. PRIOR EXPERIENCE: Include factual documentation or narrative demonstrating firm’s PRIME contractor relevant experience and subcontractor relevant experience in the specific disciplines (work types) they will be performing. Provide three (3) examples of the firm’s recent projects within the past five years, from the solicitation close date, of similar size, complexity and scope.

Quoter shall provide contact information (name, phone number, email) from their references.

Quoters are encouraged to emphasize their relevant experience to the scope of this requirement.

4. KEY PERSONNEL EXPERIENCE: Quoted Key Personnel demonstrates relevant experience with projects performed within the past five years, from the solicitation close date, of similar size and scope (Site Superintendent) as identified in the Clauses section this solicitation. The proposed site superintendent shall demonstrate five years experience, from the solicitation close date, with direct superintendence with similar scope (SOW). The proposed site superintendent is subject to substitution requirements contained in this solicitation. There is no preprinted form for this submittal.

5. PAST PERFORMANCE: {Quoter references and point of contact from Experience section above may be used by the Contracting Officer to verify the recency, relevancy, and quality of quoter’s past performance.} The Contracting Officer will evaluate the degree to which the quoter successfully performed past projects similar in scope, magnitude and complexity to the project detailed in this solicitation within the last five (5) years, from the solicitation close date, and satisfied past customers, using the quoter’s provided references.

Past performance information from other sources, including the Contractor Performance Assessment Reporting System (CPARS), may also be utilized in the determination of the past performance record. In addition to those references provided directly by the quoter, the Contracting Officer may identify and analyze the past performance of the quoter on any other relevant contract which the Contracting Officer has knowledge or obtains knowledge, including but not limited to projects listed in CPARS. The Quoter shall submit a minimum of three (3) and a maximum of five (5) references for entities that have contracted with the quoter. For each reference, the quoter must submit at least one POC name, address, email and phone number.

Option Contract language:

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

INSTRUCTIONS TO OFFERORS:

Quotes must be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.

All interested parties shall be registered in the System for Award Management or SAM at time an offer or quotation is submitted.

(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of “(DEVIATION)” after the date of the clause.

KEY PERSONNEL REQUIREMENTS

(A) Certain skilled experienced professional and/or technical personnel are essential for successful contractor accomplishment of the work to be performed under this contract. These are defined as "Key Personnel" and are those persons whose resumes were submitted for evaluation of the proposal. The contractor agrees that such personnel shall not be removed from the contract work or replaced without compliance with paragraphs (b) and (c) hereof.

(B) If one or more of the key personnel for whatever reason becomes, or is expected to become, unavailable for work under this contract for a continuous period exceeding thirty (30) work days, or is expected to devote substantially less effort to the work than indicated in the proposal or initially anticipated, the contractor shall immediately notify the Contracting Officer and shall, FAR 52.252-2 Clauses Incorporated by Reference FEB 1998

FAR 52.252-6 Authorized Deviation in Clauses NOV 2020 http://www.acquisition.gov/far/ subject to the concurrence of the Contracting Officer or his authorized representative, promptly replace such personnel with personnel of at least substantially equal ability and qualifications.

(C) All requests for approval of substitutions hereunder must be in writing and provide a detailed explanation of the circumstances necessitating the proposed substitutions. They must contain a complete resume for the proposed substitute, and any other information requested by the Contracting Officer or needed by him to approve or disapprove the proposed substitution. The Contracting Officer or his authorized representative will evaluate such requests and promptly notify the contractor of his approval or disapproval thereof in writing.

(D) If the Contracting Officer determines that suitable and timely replacement of key personnel who have been reassigned, terminated or have otherwise become unavailable for the contract work is not reasonably forthcoming or that the resultant reduction of productive effort would be so substantial as to impair the successful completion of the contract or the services ordered, the contract may be terminated by the Contracting Officer for default or for the convenience of the Government, as appropriate, or, at the discretion of the Contracting Officer if he finds the contractor at fault for the condition, the contract price or fixed fee may be equitably adjusted downward to compensate the Government for any resultant delay, loss, or damage.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(2) While not required, the Contractor may include in its subcontracts for commercial products and commercial services a minimal number of additional clauses necessary to satisfy its contractual obligations.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within _30 days from contract expiration.
