Scope of Work

Scope: The contractor shall perform work related to seed increase for common native grass and or forb species. The contractor will use only government furnished seed to start seed increase fields for native seed production. These park-specific ecotypes of genetic sourced seed are needed for utilization in the recovery of disturbed areas as a result of transportation, facility, and visitor enhancement developments occurring at parks. The contractor will be required to perform the following tasks: establishment, maintenance, and harvesting of seed increase fields originating from NPS genetic stocks; seed cleaning, seed testing, and delivery of produced seed.

Confidentiality: The original wildland seed provided to the contractor and the genetic seed stock produced under this contract are the sole property of the U.S. government and shall be kept in strict confidence. All seed and plant materials associated with this contract shall be provided to the government or destroyed as agreed upon by the government and the contractor.

Performance Period: Five years from the date of award.

Contacts:

The following individuals are to be contacted with any questions, concerns, and issues regarding this work. No other individuals are authorized to make decisions regarding this work during any portion of the work.

Contracting Officer (CO): LJ Gravelle, lj_gravelle@nps.gov, 720-415-1428 Contract Specialist (CS): Damon Griffin, damon_griffin@nps.gov Contracting Officer’s Representative (COR): Amanda Stein, amanda_stein@nps.gov, 303-905 4934 Ad Hoc: TBD

Abbreviations:

NPS – National Park Service CO- Contracting Officer COR- Contracting Officer’s Representative NPS-National Park Service NRCS -Natural Resource Conservation Service PLS -Pure Live Seed AOSCA -Association of Official Seed Certifying Agencies Locally collected, genetically appropriate seed is required for NPS revegetation and restoration work.

Utilizing ecologically appropriate seed for restoration and revegetation work supports the mission and policies of the National Park Service. Contractor tasks related to seed increase services for the NPS include maximizing production of government furnished seed in seed increase fields by cultural treatment (mechanical cultivation, fertilization, irrigation, weed control, insect and disease control), minimizing non-target plants in seed production (weeds, off-type bromes, other crops, and other non-target species), seed harvesting, seed cleaning, seed testing, seed storage, seed delivery, and reports.

The scope of services included in this contract will require the contractor to utilize only park collected (government furnished) seed to establish seed increase fields and to maximize production of the species mailto:damon_griffin@nps.gov mailto:amanda_stein@nps.gov

Denver Service Center Page 6 of 64 planted. The contractor will be required to maintain isolation distances needed to ensure the genetic integrity of the NPS provided seed as defined by seed certifying entities and established seed production rules and guidelines (as in NRCS foundation seed guidelines).

The contractor will be provided with native genetically appropriate seed accessions from in park collections. The contractor will then (if necessary) clean the collections, tested for purity and viability, sow in a field setting at the requested field size, and maintain fields (including mechanical cultivation, weed control, insect and disease control, irrigation, fertilization, and other needed cultural treatments) for the period of performance specified in the contract. Each harvest year the contractor will harvest to minimize non-target species and maximize viable seed quantities of target species. Harvested seed will be handled, dried, and stored per industry standards to maximize seed viability and minimize non-target seed.

Harvested seed will be tested, stored, and then delivered upon request to the park unit.

The species to be grown by the contractor will be native species of ecotypes that originate from a National Park Service unit. The contractor should be familiar with increasing species native to the mid-western region including forb and grass species with short growing seasons. Priority will be given to growers with experience growing species and ecotypes from the region where the seed originated, whose grow locations do not have weeds that do not occur in the park or region where the seed originated, and whose seed increase environments are similar to the location where the germplasm originated thus producing seed that is minimally affected by its growing environment. The largest park service units in the mid-west region are high latitude and mid-elevation parks in North and South Dakota however, other park units to the south and west will also utilize this BPA.

I. Scope of Services The contractor will manage native seed production fields by utilizing the best industry standards to maximize seed production which may include providing fertilization, irrigation, and weed control for the species at optimal time periods, also harvest the seed at optimum maturation for maximum seed production and viability. The contractor will ensure the prevention of cross-pollination with local or other varietals of the same or similar species by following industry distancing minimums (CSGA 2020, NRCS foundation seed guidelines) and will provide documentation of prevention methods.

Field Inspection reports conducted by state seed certifying agency that is a member of the Association of Official Seed Certifying Agencies (AOSCA), or equivalent, will be supplied yearly as written documentation.

Task 1. Native Seed Increase

Seed production: this task will include all labor and materials for seed cleaning of government provided seed accessions, testing and inventorying, field preparation, planting and establishment; field maintenance, harvesting of seed and curation, final seed cleaning, testing, storage, and shipment of seed. Seed storage shall be in a controlled environment, for a time period to be negotiated between the government and the contractor and will vary based on needs of each ordering park unit. Most seed will be shipped directly to the park unit in the year of production or the following season.

Task 1a. Receive and clean wildland collection from NPS park unit Task 1b. Before planting test seed at a certified, and NPS approved, lab for viability, germination, and purity including a weed analysis.

Task 1c. Planting and establishment Task 1d. Maintenance including weed control, irrigation, etc.

Task 1e. Yearly harvesting at a time or multiple times that maximizes seed production Task 1f. Seed Cleaning Task 1g. Seed testing -following cleaning test seed at a certified, and NPS approved, lab for viability, germination, and purity including a weed analysis (including for all off type bromes, all states noxious, and other crop or non-target analysis).

Denver Service Center Page 7 of 64

Task 1h. Storage. Most seed will be delivered to NPS upon completion of cleaning and testing.

If longer term storage is required it will be negotiated between the government and contractor for each order.

Task 1i. Shipment to the park should follow all state and federal laws.

Common species for NPS revegetation and seed increase include many grass and forb species (Table 1). The provided list is not exhaustive and orders for these or other species will be negotiated as needs arise and new contract/orders are announced. If a species targeted for increase is particularly labor intensive to establish or harvest, then NPS and the contractor will negotiate other viable species alternatives or appropriate reimbursement to work with selected (difficult) species.

This will be included as a pay item in each task order as needed.

Denver Service Center Page 8 of 64

II. TYPICAL SCHEDULE

Schedules may vary depending on the availability of government provided seed. A sample schedule is shown below to provide a frame work and clear expectations for the government and contractors.

Wildland collected seed provided to contractor -- If park has seed on hand this will be provided to contractor upon award of a new contract as early as possible in the year. If seed is not on hand and will be provided from a new wildland collection, then it will be given to the contractor following completion of field collections which are typically late fall. The government and contractor will work together to determine the appropriate quantity of seed required for the specified field sizes. Typically seed increase seeding rates are expected to follow regional Natural Resource Conservation Service (NRCS) planting guidelines and published technical notes or other equivalent publications. In absence of published propagation guidelines or protocols best available information will be utilized including publications from nearby regions or other appropriate third party sources.

Contractor to clean and test seed provided by government – Typically, wildland collected seed will be rough cleaned by collectors. Contractor may need to reclean to meet needs of seeding equipment.

Contractor will clean seed to meet their own needs likely determined by the seeding method.

Following receipt and cleaning if required, the contractor will submit seed for purity and viability tests with an approved seed testing lab. If it is anticipated that there will not be enough time after the receipt of seed to clean, test, and plant by the target planting window that shall be communicated to the government as early as possible.

Field establishment --Timing of field establishment will be determined by best practices developed for the species to be planted and contractor grow methods. For many species a dormant season planting may be appropriate and will be targeted to occur in the fall following the above tasks. Planting time will be determined by the contractor based on professional experience and expertise.

Field maintenance -- These native seed production fields may be managed by providing fertilization, insect and pest control, pathogen control, irrigation, weed control, and other standard field crop and plant maintenance requirements for the species planted at optimal time periods.

Weed and Non-Target Plant Control

The National Park Service has mandates to not bring in foreign organisms into park lands. As it relates to seed increase this includes weeds, especially those that are not present in a park unit.

The NPS’s definition of weeds includes all those species not native to the park unit including all non-native species, state listed noxious weeds, common agricultural weeds, common crop species and other geno-types of native species (not native to the park). Aggressive weed control should be conducted regularly. All non-target plants (not of the genotype, species or variety specified in the contract) shall be considered weeds and removed from in and adjacent to planted rows on a regular basis.

Seed harvest –Typically, harvest will take place the summer or fall of each contracted year depending on growing climate and species planted. The first year may be considered an establishment year.

Spring plantings and annual species may have the first year also as a production year. Harvest the seed at optimum maturation for maximum seed production and viability. Use harvesting techniques and timing that maximizes viable seed production.

Clean, test, and storage -- Seed shall be treated per quality standards, below. Following harvest and drying, the seed shall be cleaned, and a representative sample sent to a testing lab, typically in the late fall. Seed may be requested in the same fall as it was produced if timing of harvest, testing and park needs allow. Typically, seed will either be requested to be sent to the park upon completion of testing or will be stored for up to 12 months.

Denver Service Center Page 9 of 64

Reporting –Harvest, cleaning, and seed testing reports will be provided annually to the government no later than March 1st.

Seed delivery --Typically, parks will conduct dormant season seedings in the late fall. Seed will usually be requested by late summer or early fall. Contractor will arrange delivery of seed such that transit time is limited to no more than two days. If shipping via a commercial carrier seed will be shipped such that it is not in transit over weekends or holidays and shipping will be expedited to minimize time in transit.

Estimated timeline of major activities. Highly variable dependent on seed availability from government, species to be produced, grow out geographic location, yearly weather, and water supply to planted fields.

III. QUALITY STANDARDS

Quality standards shall be in accordance with commercial practices and as described in this statement of work. All work within this Scope of Work shall adhere to Quality Standards outlined below. If discrepancies exist, the more stringent standards shall apply. All seed, plants, and other propagules resulting from this agreement are from NPS germplasm and therefore remain the property of the NPS. As projects are completed and materials are no longer needed, all existing seed, plants or other propagules will be provided to the NPS or destroyed as specified by the NPS.

Inspections: All seed increase fields shall be inspected annually by a representative of the states’ Association of Official Seed Certifying Agencies (AOSCA). Inspections, land requirements, and isolation distances shall be based upon Foundation Certification

Denver Service Center Page 10 of 64

Standards (AOSCA ©2012, Effective July 2011) for foundation seed certification requirements.

Limitations of Generations: The grower agrees to establish provided G0 Breeder seed stock for increase and provide G1 seed stock to the NPS. No further generations are allowed unless prior approval in writing is provided by the National Park Service.

Field Establishment: Before planting the increase field contractor must submit the seed test of the seed to be planted and propose a planting rate per acre in Pure Live Seed (PLS) values. Tests and seeding rate will be discussed and agreed upon between the government and the contractor.

Volunteer Plants: All volunteer plants establishing in the fields (for example as a result of seed set or vegetation remnants) from the crop species shall be considered G1 plants and every reasonable effort must be made to remove these volunteer plants.

Harvest: Identity and purity of seed must be maintained at all times during harvest.

Equipment and facilities used for transporting, handling, and storing of seed must be as free as possible of other non-target seeds and may be inspected by COR.

Harvesting should be done in a manner that maximizes seed produced from the field and may include hand harvesting, multiple harvests from a field per year, etc.

Seed Standards and Seed Quality: The following minimum standards will apply to all seed increased.

i. Other Crop Seeds maximum 0.2%

ii. Weed Seeds maximum 0.1%

iii. Noxious weed seed 0%

iv. “Off type” brome seed should meet foundation seed certification standards and be in the range of <0.03%.

v. Isolation standards, distances from other plants that can cross pollinate. These should follow standards set by state seed certifying agencies or NRCS foundation seed standards.

Weed and Non-Target Plant Control: NPS units have a mandate to not bring in foreign organisms into park lands. As it relates to seed increase this includes weeds, especially those that are not present in a park unit. The NPS definition of weeds includes all those species not native to the park unit including all non-native species, state listed noxious weeds, common agricultural weeds, common crop species and other geno-types of native species (not native to the park). Aggressive weed and non-target plant control should be conducted regularly. All non-target plants (not of the genotype, species or variety specified in the contract and arising from government provided seed stock) shall be considered weeds and removed from in and adjacent to planted rows on a regular basis. Failure to control volunteer plants, without justification, may be cause for rejection by CO. Justifications may include phenology differences such as differing seed set times of weeds as compared to production crops.

Substandard Seed: Seed that fails to meet the requirements may not be accepted by NPS. Contractor shall provide, in writing, the reasons for substandard seed. The CO will determine if reasons are beyond the control of the grower. If the reasons are determined to be beyond the control of the grower, a mutually agreed upon strategy to complete this contract will be sought, which may result in a modification of this contract.

Seed Testing: Seed tests must include germination, Tetrazolium, purity, all states’ noxious weed exam, and all off-type non-target seeds identified. Tests must be completed at a university affiliated or state run Association of Official Seed Certifying

Denver Service Center Page 11 of 64

Seed Storage: Seed shall not be allowed to remain or become wet after harvest. Seed shall be stored in a building, shed, or warehouse that allows ample air circulation and is protected from rain, moisture, temperature extremes, and rodents or other conditions that would reduce the viability of the seed. The ideal temperature for seed storage is 40 to 50 degrees F with low relative humidity of between 40 and 50%. The acceptable range of storage temperatures is between 68 and 40 degrees Fahrenheit.

Seed Shipment: Seed shall be shipped in a manner that will prevent damage to the seed and arrive expeditiously at the park. The Contractor will be notified two weeks prior to the date the seed will be shipped to the park. The Contractor shall provide notification to the COR one week before the seed is shipped and shall provide the tracking number of the package by email as soon as it is available. The contractor may elect to self-deliver the seed to the park and can work with COR and park staff on delivery details. All shipments should minimize time spent in transit, minimize temperature extremes during shipping, and maintain a dry, yet “breathable”, environment for seed to maintain viability.

Commercial shipments should not be done such that seed is in transit over holidays or weekends.

Seed Delivery: All seed delivered shall conform to all laws and regulations pertaining to the shipment of seed required by the Federal Seed Act and the Seed laws pertaining to the representative state. The contractor will submit the original seed test analysis and copy of the seed tags by lot number to the park Technical Contact and COR. Seed is to remain dry and unmixed upon delivery.

DOI AAAP-0050 V2 – NOTICE TO CONTRACTORS

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (DECEMBER 2015)

1) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.

2) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html

3) We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.

4) When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.

5) Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.

a) Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.

b) Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.

c) All information provided should be reviewed for accuracy prior to submission.

d) If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.

e) Your response is due within 60 calendar days after receipt of the CPAR. On day 15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.

f) If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."

6) The following guidelines apply concerning your use of the past performance evaluation:

a) Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.

b) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

c) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.

7) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.

8) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
