Section C - Descriptions/Specifications/Statement of Work

C.1. Statement of Work

Section C

Statement Of Work

C.1. Background The Foreign Service Institute provides language training and testing to employees of the Department of State and other government agencies in more than sixty foreign languages. The School is responsible for the diverse and complex mission of language training for employees of the State Department and other U.S. Government agencies. The School of Language Studies consists of approximately 450 technical and professional personnel.

Enrollments surpass 4000 students annually, and include over 1000 Distance Learning enrollments.

The School of Language Studies is staffed by professionals in the field of foreign language teaching, culture, and applied linguistics. In addition to the full-time direct-hire staff, the School makes extensive use, through contract and other arrangements, of other professionals from outside the Foreign Service Institute. The Foreign Service Institute is actively seeking individual contractors for a variety of regular work schedules or occasional, intermittent activities. Successful contractors may join an existing teaching, testing, or program management staff composed of government employees and contractors. The settings within which the work is conducted include large- and small-group classrooms, many of which are equipped with video recording and playback capabilities; audio laboratories, including multimedia workstations equipped with audio tape recorders, videotape recorders, videodisc players, CD-ROM drives; an Internet lab; testing rooms; standard offices, and a Library. A typical class may have one to six students, although groups may range up to twenty.

C. 2. Purpose This will be a Blanket Purchase Agreement (BPA) effective for the entire period specified. This solicitation will result in some full-time and some intermittent or part-time multiple award agreements. This BPA is not for United States Government Civil Service jobs. Performance of these services will only occur as authorized by specific orders detailing dates, tasks, and schedules. There will be no limit to the number of orders issued under the BPA. The Government may issue orders requiring services at multiple locations. There is no specific commitment by either party until dates, tasks, and schedules are mutually negotiated by individual order. We intend to issue BPAs to many individual contractors to teach, test in their native languages, conduct testing examinations in any number of languages, or develop language-learning materials in a variety of formats.

Contractor will develop, test, and/or support in any other fashion the linguistic competency of personnel of the United States Government agencies and the eligible family members of those employees as measured by the Interagency Language Roundtable language proficiency skill level descriptions in speaking and reading. The skill level descriptions define five levels of proficiency, from 0 to 5 (5 being functionally equivalent to an educated native speaker). The levels are the benchmarks by which the government measures success, with 3 being the general level of professional proficiency. No part of the services to be performed under this agreement may be subcontracted, and no obligation or duty arising out of the individual order may be transferred, or assigned, without the prior authorization of the Contracting Officer.

C. 3 Qualifications All contractors must be eligible to work in the United States. The Department of State does not sponsor individuals for work permits. All bidders must submit a photocopy of documentation as to their citizenship.

Please see the list of acceptable documents to demonstrate employment eligibility (see Section J). It is desirable, but not required, for instructors to have some experience in teaching adults. Instructors will be considered based on the following:

In order to teach or serve as testers, contractors must have the following qualifications:

* Language Proficiency: Individuals/contractors must be educated native speakers of the language.

Participation is strictly voluntary. Contractors will be compensated for the hours at their normal hourly rate and will additionally receive compensation for Meals and Incidental Expenses (M and IE) as follows:

Multimedia and Library Services at the Foreign Service Institute provide multimedia equipment and technology-based materials. All equipment is inventoried and materials are catalogued. Contractors must make every effort to ensure the security of all equipment, peripherals, and materials.

C. 10. Quality Assurance The Government Technical Representative (GTM) determines acceptability of services. The Government has the right to inspect and approve all services called for in orders issued under the BPA. If the Contractor fails to perform the required services at an acceptable level as determined by the Supervisor/Government Technical Monitor (GTM), either from a performance or professionalism standpoint, the Government reserves the right to terminate the order.

C. 11. Technical Direction Guidance and specific direction in carrying out the requirements stated above within the context of the Foreign Service Institute will be provided by the Government Technical Monitor (GTM) (to be identified when the orders are placed) on an ongoing basis.

Contractor is expected to carry out instructions received from GTM in a professional and timely manner. The Government will not provide counseling to contractor on their performance; it is assumed that once contractor receives instructions about how to perform duties that the contractor will implement the instructions. Should contractor performance not be adequate, the Government may terminate the agreement without discussion.

Neither the Contracting Officer's Representative nor the Government Technical Monitor has the authority to make changes in this Statement of Work or in the terms and conditions of this agreement. The Contractor is forewarned that the Government may not compensate any such changes not authorized by the contract. Any such changes that necessitate additional work by the Contractor will be at the expense of the Contractor and at no additional cost to the Government.

C. 12. Place of Delivery Services under this contract will be performed primarily, but not exclusively, at the Government's facility located at The George P. Shultz National Foreign Affairs Training Center at 4000 Arlington Boulevard, Arlington, Virginia.

C. 13. Payment/Invoicing

1. Commercial companies/schools submit invoices to the Budget Office, Foreign Service Institute, Department of State, Washington, D.C. 20520-4201.

2. Contractors will submit invoices bi-weekly for hours worked through presentation of a Work Schedule and an invoice to the FSI Budget Office. The contractor must date stamp the invoice at the Budget Office before submitting it.

3. Testing contractors will submit invoices to the Language Testing Office immediately following the test(s) for which they were contracted or, if testing on an ongoing basis, as in 2 above.

Individual Contractors will be provided with a customized invoice format that must be used, including:

* Name and address

* Obligation number

* Invoice number

* BPA contract number

* A blank field in which to enter number of hours worked

* Hourly rate

The invoice will be certified correct by the Government Technical Monitor (GTM). Payment to the Contractor for hours worked shall be made on the 30th calendar day after either (1) presentation of an invoice to the Government Technical Monitor, or (2) the date the services are accepted by the Government.

C. 14. DOSAR 652.242-70 - Contracting Officer's Representative (COR) (Dec 1994) The Contracting Officer may designate in writing one or more Government employees, by name and position title, to take action for the Contracting Officer under this contract. Each designee shall be identified as Contracting Officer's Representative (COR). Such designation(s) shall specify the scope and limitations of the authority so delegated, provided that the designee shall not change the terms and conditions of the BPA and/or orders under the BPA unless the COR is a Warranted Contracting Officer and this authority is delegated in the designation.

C. 15. Bidding Best Value: Bids will be considered based on the best value principle. The Government will take into consideration the contractor's experience, education, etc., in determining whether the bid price is fair and reasonable. Contractors should be aware that once their bid has been accepted, it will not be changed.

C. 16. Self-Employed Contractors Bidders under this Blanket Purchase Agreement understand that they are self-employed Contractors and not Government employees. As such, contractor is responsible for managing their taxes, health insurance, social security payments, etc. The Government will pay the contractor based on the hourly rate bid; the contractor is responsible for paying their personal expenses. The Government will pay no benefits under this agreement. Contractors will be issued a task order that will detail the period of performance their services are required. The award of a BPA does not necessarily mean that the Government will require the use of your services.

C. 17. Termination of Task Orders Failure to follow directions/guidance from the Government Technical Monitor (GTM) or the Contracting Officer's Representative (COR) can result in the termination of the task order. GTMs are responsible for monitoring contractor performance. Should they observe that a contractor is failing to follow guidance, is unable to complete designated tasks, cannot work collegially with colleagues or is demonstrating any other unprofessional behavior, the GTM will advise the contractor and also notify the COR. Any of the above can result in the termination of a task order. Contractor can be terminated from task order without discussion and without the Government giving a reason for termination of order.
