About this file
This is a sample contract between the State of Oregon, acting through its Department of Forestry (ODF), and a contractor to provide fuels reduction services via Pre-Commercial Thinning (PCT) mastication on approximately 26 acres of private land located west of Sisters, Oregon, adjacent to the Deschutes National Forest. The contractor must furnish all labor, supervision, transportation, equipment, and materials necessary to complete the work, including at least one drum-mounted masticator. The services involve clearing all brush and standing trees 8 inches diameter breast height (DBH) and under down to seedlings 1 foot tall, with material masticated to within 8 inches or less of the ground surface. Residual trees over 8 inches DBH must be protected, and up to 20 percent of the treatment area may be skipped to prevent damage to leave trees. Work is anticipated to begin on or after October 1, 2026, with all services required to be completed by May 31, 2027. The contract becomes effective upon execution by all parties and receipt of required state approvals, with no extension options permitted. A pre-work meeting with ODF is required prior to commencement of operations, and work may not be scheduled on weekends or ODF holidays without written approval.
Compensation for the services is provided on a per-acre basis at a rate to be specified by the bidder in Exhibit B, with payment made only for acres satisfactorily completed and certified by ODF. The contractor must be registered in the OregonBuys system to receive payment and may submit invoices no more than monthly for work completed and accepted by Agency, with invoices directed to Ben Walen at the Oregon Department of Forestry, Prineville office. The contractor is responsible for all operational expenses including equipment costs, transportation, and crew wages, and will not be reimbursed for move-in, move-out, demobilization costs, or travel time and expenses to the job site. A designated foreman, identified as a Key Person, must remain on the contract for its duration unless otherwise approved in writing by ODF. The contractor must possess a valid Forest Labor Contractor License issued by the Oregon Bureau of Labor and Industries throughout the contract term and maintain comprehensive insurance coverage including Workers' Compensation, Commercial General Liability with minimum limits of $1,000,000 per occurrence and $2,000,000 annual aggregate, and Automobile Liability Insurance with combined single limits of not less than $1,000,000. The contract specifies that ODF will provide periodic inspection and certification of completed work and that Agency may require rework of any areas that exceed acceptable leave percentages or do not meet specification requirements.
