JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

1. The Office of Acquisition Management is conducting this acquisition to extend the U.S. Department of State Bureau for International Narcotics and Law Enforcement Affairs Office of Aviation (INL/A) Worldwide Aviation Support Services Contract for a period of six months with a 6 month option. The estimated cost for 12 months is $276,000,000.

2. Nature and/or description of the action being approved. INL/A has solicited offerors for its worldwide aviation support services requirements under solicitation number SAQMMA14R0319. However, due to agency reviews, GAO and small business protests the awards have been delayed. The completion date of the existing Aviation Support Services Contract SAQMPD05C1103 is October 31, 2017. Consequently, an extension to the existing contract will be necessary for the continuation of the SAQMPD05C1103 to ensure there is no break in services pending the award of SAQMMA14R0319.

3. A description of the supplies or services required to meet the Department’s needs.

INL/A provides aviation support for the eradication and interdiction of illicit drugs, training of contractor and host nation personnel, movement of personnel and equipment, reconnaissance, personnel recovery (PR), medical evacuation, security of personnel and equipment, and ferrying of aircraft.

Operational missions may include but are not limited to: aerial eradication, manual eradication support, interdiction support, air assault, border security, external load, forward resupply, aerial transportation of personnel and cargo, Search and Rescue (SAR), SAR/MEDEVAC, disabled aircraft recovery, armed helicopter escort, maintenance test flights, aerial reconnaissance, surveillance and verification. Applicable missions are performed by contractor personnel at CONUS and OCONUS.

4. An identification of the statutory authority permitting other than full and open competition. 41 USC 3304 (a) (1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited. As the incumbent contractor, DynCorp International, LLC presently has the requisite resources and personnel located in the areas of operation, and is therefore, the only source capable of providing these short-term critical services until a new contract can be awarded.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. An FBO.GOV announcement of the Government's intent to award an extension of the existing contract will be published on July 1, 2017 and interested parties will be invited to submit their qualifications to meet the requirement. However, the full and open Solicitation SAQMMA14R0319 was published on July 18, 2014 inviting qualified offerors to propose for the follow-on INL/A Aviation Support Services Contract. Proposals in response to SAQMMA14R0319 were due October 2, 2014.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer shall utilized DCAA approved indirect rates, perform cost and price analysis, utilize over ten years of program actuals, and request current cost and pricing data from the contractor. Additionally, the Contracting Officer may request additional audits of proposed costs if necessary to ensure that the final negotiated price is fair and reasonable.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. INL/A began the market survey process associated with the full and open requirements starting in November 2012. INL/A hosted three industry days and held over 100 one on one meetings with industry and has identified a large pool of contractors who are capable of performing the worldwide aviation mission.

9. Any other facts supporting the use of other than full and open competition. This extension of 6 months with a 6 month optional extension allows INL/A to continue to perform its worldwide aviation mission without a disruption in services.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

An FBO.GOV announcement of the Government's intent to award a sole source extension contract was published and interested parties have been invited to submit their qualifications to meet the requirement. However, the full and open Solicitation SAQMMA14R0319 was published on July 18, 2014 inviting qualified offerors to propose for the follow-on INL/A Aviation Support Services Contract. Proposals in response to SAQMMA14R0319 were due October 2, 2014 and the awards are currently under review.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Government is conducting a full and open competition under Solicitation SAQMMA14R0319 for these services.
