JUSTIFICATION AND APPROV AL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
1. The Office of Acquisition Management is conducting this acquisition for Administrative Management and General Management Consulting Services on behalf of the Office of Anti- Terrorism Training Assistance (ATA). The estimated cost is $22,000,000.00, which includes a six month base and three two month extensions.
2. Nature and/or description of the action being approved.
The current contract was awarded on 28 March 2014 with a base period and two option years.
The total contract value is approximately $68,500,000.00, which includes the base period and two option years, including extensions, and extending individual task orders under the base contract (SAQMMA14D0037) to 30 August 2016 (via final task orders modifications).
Due to the unexpected and substantial increased program requirements within DS and the Office of Logistics Management, the Department is unable to complete the solicitation and competition which has been started under solicitations yet to be publicized.
The U.S. Department of State proposes a six month base plus three two month option period to be awarded to Alutiiq Professional Training, LLC, an 8(a) program participant, an Afognak, tribally owned firm capable of immediately continuing services so that approximately 85 contract personnel are not disrupted which are providing vital mission critical services to DS/T/ATA overseas and domestic positions.
The purpose of this J&A is to allow time for the RFP to be formalized and to give industry enough time to respond and to be evaluated competitively. The work to be performed during this period is solely to complete the residual work ready placed on contract that will be required prior to the award of a new contract. The contracting officer is not accepting new orders against this current contract.
3. A description of the supplies or services required to meet the Department's needs.
The Alutiiq contract provides services in support of the Bureau of Diplomatic Security. Alutiiq Professional Training, LLC capability to seamlessly transition hundreds of personnel both domestic and overseas particularly quickly to the new specifications for this temporary time will reduce employee moral issues, incumbent retention issues along many other contractor employee life concerns through a single contract vehicle to optimize efficiencies for: continuity of services, planning, programming, training, sustainment and implementation cycles, and management/administration of U.S. mission critical needs.
4. An identification of the statutory authority permitting other than full and open competition.
This request is made pursuant to the authority of 10 U.S. 2304( c)(5), FAR 6.302-5 -- Authorized or Required by Statute.
5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
The requirement is a large services requirement covering a variety of complex DS program office missions. No other contractor would be in position to provide the required services at an acceptable cost and level, and within the required time frame. It is anticipated that once a new contract is awarded there will be a period of transition from the incumbent to the new contractor, in order to maintain the desired level of services during the transition period (the incumbent will not be the successful offeror for the new contract, due to the fact that they have graduated from the 8(a) program). Failure to retain the current contractor personnel throughout the solicitation process in awarding the new contract would result in potential harm to government operations due to the following issues:
• Contractor support personnel with DS experience and the appropriate security clearance requirements and infrastructure are critical to program stability.
• The learning curve that is required would cause a negative impact on the mission.
• DS's ability to meet our increasing mission critical requirements would be at undue risk and will jeopardize our ability to maintain operational capabilities.
• The work to be performed during the period is solely to complete the residual work already placed on contract that will be required prior to the award of a new contract and some current positions will gradually be transitioned to Personal Services Contracts.
6. A description of efforts made to ensure that offers re-solicited from as many potential sources as is practicable.
The Bureau of Diplomatic Security has commenced advanced acquisition planning for the follow on competitive contract. The follow on competitive contract will be an 8(a) Set-aside competition and will be publicized on FedBizOp, subject to the approval of the Department of State's Office of Small and Disadvantaged Business Utilization (OSDBU).
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will utilize the current contract rates and any other necessary cost and pricing data (current invoices, GS Pay scale, Sal.com) to ensure the cost to be fair and reasonable.
8. A description of the market survey. conducted and the results or a statement of the reasons a market survey was not conducted.
Market Research has been conducted on the follow-on requirement. The purpose of this action is to provide continued contractual coverage for the support services of the Office of Diplomatic Security and Training Services.
9. Any other facts supporting the use of other than full and open competition.
Advanced acquisition planning has been completed. The acquisition is being coordinated with the DS, AQM, and OSDBU office.
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.
N/A.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The Department has begun synopsizing DS competitive requirements. This award to a small business 8(a) firms for base six month plus three two month option period is to allow additional time to appropriately complete those competitions.
