About this file
This is a Statewide Contract Waiver Request document issued by the Pennsylvania Department of General Services, Bureau of Procurement, establishing compliance procedures for Pennsylvania Act 57 of 2023 regarding Russia and Belarus certification. The document applies to all competitive sealed bidding (IFB) procurements for supplies and services exceeding $50,000 conducted by Commonwealth agencies. The waiver request establishes a mandatory verification process that contracting officers must complete prior to contract award, requiring attestation that selected suppliers do not appear on the Russia-Belarus restricted persons list maintained and published by the Pennsylvania Treasury Department. The process involves three steps: accessing the Treasury's Divestment Page to review both the Act 57 Russia and Act 57 Belarus lists, searching for the supplier using the name as submitted in their proposal or bid, and completing a formal attestation document confirming the supplier's eligibility.
Any supplier appearing on the Treasury-published restricted persons list is automatically deemed not responsible and is ineligible to receive a contract award from Commonwealth agencies. The attestation must be completed by the contracting officer, signed, dated, and attached to the contract file. This certification requirement applies uniformly across all state procurements exceeding $50,000 and does not contain specific pricing terms, set-asides, or funding provisions, as it functions as a compliance and responsibility determination mechanism rather than a procurement specification document. The form BOP-2401 was published on May 2, 2024.

Russia Belarus Certification
Background
Pennsylvania Act 57 of 2023 states that persons associated with Russia or Belarus may not bid on, submit a proposal for, enter into, be a party to or renew a contract with a Commonwealth agency for the provision of goods or services. Per Act 57, the Pennsylvania Treasury Department will publish a list of such persons.
To be compliant with this Act, the contracting officer will review the list published by Treasury as part of the determination of contractor responsibility prior to contract award. This process is outlined below. This completed document should be attached to the contract.
Instructions
1. Access the Pennsylvania Treasury’s Divestment Page and review both the Act 57 – Russia and Act 57 – Belarus posted lists.
2. Search for the supplier on the lists. Use the name as listed on the supplier’s proposal/bid submission.
3. Complete the attestation below and attach to the contract. Suppliers appearing on the Treasury-published list are deemed not responsible and may not be issued a contract.
Attestation
On Date, I, Name or Attesting Individual, verified that Name of Supplier is not on the list of individuals doing business with Russia and Belarus, as accessed via the link above.
