MUTUALLY AGREED UPON CLARIFICATIONS / MODIFICATIONS TO THE RFP

Attachment 1_Sample Justification Attachment 2_Client Business Review Reporting Attachment 3_Implementation Timeline and Project Plan GDC030 - Clarifications & Negotiations

EFFECTIVE 05/01/24:

LEGACY RESOURCES – The Contractor will transition previous Resources into their program at the rates defined by DAS.

DOCUMENTING OVER TIER 3 RESOURCES - The Contractor must maintain a complete master list of all Resources over tier 3 for their respective position. This list must be provided to DAS upon request as well as provided to DAS when a new over tier 3 request is approved by DAS. At a minimum, the list must include the Agency in which the Resource provides services, the current Bill Rate for the Resource, the current tier 3 rate for the position in which they hold, and the Resource’s identifying information. Additional information/modifications must be provided to DAS upon request.

NEW REQUESTS OVER TIER 3. - Any request (for example: a job posting, a pay increase, or the onboarding of Resource(s)) the Contractor receives that affects a price that does or will exceed tier 3 for the respective position, the Contractor must reach out to DAS for written approval to exceed tier 3. DAS reserves the right to accept or deny the rate for any reason. The Contractor must provide any documentation and/or information requested by DAS to accompany the request.

RATE-LESS POSTINGS. The Contractor, with the approval of DAS and the ordering Agency, may post any position(s) currently on the rate card without a tier/rate associated with the posting. The posting must still follow the other terms and conditions of the contract. The State reserves the right to reject any candidate if the State, at its sole discretion, determines that the price is excessive in nature. Once a Resource is found and onboarded into the program, the Resource will be added to a running list of all Resources over tier 3 for their position and provided to DAS.

OVER TIER 3 NOTIFICATIONS. Annually, the Contractor must reach out to Agencies with Resources currently in the program over the tier 3 rate for their respective positions and inform them that they have Resources currently over the tier 3 rate to give the Agency an opportunity to determine if the position should be backfilled.

“TRAVEL” RATES. In addition to the tiered rates on the rate card, the Contractor may solicit “travel” positions with rates specifically designed to fill these types of positions. The rates associated with travel positions are subject to the terms and conditions of the contract, including items relating to increases and approvals. The “travel” rates may not be used for posit ions that are not in a “travel” compacity. The Contractor must take reasonable steps to ensure that the travel rates are used appropriately.
