I. PURPOSE
The purpose of this Request is to solicit proposals from qualified organizations to provide Food Trucks/Mobile Food Vending Services; here after referred to as “Food Trucks”, as described in Section III. Statement of Needs, for the Fort Monroe Authority at Fort Monroe for planned events including but not limited to African Landing Commemoration on August 22 and August 29, 2026; Ghost Walk October 16-18, 2026, and Veterans’ Day on November 7, 2026. Event times and durations will vary.
II. BACKGROUND
A. THE FORT MONROE LANDSCAPE
Resng on 561-acres, this public landscape is a two-and-a-half-mile long peninsula located on the Chesapeake Bay. The Fort Monroe Naonal Historic Landmark (NHL) encompasses 400 acres within the public landscape and consists of 171 Contribung buildings, sites, structures and objects, as well as 77 non-contribung buildings, sites, structures and objects. The 93-acre southern secon includes a 63-acre moated masonry and earthen fortress (1819-1834), the African Landing Memorial, and a 332 wet-slip marina. The northern secon is characterized by remnant bateries, sandy beaches, and coastal forests. The peninsula is separated from the mainland by Mill Creek, a 53-acre salt marsh that is ulized for recreaonal crabbing, sailing, and crical dal habitat.
Fort Monroe has been the site of human habitaon for at least 11,000 years and was the place where one of the first contacts between colonists from the London Company and the Kikotan Naon occurred in 1607. The English colonists constructed a fort (1609) at this site as protecon for the Jamestown setlement. This fort witnessed the arrival of the first documented enslaved Africans to England’s North American colonies in 1619. The Fort was reconstructed twice in 1632 and 1730. The construcon of the Old Point Comfort Lighthouse began in 1802 and was completed someme in early 1803. Aer the War of 1812, the United States engaged military engineer General Simon Bernard to design and construct a Third System stone forficaon on the lands of Old Point Comfort that would become known as Fort Monroe. Fort Monroe is the largest stone forficaon in the United States.
Controlled by Union troops throughout the Civil War, in May 1861 the fort provided refuge to three self-emancipated African Americans. Rather than returning them, as required by the Fugive Slave Act, Major General Benjamin Butler declared them “contraband of war” and permited them to remain on the site, soon atracng others. This established the naon’s first contraband camp, enclaves where African Americans sought refuge before and in the aermath of the Emancipaon Proclamaon.
In 1960 most of the peninsula was designated a Naonal Historic Landmark District, and in 1966 it was listed in the Naonal Register of Historic Places. In 2025, the African Landing Memorial will open, recognizing Fort Monroe’s seminal place in the story of America’s mul-cultural history.
In 2011, the base closed as an acve post through a BRAC process. The Commonwealth of Virginia assumed ownership and control of the site in 2011. Also in 2011, President Barack Obama designated 325 acres a naonal monument, included in the Naonal Park Service Underground Railroad Network to Freedom in 2012.
Since the Army’s final flag ceremony in 2011, Fort Monroe has been on a journey to become a place of renewal, where historic buildings are preserved, natural habitats restored, and community life thrives.
Recreaonally, the site is home to mulple public beaches, over three miles of trails, a public campground, and four restaurants. A sailing center, community center, and public park spaces are available across the landscape.
The fort is also home to the Casemate Museum (1951) that interprets its history, features a rectangular central lawn parade ground surrounded by a perimeter drive that traces the edges of the irregularly shaped forficaon, offering panoramic views of the bay. Along this outer ring are two and three-story living quarters, predominantly in the colonial Revival style having street-facing porches on their principal façade. Mature southern live oaks, including an approximately five hundred years old specimen called the “Algernourne Oak,” frame the parade ground and dot the landscape.
Ecologically, Fort Monroe delivers limited services supporng migratory birds on the East Coast flyway and offers significant shoreline opportunies for intervenons to heal Mill Creek, an important spawning ground for blue crabs, speckled trout, croaker, spot, red drum, and striped bass. There is an opportunity to improve and enhance ecological service funcon on the site.
Over three hundred individuals live on the site of Old Point Comfort within historic residences, mul-family units, and an historic hotel called the Chamberlin, which was adapvely redeveloped into an independent senior living community. Over twenty businesses exist on the site ulizing former military buildings and structures, including new and historic facilies. 1,000,000 sf Contribung historic structures are vacant.
B. THE FORT MONROE AUTHORITY
The Fort Monroe Authority (FMA) was created by legislave acon of the Virginia General Assembly in 2007 and is led by an appointed Board of Trustees charged with implemenng reuse, preservaon, and the future evoluon of this priceless historic treasure.
FMA is charged with the following responsibilies:
• Protect the historic resources at Fort Monroe,
• Provide public access to the Fort's historic resources and recreational opportunities.
• Exercise exemplary stewardship of the Fort's natural resources,
• And maintain Fort Monroe in perpetuity as a place that is a desirable one in which to reside, do business, and visit, all in a way that is economically sustainable.
C. FORT MONROE NATIONAL MONUMENT
On November 1, 2011, President Barack Obama, using the authority of the 1906 Anquies Act, proclaimed that 325.21 acres of federal property at Fort Monroe be appropriated as the Fort Monroe Naonal Monument (FOMR) as the 396th unit of the Naonal Park Service (NPS). This declaraon elevated the Fort Monroe property to a stature never imagined and created an opportunity for the world to learn about the complete history of this property.
On March 20, 2015, Governor Terrence McAuliffe commited to work with the NPS to expand the boundaries of the FOMR by an addional 39.5± acres. The boundary expansion remains a priority for the FMA.
Using the great assets of this property, the NPS has developed public programs, interpreve tours, and is preserving hundreds of acres of natural area in the heart of this urban environment. Historic buildings are being restored, direconal signage is being installed, and new visitors, especially school children, are being brought into this space to enjoy nature and learn the history of this site.
The purpose of FOMR is to preserve, protect, and provide for the appropriate public use of the historical, natural, and recreaonal resources of the site. Fort Monroe is jointly managed as a unique partnership between the NPS and the FMA.

IV. PROPOSAL PREPARATION AND SUBMISSION INSTRUCTIONS:
A. GENERAL INSTRUCTIONS
1. RFP RESPONSE
To be considered for selecon, Offerors must submit a completed response to the RFP.
Failure to provide the requested informaon may be grounds for rejecon of the proposal.
One (1) electronic proposal shall be submited through eVA as a SINGLE PDF FILE. No other distribuon of the proposal shall be made by the Offeror.
2. PROPOSAL PREPARATION
a. Proposals shall be signed by an authorized representative of the offeror. All information requested should be submitted. Failure to submit all information requested may result in the purchasing agency requiring prompt submission of missing information and/or giving a lowered evaluation of the proposal. Proposals which are substantially incomplete or lack key information may be rejected by the purchasing agency. Mandatory requirements are those required by law or regulation or are such that they cannot be waived and are not subject to negotiation.
b. Proposals shall be prepared simply and economically, providing a straightforward, concise description of capabilities to satisfy the requirements of the RFP. Emphasis should be placed on completeness and clarity of content.
c. DELETED
d. As used in this RFP, the terms "must", "shall", "should" and “may” identify the criticality of requirements. "Must" and "shall" identify requirements whose absence will have a major negative impact on the suitability of the proposed solution. Items labeled as "should" or “may” are highly desirable, although their absence will not have a large impact and would be useful but are not necessary. Depending on the overall response to the RFP, some individual "must" and "shall" items may not be fully satisfied, but it is the intent to satisfy most, if not all, "must" and "shall" requirements. The inability of an Offeror to satisfy a "must" or "shall" requirement does not automatically remove that Offeror from consideration; however, it may seriously affect the overall rating of the Offerors’ proposal.
e. All documentation submitted with the proposal should be contained in that single pdf file.
f. Ownership of all data, materials, and documentation originated and prepared for the FMA pursuant to the RFP shall belong exclusively to the FMA and be subject to public inspection in accordance with the Virginia Freedom of Information Act. Trade secrets or proprietary information submitted by an offeror shall not be subject to public disclosure under the Virginia Freedom of Information Act; however, the offeror must invoke the protections of § 2.2-4342F of the Code of Virginia, in writing, either before or at the time the data or other material is submitted. The written notice must specifically identify the data or materials to be protected and state the reasons why protection is necessary. The proprietary or trade secret material submitted must be identified by some distinct method such as highlighting or underlining and must indicate only the specific words, figures, or paragraphs that constitute trade secret or proprietary information. The classification of an entire proposal document or prequalification application, line-item prices, and/or total proposal prices as proprietary or trade secrets is not acceptable and will result in rejection of the proposal. If, after being given reasonable time, the offeror refuses to withdraw an entire classification designation, the proposal will be rejected.
3. ORAL PRESENTATION
Offerors who submit a proposal in response to this RFP may be required to give an oral presentaon of their proposal to the FMA. This provides an opportunity for the offeror to clarify or elaborate on the proposal. This is a fact finding and explanaon session only and does not include negoaon. The issuing agency will schedule the me and locaon of these presentaons. Oral presentaons are an opon of the purchasing agency and may or may not be conducted.
B. SPECIFIC PROPOSAL INSTRUCTIONS

c. All goods or services provided under this contract or purchase order, that are to be paid for with public funds, shall be billed by the contractor at the contract price, regardless of which public agency is being billed.
d. The following shall be deemed to be the date of payment: the date of postmark in all cases where payment is made by mail, or when offset proceedings have been instituted as authorized under the Virginia Debt Collection Act.
e. Unreasonable Charges. Under certain emergency procurements and for most time and material purchases, final job costs cannot be accurately determined at the time orders are placed. In such cases, contractors should be put on notice that final payment in full is contingent on a determination of reasonableness with respect to all invoiced charges. Charges which appear to be unreasonable will be resolved in accordance with Code of Virginia, § 2.2-4363 and -4364. Upon determining that invoiced charges are not reasonable, the FMA shall notify the contractor of defects or improprieties in invoices within fifteen (15) days as required in Code of Virginia, § 2.2-4351.,. The provisions of this section do not relieve an agency of its prompt payment obligations with respect to those charges which are not in dispute (Code of Virginia, § 2.2-4363).
2. To Subcontractors:
a. Within seven (7) days of the contractor’s receipt of payment from the FMA, a contractor awarded a contract under this solicitaon is hereby obligated:
(1) To pay the subcontractor(s) for the proporonate share of the payment received for work performed by the subcontractor(s) under the contract; or
(2) To nofy the agency and the subcontractor(s), in wring, of the contractor’s intenon to withhold payment and the reason.
b. The contractor is obligated to pay the subcontractor(s) interest at the rate of one percent per month (unless otherwise provided under the terms of the contract) on all amounts owed by the contractor that remain unpaid seven (7) days following receipt of payment from the FMA, except for amounts withheld as stated in (2) above. The date of mailing of any payment by U. S. Mail is deemed to be payment to the addressee. These provisions apply to each sub-er contractor performing under the primary contract. A contractor’s obligaon to pay an interest charge to a subcontractor may not be construed to be an obligaon of the FMA.
3. Each prime contractor who wins an award in which provision of a SWaM procurement plan is a condion to the award, shall deliver to the contracng agency or instuon, on or before request for final payment, evidence and cerficaon of compliance (subject only to insubstanal shoralls and to shoralls arising from subcontractor default) with the SWaM procurement plan. Final payment under the contract in queson may be withheld unl such cerficaon is delivered and, if necessary, confirmed by the agency or instuon, or other appropriate penales may be assessed in lieu of withholding such payment.
4. The Commonwealth of Virginia encourages contractors and subcontractors to accept electronic and credit card payments.

The FMA reserves the right to inspect the offeror’s physical facilities prior to award to satisfy questions regarding the offeror’s capabilities. The FMA further reserves the right to reject any proposal if the evidence submitted by, or investigations of, such offeror fails to satisfy the FMA that such offeror is properly qualified to carry out the obligations of the contract and to provide the services and/or furnish the goods contemplated therein.
M. TESTING AND INSPECTION: The FMA reserves the right to conduct any test/inspection it may deem advisable to assure goods and services conform to the specifications.
N. ASSIGNMENT OF CONTRACT: A contract shall not be assignable by the contractor in whole or in part without the written consent of the FMA.
O. CHANGES TO THE CONTRACT: Changes can be made to the contract in any of the following ways:
1. The parties may agree in writing to modify the terms, conditions, or scope of the contract. Any additional goods or services to be provided shall be of a sort that is ancillary to the contract goods or services, or within the same broad product or service categories as were included in the contract award. Any increase or decrease in the price of the contract resulting from such modification shall be agreed to by the parties as a part of their written agreement to modify the scope of the contract.
2. The Purchasing Agency may order changes within the general scope of the contract at any time by written notice to the contractor. Changes within the scope of the contract include, but are not limited to, things such as services to be performed, the method of packing or shipment, and the place of delivery or installation. The contractor shall comply with the notice upon receipt, unless the contractor intends to claim an adjustment to compensation, schedule, or other contractual impact that would be caused by complying with such notice, in which case the contractor shall, in writing, promptly notify the Purchasing Agency of the adjustment to be sought, and before proceeding to comply with the notice, shall await the Purchasing Agency's written decision affirming, modifying, or revoking the prior written notice. If the Purchasing Agency decides to issue a notice that requires an adjustment to compensation, the contractor shall be compensated for any additional costs incurred as the result of such order and shall give the Purchasing Agency a credit for any savings. Said compensation shall be determined by one of the following methods:
a. By mutual agreement between the parties in writing; or
b. By agreeing upon a unit price or using a unit price set forth in the contract, if the work to be done can be expressed in units, and the contractor accounts for the number of units of work performed, subject to the Purchasing Agency’s right to audit the contractor’s records and/or to determine the correct number of units independently; or
c. By ordering the contractor to proceed with the work and keep a record of all costs incurred and savings realized. A markup for overhead and profit may be allowed if provided by the contract. The same markup shall be used for determining a decrease in price as the result of savings realized. The contractor shall present the Purchasing Agency with all vouchers and records of expenses incurred and savings realized. The Purchasing Agency shall have the right to audit the records of the contractor as it deems necessary to determine costs or savings.
Any claim for an adjustment in price under this provision must be asserted by written notice to the Purchasing Agency within thirty (30) days from the date of receipt of the written order from the Purchasing Agency. If the parties fail to agree on an amount of adjustment, the question of an increase or decrease in the contract price or time for performance shall be resolved in accordance with the procedures for resolving disputes provided by the Disputes Clause of this contract or, if there is none, in accordance with the disputes provisions of the Commonwealth of Virginia Vendors Manual. Neither the existence of a claim nor a dispute resolution process, litigation or any other provision of this contract shall excuse the contractor from promptly complying with the changes ordered by the Purchasing Agency or with the performance of the contract generally.
P. DEFAULT: In case of failure to deliver goods or services in accordance with the contract terms and conditions, the FMA may terminate this agreement after verbal or written notice without penalty.
Upon termination the FMA may procure the goods or services contracted for from other sources and hold the contractor responsible for any resulting additional purchase and administrative costs. This remedy shall be in addition to any other remedies which the FMA may have.
