III EVALUATION FACTORS
52.212-2 - Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Price (Most important)
2. Technical capability of the offered item (Less Important)
3. Past Performance (Least Important)
Technical capability and past performance, when combined, are equally as important as the price. However, the Government will not make an award at a price premium it considers disproportionate to the benefits associated with the evaluated superiority of one technical quotation over another. Thus, to the extent that quoter’s technical and past performance quotations are evaluated as close or similar in merit, the evaluated price is more likely to be a determining factor.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
The Government will determine quoter acceptability by assessing the quoter's compliance with the terms of the RFQ.
The Government will determine quoter responsibility by analyzing whether the apparent successful quoter complies with the requirements of FAR 9.1, including:
• adequate financial resources or the ability to obtain them;
• ability to comply with the required performance period, taking into consideration all existing commercial and governmental business commitments;
• satisfactory record of integrity and business ethics;
• necessary organization, experience, and skills or the ability to obtain them;
• necessary equipment and facilities or the ability to obtain them; and
