The Project Approach evaluation, representing the largest weighting at 45 percent, requires detailed submissions on design and construction methodology, risk management, permitting, pilot testing, cost modeling, and operator engagement strategies. Proposers must submit detailed Scopes of Work with work plans, task descriptions, team member assignments, and schedules. Relevant Project Experience, valued at 25 percent, requires submission of five to eight reference projects completed within the past eight years for municipal clients, with preference for collaborative delivery methods such as Progressive Design-Build or Construction Manager at Risk. The project includes Disadvantaged Business Enterprise provisions, Davis-Bacon and Related Acts labor standards compliance, and Small Business Enterprise program requirements. The project has a total budget of $86.7 million with substantial funding from the Bureau of Reclamation. Design-Builders must demonstrate surety availability of at least $120 million, provide three years of financial statements, and document safety records including Experience Modification Rates and days-away-from-work injury incidence rates. The project emphasizes collaborative delivery with the Design-Builder expected to work closely with Tucson Water, HDR Engineering Inc. as Owner's Advisor, and an Operations Manager at Risk.

ATTACHMENT C – DETAILED EVALUATION CRITERIA

1. Project Approach – 45%

A. Provide a conceptual description of the Design-Builder’s understanding of the project followed by the approach for managing and performing its services during both Phase 1 and Phase 2. The Offeror should focus on describing the specific approach and related benefits to the project. Specifically address the following:

a. Provide an understanding of the project

b. Provide the project team’s approach to perform the requested services. A summary of the schedules is required in this Part 4.

c. Describe in detail the project team tools, resources, and quality assurances applicable to proposed work and describe in detail how the project team will collaborate, make decisions, and resolve issues. Describe how design, construction, and the Owner will interface (including for Phase 1: how alternatives, value engineering, and constructability will be addressed and for Phase 2: how construction progress tracking will occur, how will RFIs be managed, and how changes will be managed).

d. Describe how the team proposes to engage, integrate and collaborate with the operator, including when and how operator is engaged, training and optimizing handover at the completion of startup and commissioning. Describe the project team’s approach to ensuring adequate resources for completing the project. In addition to ensuring adequate design and construction resources, the offeror should identify any specific project sequencing or early work packaging or other mitigation measures to minimize impacts on completion time or cost.

e. Describe your risk management approach, including an initial list of at least the top five (5), but not more than ten (10), key risks for implementation, Phase 1 or Phase 2, and any proposed actions to mitigate and/or manage these risks.

f. Describe the project team’s approach to ADEQ AWP permitting.

g. Describe the project team’s approach to pilot testing.

h. Describe how costs will be communicated to the Owner as design advances toward a Phase 2 Proposal. Further describe who will be responsible for putting together and maintaining the Cost Model and estimating throughout the Project? What methods and resources are used to develop and communicate project costs? How will the amounts of contingency be determined and developed?

i. Provide a detailed Scope of Work as Appendix E that fully describes and details the Offerors approach to Phase 1. The Scope of Work submittal should include a detailed work plan, which clearly identifies the tasks, scope of the tasks, team members responsible for each specific task and those involved, and duration required, based on the submitted schedule, for each segment and/or phase of the work. An example scope of work is provided in RFQ Attachment D for the Offerors consideration in preparation of it’s submitted scope for Phase 1 services. For clarity, the Offeror is not required to use the included scope of work but should consider the information as background or input.

i. Also, provide an outline for Phase 2 tasks and the team’s approach to phasing. An example outline for Phase 2 tasks are provided in RFQ Attachment D for the Offerors consideration. The Offeror is not required to use the included outline of Phase 2 services but should consider the information as background or input.

j. The City has not considered the use of formal partnering for the delivery of this project. Provide the Design-Builders approach to partnering and include any suggestions or best practices, whether formal or informal, for the City’s consideration.

2. Relevant Project Experience – 25%

A. Describe the performance history and experience of the Project Team on similar projects, including a description of past working relationships.

B. Provide a summary table to cross-reference the Project Team (Design-Builder, Key Firms, and Key Personnel) with participation in the reference projects. Submitted as Project References with Appendix C and limited to 1 page per reference, the Offeror shall submit at least five (5) but not more than eight (8) reference project descriptions to demonstrate relevant experience with projects of similar scope and scale for municipal clients in the United States, completed in the last 8 years, with a preference for collaboratively delivered projects (greater emphasis will be placed on Advanced Water Purification, Pilot Studies, and projects delivered in the Progressive Design Build or Construction Manager at Risk methods). Each project reference shall contain at least the following information:

a. Project name and location

b. Name of owner

c. Owner reference and contact information

d. Delivery method (DB, PDB, CMAR, etc.)

e. Role of Offeror and/or Key Firm(s)

f. Initial Contract Price Estimates for approximately 30% and 60% design in addition to agreed to Phase 2 Contract Price and final contract value and reason for change

g. Scheduled and actual completion dates

h. Description of the project showing relevance to this Project including engagement with operations, if applicable

i. Names of Key Personnel that will participate in the project and are included in this SOQ, along with a clear description of the roles and responsibilities of each.

C. Describe the history and experience of the Design-Builder on projects involving collaboration and integration with operations including but not limited to operator engagement during design and preconstruction, engagement during construction, training of operations staff, and overlap of operations during startup and commissioning. If applicable, the Offeror may submit two (2) additional Project Reference (i.e. may include up to a total of 10 references) in Appendix C related to engagement with operations staff and/or operations firms.

3. Project Team Structure and Key Personnel – 20%

A. Describe the structure and management of the Project Team. Note that any change in the Key Firms or Key Personnel included in the SOQ requires Owner approval of such changes. The Design-Builder profile must include the following information:

a. Unique Qualifications of the Team. Describe how the Project Team’s qualifications and experience are of unique benefit to the Project in light of the Proposer’s Project approach described in Part 4.

b. Project Team Structure. Describe the scope of the Design-Builder’s and each Key Firm’s services and responsibilities. Include organizational chart(s) showing reporting relationships and responsibilities of the Design-Builder and Key Firms during Phases 1 and 2.

c. Key Personnel. Include organizational chart(s) identifying all Key Personnel (and their firm affiliations) and showing reporting relationships of all Key Personnel (along with their firm affiliations) during Phases 1 and 2. Describe Key Personnel individual qualifications and experience and how it aligns with their proposed role. Additional Key Personnel information required includes:

i. Offerors may identify Key Personnel they deem to be critical to Project success but must include, at a minimum, the Design-Build Project Manager, the Preconstruction Manager, the Construction Manager, the Design Manager, the Lead Process Engineer, and a Permitting Lead.

ii. Provide resumes for all Key Personnel with Appendix C. Resumes must be limited to two pages per individual and include:

1. Academic and professional qualifications

2. Professional registration(s) (as applicable)

3. Tenure with organization and industry

4. Experience as it relates to the Project, the individual’s specified role on the Project, and the approximate percentage of time they will spend on the project per phase including other commitments they have in parallel.

d. Project Manager. Describe how the Project Manager will ensure ongoing integration of Design-Builder personnel with Owner, OA, and OMAR, through both Phases 1 and 2. Describe how the team will interact with each other and the Owner during both Phase 1 and Phase 2, highlighting differences between phases.

e. Construction Manager. Include their unique qualifications, education, industry certifications, experience, and number of years with the firm. Identify similar projects managed, specifically Design-Build projects.

f. Regulatory Experience. Describe Project team’s experience with local, state, and federal regulations as applicable to the scope of work.

4. Design-Builder Profile and Key Firms – 5%

A detailed and complete description of the Design-Builder and Key Firms must be provided in Part 2 of the SOQ.

Design-Builder Profile

Required information applies to the Design-Builder and not to Key Firms (subconsultants/subcontractors). In the case of a joint venture, both parties must provide requested information. The Design-Builder profile must include the following information:

A. General Information. Provide general information about the Design-Builder, such as lines of business and service offerings, locations of home and other offices, number of employees (professional and nonprofessional), years in business, and evidence of required licenses. Provide licenses in Appendix B (Supporting Financial and Company Documentation) of the SOQ.

B. Design-Builder Legal Structure. Identify whether the Design-Builder is organized as a corporation, limited liability company (LLC), general partnership, joint venture, limited partnership, or other form of legal entity. For joint ventures, identify how the individual members of the joint venture are organized and provide relevant joint venture or similar agreements that detail how the joint venture is formed and structured. Describe how the Design-Builder has used this structure, or a similar structure, to deliver similar projects and the associated benefits and challenges with this structure. As applicable, identify the owners of the Design-Builder (e.g., shareholders, members, partners, and the like) who hold an interest of 10% or more in Appendix B (Supporting Financial and Company Documentation).

C. Project Office Location. Identify where the Design-Builder intends to maintain its Project office(s) and the location where the construction management work will be performed.

D. Communications. Describe the points of contact, the communication process, and how the management team(s) will interact with City staff. Identify the main points of contact in the Project Team who will coordinate the design, pre-construction, and construction phases.

E. Collaborative Delivery. Describe how the Design-Builder will achieve a collaborative atmosphere with City while working on this project. This is of particular concern during Phase I design development, scheduling and cost estimating, but is applicable throughout the entire project. Include any information regarding past history of collaboration between the project manager, designer, builder, operations firms, other relevant subconsultants, subcontractors and owners. Describe in detail the firm’s approach to potential conflicts/issues between owner or regulatory requirements, design and constructability.

F. Safety. Provide a summary description of the Design-Builder’s corporate safety program and include safety statistics or records indicating categories of accidents and their incidence or frequency rates for the past three years. The following safety records must be provided for the Design-Builder for the current and past three years:

G. The experience modification rate (EMR) calculated by the National Council on Compensation Insurance or similar rating bureau. (The EMR is also referred to as the experience modification rating, experience modification factor, experience modifier or X-mod.) Where this value is greater than the industry average of 1.0, the Offeror may provide mitigating information to explain the reasons for the EMR rating in Appendix B (Supporting Financial and Company Documentation).

H. The days-away-from-work injury incidence rate. A day-away-from-work injury is an injury that prevents an employee from returning to their next regularly scheduled shift. The incidence rate is calculated by multiplying the number of days-away-from-work injuries for the particular year by 200,000 and then dividing the product by the person-hours worked for that year.

I. Quality Management. Describe the Design-Builders quality management plan.

The SOQ must provide the following additional information pertaining to factors or events that have the potential to adversely impact the Design-Builder’s ability to perform its contractual commitments. If any of the questions below are answered in a manner that indicates that any of these unfavorable factors or events are present, it is the Offeror’s responsibility to (1) describe in detail the unfavorable factor or event, and (2) provide sufficient information to demonstrate that the unfavorable factor or event will not adversely impact the Offeror’s ability to perform its contractual commitments. Include the following information in Appendix B (Supporting Financial and Company Documentation):

A. Financial Condition. Provide financial statements for the Design-Builder for the past three years and quarterly financial statements, certified by the chief financial officer, for the current year. For publicly traded companies, reference to US Securities and Exchange Commission 10-K filings and any recent 10-Q findings are adequate. For entities that are not publicly traded, provide audited financial statements for the same period. If the Design-Builder is a joint venture, LLC, or partnership, such financial statements must be provided for each partner or member.

B. Payment and Performance Bonds. Provide a letter issued by the Design- Builder’s surety company to verify the availability of a bond of at least $120,000,000 million for this Project. The surety must be authorized by law to do business in Arizona and should be listed in the US Department of Treasury’s Circular 570.

C. Insurance. Provide a letter from the Design-Builder’s insurance company or broker stating its ability to meet the requirement of and acquire and provide the minimum limits for the required insurance provided in the Draft PDB Contract.

D. Legal Proceedings and Judgments. List and briefly describe any pending or past (within five years) legal proceedings and judgments, or any contingent liability that could adversely affect the financial position or ability to perform contractual commitments to Owner. If no such proceedings or judgments are listed, provide a sworn statement to that effect from the Design-Builder’s general counsel.

E. Completion of Contracts. Has the Design-Builder failed to complete any contract, or has any contract been terminated due to alleged poor performance or default within the past 10 years? If so, describe the circumstances.

F. Debarred from Bidding. Has the Design-Builder been debarred or is it currently under consideration for debarment, on public contracts by the federal government or by any state? If so, describe the circumstances. Additionally, City will separately verify debarment during evaluations of the SOQ.

Key Firms

A. Identify and provide general information for any Key Firms (such as subcontractors and subconsultants) included on the Project Team. Include EMR safety records for the current and past three years for each Firm anticipated to be responsible for construction activities.

B. Key Firms include the design-builder, engineer, and subcontractors performing >10% of the total work.

5. Subcontractor Selection Plan – 5%

A DBE goal will be assessed for this project at both the design and construction phases.

Offerors shall address the following:

A. Provide details to your subcontractor selection process, including any tools and resources.

B. Describe your firm’s approach and commitment to achieve or exceed the established goal and the utilization of available DBE.

C. List any subcontracting areas you have preliminarily identified for possible DBE utilization for these services.
