5.2 Product Accessibility

Seattle Public Schools is committed to making its technology-related products and services accessible to individuals with disabilities in compliance with applicable law and technical standards. Firms submitting proposals to this RFP must voluntarily disclose information bearing on whether the firm’s proposal complies with Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), as amended, all other regulations promulgated under Title II of the Americans with Disabilities Act, and the accessibility standards of the Web Content Accessibility Guidelines (“WCAG”) 2.0 AA. To facilitate this disclosure, firms will be required to submit a completed Voluntary Product Access Template (“VPAT”) to the District for verification.

Seattle Public Schools (SPS or District) strives to ensure that IT products developed at, purchased by, or used across the District are accessible to all faculty and students, including those with disabilities. To reach this goal, those responsible for making decisions about which products to procure must consider accessibility as one of the criteria for acquisition. Please review the following three (3) steps to meet the accessibility requirements for the

RFP:

Step 1: Provide information about the accessibility of your product

SPS refers to the Web Content Accessibility Guidelines (WCAG) 2.0 developed by the World Wide Web Consortium (W3C) Level AA for guidance in meeting its software accessibility commitments

Is your product in compliance with W3C Web Accessibility Initiative AA?

o If yes, please provide us with the most recent automated accessibility report and skip to Step 2 for further validation o If no, please provide a detailed roadmap for ADA enhancement releases and a timeline you will follow to achieve WCAG 2.0 AA compliance plan o If vendor cannot agree to make nonconforming web content or software conform to WCAG 2.0AA, please detail how vendor will support SPS in providing equally effective alternate access for nonconforming web content, software, equipment, devices, or hardware.

Step 2: Submit a Voluntary Product Accessibility Template (VPAT)

Vendors need to provide detailed information about the accessibility of their software product or services through a VPAT. This is a standard form developed to assist with fulfilling Section 508 requirements. Please note, SPS is aware that VPATs can sometimes have limitations since they are self-reports completed by the vendors that don’t have the technical expertise to assess their products’ accessibility. Therefore, VPATs will be reviewed by the SPS Accessibility Coordinator and perhaps an outside expert with a focus on WCAG 2.1 compliance.

Vendors are required to make a commitment to address their accessibility gaps. Without this commitment, using the product may place SPS in a situation of discriminating against some of its students and/or parents

Step 3: Accessibility assurances from the vendor

If the best product for meeting a District need is one that fails to fully meet accessibility requirements, the vendor is required to make a commitment to achieving accessibility over a specified timeline and/or detailing how it will support SPS in providing equally effective alternate access (see step 1)

Contract extensions will be contingent on progress toward resolving the issues identified in the roadmap to achieve WCAG 2.0 AA compliance.

o If the vendor fails to make progress or provide an action plan, SPS has the right to cancel the contract due to ADA legal requirements o If the vendor provides an action plan, but fails to remediate the ADA compliance issues within the agreed upon timeframe, SPS has the right to cancel the contract

If the product is currently accessible, the vendor assures continued accessibility as the product is updated.

This is especially important for products that are developed on an ongoing rapid release cycle

Please note that the District will select the successful firm based on the best interests of the District, all factors considered. The District reserves the right to reject any or all proposals, waive minor irregularities and informalities, and make the awards in its best interest.

6.0 SELECTION PROCESS

6.1 Method of Selection

6.1.1 The District will review and may award a contract based solely on written proposals based upon the best interests of the District, all factors considered. The District reserves the right to conduct interviews, if deemed necessary with a short list of up to the top three Proposers, determined by the initial evaluation.

6.1.2 The final selection will be based upon the criteria set forth in Section 6.1.3.
