SECTION 4 – SOCIO-ECONOMMIC PROGRAM INFORMATION AND RESOURCES

1. INTRODUCTION

This secƟon describes socioeconomic and environmental programs established by State law and further defined by regulaƟons and policies to increase business opportuniƟes to small and disabled veteran businesses and those businesses operaƟng in economically distressed areas of the State.

SB and/or DVBE firms must be cerƟfied by the State of California, Department of General Services (DGS), Procurement Division (PD), Office of Small Business and DVBE Services (OSDS). CerƟfied ReporƟng Requirements apply to SB/DVBE preference and incenƟve programs as described in General Terms and CondiƟons (GTC 02/2025), 19., Small Business ParƟcipaƟon and DVBE ParƟcipaƟon ReporƟng Requirements.

2. SB PREFERENCE AND NON-SB SUBCONTRACTOR PREFERENCE PROGRAMS

The following informaƟon will apply to both Small Businesses (SBs) and Microbusinesses (MBs)

Bidders will note that for the purposes of this RFP, the OSDS SB cerƟficaƟon of “SB-PW” (public works) cannot be used to fulfill the SB/Non-SB Preference Program(s).

a. SB Preference

A five percent (5%) small business preference will be granted to Bidders cerƟfied as “Small Business” in accordance with § 1896 et. Seq., Title 2, California Code of RegulaƟons (CCR). CerƟficaƟon must be provided by OSDS.

Pursuant to 2 CCR § 1896.14, in order to receive the small business preference, Bidders must have a completed applicaƟon (including proof of annual receipts) on file with OSDS.

If claiming the SB Preference, include your OSDS CerƟficaƟon number and the required informaƟon as directed in the proposal documents.

For award based on low price, the preference is applied by reducing the proposal price by the five percent (5%) preference as computed from the lowest responsive and responsible proposal. The preference is used only for evaluaƟon purposes and does not alter the amounts of the actual proposals. The maximum SB preference allowed may not exceed $50,000 per proposal. In combinaƟon with any other preferences (TACPA, recycled, etc.), the maximum limit of the combined preferences is 15% of the proposal amount and, in no case, more than $100,000.00 per proposal, whichever is less.

A cerƟfied SB may only be displaced by another cerƟfied SB with a higher percentage of DVBE parƟcipaƟon resulƟng in a lower adjusted proposal price.

b. Non-SB Subcontractor Preference

In accordance with Government Code (GC) § 14838(b)(1)(2), the applicaƟon of the five percent (5%) small business bidding preference is extended to a Bidder whose business is not cerƟfied as a small business but commits to subcontracƟng at least twenty-five percent (25%) of its net proposal price to businesses that are California cerƟfied small businesses and/or microbusinesses performing a commercially useful funcƟon.

If requesƟng the Non-SB…
