About this file
This is a Request for Proposal (RFP) issued by the Washington State Department of Labor & Industries (L&I) for an independent third-party study of the Retrospective Rating (Retro) insurance table implementation. The solicitation seeks a qualified actuarial firm to analyze adjustment results for three enrollment periods (October 2023, January 2024, and April 2024) to assess whether the new insurance tables have achieved equitable distribution of retrospective rating refunds among participants. The contractor must examine impacts of blended table usage during the transition period and provide recommendations for mitigating inequity in future table updates. The study scope is limited to first adjustments performed under the 2023 insurance tables and must be completed by June 30, 2027. The Question and Answer period runs from October 1–14, 2026, with final answers posted by October 16, 2026. The bid due date is October 23, 2026, at 5:00 PM Pacific Standard Time. No bidders' conference will be held; questions must be submitted in writing. The contract period begins November 1, 2026, and concludes June 30, 2027, with no extension options.
Bids exceeding $150,000 will be deemed non-responsive. Evaluation will be weighted as follows: Qualifications & Experience (35%), Methodology & Approach (30%), Cost (20%), Executive Order 18-03 Certification (5%), and Washington Veteran-owned/Small Business status (10%), for a total of 630 preliminary scoring points. Minimum qualifications require five years of actuarial experience in workers' compensation and retrospective rating, including familiarity with NCCI programs, L&I systems, or similar rating systems, with proposed staff credentialed as Fellow Casualty Actuarial Society (FCAS). Preferred qualifications include more than five years of experience and knowledge of insurance table roles in ensuring equitable distribution. L&I encourages participation of small and diverse businesses and has established voluntary goals of 6.79% for minority- and women-owned businesses and 2.23% for veteran-owned businesses. A 5% bid preference applies to firms certifying they do not require mandatory arbitration clauses. References will be contacted for top-scoring bidders only. The contract is contingent upon funding availability, and L&I reserves the right to reject all bids or cancel the solicitation without penalty.

GENERAL INFORMATION
3. INTRODUCTION
The Washington State Department of Labor & Industries (hereafter called L&I or the Department) is initiating this solicitation to obtain responses from individuals or firms interested in contracting with L&I to provide an independent study of the Retrospective Rating (Retro) adjustment results for the enrollment periods of October 2023, January 2024, and April 2024 to ensure the adjustment results are consistent with the expectation of improved fairness in the distribution of the retrospective rating refunds among participants as stated under WAC 296-17B-010.
This solicitation is seeking to obtain an independent third-party analysis on the impact of:
1. Blended table usage when calculating adjustment results for the first three enrollment periods under the new tables; specifically, impacts on the first adjustments of the October 2023, January 2024, and April 2024 enrollment periods.
2. Implementing new tables on an enrollment quarter other than July.
The department is also asking the third-party for a recommendation(s) on ways to mitigate any inequity or bias when implementing future insurance table updates.
The scope of the contract is limited to reviewing the first adjustments performed under the 2023 insurance tables and must be completed by the end of the current fiscal year, June 30, 2027.
4. BACKGROUND
Retrospective Rating (Retro) is a safety incentive program offered by L&I. In Retro, employers can potentially earn a partial refund of their workers’ compensation premiums if they reduce workplace injuries and lower associated claim losses. Any employer with an industrial insurance account in good standing may qualify to participate— either as a member of a Retro group or as an individual business. Retrospective rating is simply another way of calculating employer premium, after the fact or “retroactively.”
In order to ensure fairness in the distribution of refunds, the Retro program undergoes a thorough review and update of their insurance tables every five years in accordance with WAC 296-17B-010. The Retro program most recently implemented new insurance tables beginning with the October 2023 enrollment period.
In July of 2025, the department performed the first adjustment under the new tables for enrollment period October 2023 and has subsequently completed first adjustments for January 2024, April 2024, and July 2024. Upon review of the adjustment results, it was brought to the department’s attention that there may be an inequity in the refund calculation and distribution for the enrollment periods that are adjusted using both the old and new insurance tables. In addition, there was also concern about equity and fairness when implementing updated insurance tables beginning with an enrollment period other than July.
5. BIDDER QUALIFICATIONS
Bidders who do not meet the minimum qualifications as described herein will be deemed non-responsive and may not receive further consideration. Please see Bidder’s Questionnaire to review and respond to these qualifications.
