3.0 SCOPE OF WORK

3.1 BACKGROUND

Pre-Admission Screening and Resident Review (PASRR) is part of the Federal Omnibus Budget Reconciliation Act (OBRA) 1987. The regulations regarding the PASRR process are found in the Code of Federal Regulations (CFR) Part 483, Subpart C and E. This federal law was enacted for three purposes:

1) To prevent the placement of individuals with Serious Mental Illness (SMI) and or Intellectual

Disabilities (ID) into Nursing Facilities (NF) unless their medical needs clearly indicate that they require the Level of Care provided by a NF

2) To provide placement options in the community as appropriate

3) To identify any specialized services that individuals need, wherever they are placed

The term PASRR refers to the Pre-Admission Screening and Resident Review of individuals with Serious Mental Illness (SMI) or Intellectual Disabilities (ID). Pre-Admission Screening refers to those applicants seeking admission into a nursing facility. Resident Review refers to individuals residing in a nursing facility and have either exceeded their approval to stay or have experienced a significant change in condition.

There are two levels in the PASRR process:

Level I

1) Screening- Federal regulations require the State PASRR program to identify all NF applicants and residents with a possible SMI or ID diagnosis. This function is completed through the Level I review process. Qualified personnel in hospitals, nursing facilities, and other community-based agencies complete the Level I screening process. Those individuals with an indication of a SMI or ID based on the screening process, will be referred to the State PASRR program for a categorical/exemption determination or Level II evaluation.

2) Categorical/Exemption Determination- Federal regulations allow the State PASRR program to identify exemptions and categorical determinations based on certain diagnoses, severity of illness, need for a particular service, or time limits. The Level II process is not required provided there is enough data to determine that the individual fits into an established category, typically from existing medical records.

Level II

1) Evaluation- For those individuals requiring a Level II evaluation, an assessment is performed to confirm the presence of SMI and or ID. The PASRR Level II assessment for individuals with indications of SMI provides an in-depth review of the individual's medical history, psychiatric history, as well as functional and social history. The assessment may also include the completion of a comprehensive mental health evaluation by a qualified mental health professional, as outlined in SDCL 27A-1-3, if a current one is not available for review.

2) Determination- If the diagnosis of SMI or ID is substantiated, a determination is completed on whether NF placement is deemed appropriate as well as recommendations for specialized services.

3) Specialized Services- Are additional services available to individuals with substantiated SMI or ID that are combined with services provided by NFs that will result in the continuous and aggressive individualized plan of care

Responsibility of State Agencies:

Three state agencies have a major role to play in PASRR. The Medicaid agency, the state mental health authority (SMHA), and the state intellectual disability authority (SIDA). The Medicaid agency is ultimately responsible for overseeing the PASRR program. The SMHA has responsibility for the Level II determinations, but not the Level II evaluations, which must be performed by an entity independent of the SMHA. The SIDA has the responsibility both for Level II evaluations and Level II determinations.

3.2. REQUIRED OBLIGATIONS

The selected Contractor's responsibility in the South Dakota's PASRR process will include the following:

3.2.1 Level I Reviews

1) Utilizing an existing State PASRR email, receive all positive Level I screenings and supporting documentation from hospitals, nursing facilities, and other community-based agencies for individuals seeking admission or continued stay in a Medicaid certified Nursing Facility

2) Complete a Level I Review of the screening and supporting documentation

a) Determine if the Level I screen is appropriately suggesting a SMI or ID

b) Determine if a categorical determination or exemption exists that would negate the need for a Level II evaluation at this time

c) Notify affected parties appropriately in an agreed upon method regarding the determination of the Level I review.

3) Process all Level I Reviews within one business day from the time of receipt of all required documents.

4) Document all Level I Reviews in the State PASRR database https://sdlegislature.gov/Statutes/Codified_Laws/2051013

3.2.2 Level II Mental Health Evaluations

1) Refer all positive Level I Reviews suggesting an ID to the SIDA for completion of a Level II evaluation and determination

2) Refer all positive Level I Reviews suggesting a dual SMI and ID to the SIDA. Complete the Level II evaluation process in coordination with the SIDA

3) Complete a Level II evaluation on all positive Level I Reviews suggesting a SMI

a) Request and review the following documents:

i) Current medical and psychiatric conditions and medications

ii) Medical history and physical exam that has been performed by a qualified clinician

iii) Other documentation or information provided

iv) Psychological Evaluation performed by a Qualified Mental Health Professional

(SDCL 27A-1-3)- or request for one to be completed

b) Conduct a person-centered interview with the applicant and guardian

i) Completed face to face or via telehealth

ii) Obtain releases of information as necessary

iii) Evaluate physical and mental status

iv) Complete a functional and psychosocial assessment

v) Include interviews of persons involved in the current delivery of care for the applicant as necessary

c) Complete a Level II evaluation report

i) Summarize the review of findings, including the substantiation of the SMI

ii) Provide recommendations related to the need of specialized services

iii) The selected Contractor will not be determining Level of Care for the NF

4) Submit final Level II evaluation reports and supporting documentation to the SMHA for final determination

5) Process all Level II Evaluations in 3-5 business days from the time of receipt of the Level I screen.

6) Document all Level II MH Evaluations in the State PASRR database

3.2.3 Attend interagency PASRR related meetings.

3.2.4 Participate in relevant technical assistance trainings provided by the PASRR Technical Assistance Center.
