About this file
This Request for Proposal (RFP) from the California Governor's Office of Emergency Services (Cal OES) seeks a contractor to develop seismic bracing code provisions for mobile homes and manufactured homes (MH) as part of the Building Resilient Infrastructure and Communities (BRIC) program. The project requires a comprehensive review of current California Code of Regulations (CCR) relating to tie-down assemblies, Engineering Tiedown Systems (ETS), Earthquake Resistant Bracing Systems (ERBS), and foundation systems for MH, coupled with a literature review of MH performance before and after June 15, 1976, and performance in past earthquakes including the Ferndale, Anchorage, Ridgecrest, and South Napa earthquakes. The contractor must conduct laboratory and field testing of at least four sets of commonly used bracing assemblies and soil anchors, perform modeling and analysis, and develop reports with recommended CCR amendments suitable for adoption by the Department of Housing and Community Development (HCD). The RFP deadline for proposal submission is March 13, 2026, at 4:00 PM PST, with questions due by February 27, 2026. The proposed award date is March 30, 2026, or upon Department of General Services (DGS) approval, whichever is later. The contract period runs from March 1, 2026, through November 30, 2027, with all deliverables to be completed three months before the period of performance end date.
The contract is funded by federal FEMA assistance under the BRIC program with a budgeted amount not to exceed $337,500, with payment structured on an hourly rate basis for actual hours worked and services completed. The RFP includes mandatory qualifications requiring the contractor to employ licensed civil and geotechnical engineers and minimum qualifications requiring six years of experience in seismic bracing regulations, laboratory/field testing of bracing assemblies and soil anchors, and code development. The contractor must provide a staffed project team including a Project Steering Committee, Project Technical and Review Committee, Working Group, and Code Writing Group, along with project management and coordination responsibilities. Proposers must demonstrate technical qualifications through narrative proposals, detailed cost sheets, three client references for similar work completed within the past three years, and resumes of key personnel. The evaluation will consider technical approach and methodology (30 points), project team composition and qualifications (14 points), project management and coordination (6 points), code development and writing expertise (10 points), and cost evaluation (30 points), with additional incentive points available for Small Business (SB) and Disabled Veteran Business Enterprise (DVBE) participation, with a minimum 3% DVBE participation requirement. All insurance requirements, prevailing wage considerations, and federal compliance provisions including Davis-Bacon Act requirements apply to this contract.

RFP, it will be the basis for rejection of the proposal submission.
c) Deviations in the proposal submission, whether or not intentional, may cause the proposal submission to be deemed “non-responsive” and as such, will not be considered for award.
d) Unless previously approved by the State through the written questions process identified in Section 11, any material submitted by any Proposer in the final proposal submission that is marked “CONFIDENTIAL” or
“PROPRIETARY” may cause the entire proposal submission to be deemed non-responsive and thereby rejected.

Contractor. A proposal with such language will be considered a counter proposal and will be rejected. Additionally, the General Terms and
Conditions (GTC 02/2025) for the State of California are standard contract terms and are not negotiable.
f) Cal OES is not required to award a contract. Cal OES reserves the right to reject any or all proposals and to waive informalities and minor irregularities in proposals received and to accept all or any portion of a proposal, if deemed in the best interest of the State and not contrary to law. Cal OES’ waiver of any immaterial deviation or defect will in no way modify the RFP documents or excuse the proposer from full compliance with the RFP specification, if awarded the contract.
g) A proposal may be rejected if it is conditional or incomplete, or if it contains any alterations of form or other irregularities of any kind.
7. EVALUATION AND SELECTION
a) At the time of proposal opening, each proposal will be checked for the presence or absence of required information in conformance with the submission requirements of this RFP.

OES’s needs. Should a proposal package not meet all of the requirements set forth in this RFP, it may be considered non-responsive and rejected from further competition. Those Proposer’s submittals that pass the initial review will be forwarded to the evaluation committee for evaluation of the technical proposals.
c) Award, if made, will be to the highest scored responsive, responsible proposal.
d) In the event of a tie, the proposed winner will be determined by a coin toss. Tie breaks will be witnessed, and Proposers may attend to witness the tiebreak process by contacting the contract analyst noted on the cover page of this RFP.
e) Proposals will be rated by an evaluation committee using a consensus scoring process for determining final scores. Below is the scoring criteria that will be used to evaluate proposals for this RFP.

• Is responsible for the execution of a distinct element of the work of the contract.
• Carries out the obligation by actually performing, managing, or supervising the work involved.
• Performs work that is normal for its business services and functions.
• Is responsible, with respect to products, inventories, materials, and supplies required for the contract, for negotiating price, determining quality and quantity, ordering, installing, if applicable, and making payment.
• Is not further subcontracting a portion of the work that is greater than that expected to be subcontracted by normal industry practices.
A contractor, subcontractor, or supplier will not be considered to perform a
“commercially useful function” if the contractor's, subcontractor's, or supplier's role is limited to that of an extra participant in a transaction, contract, or project through which funds are passed in order to obtain the appearance of SB or DVBE participation.
2. DISABLED VETERAN BUSINESS ENTERPRISE (DVBE) PROGRAM
It is the intent of the California Legislature that every State procurement authority honor California’s disabled veterans by taking all practical actions necessary to meet or exceed the Disabled Veteran Business Enterprise participation goal of a minimum of three percent (3%) of total contract value.
The Disabled Veteran Business Enterprise (DVBE) Certification and Outreach
Branch program was created for this purpose. The Disabled Veteran Business
Enterprise (DVBE) Participation Goal Program for State contracts is established in Public Contract Code (PCC), §10115 et seq., Military and Veterans Code
(MVC), §999 et seq., and California Code of Regulations (CCR), Title 2, §1896.61 et seq.
a) DVBE PARTICIPATION REQUIREMENT
The minimum percentage of DVBE participation is 3% for this solicitation.
The Proposer must complete the identified form(s) and fully document that the mandatory minimum percent of DVBE participation will be met in order to comply with this solicitation’s DVBE program requirement or the bid may be considered non-responsive.
Information submitted by the Proposer to comply with this solicitation’s
DVBE requirements will be verified by Cal OES. If evidence of an alleged violation is found during the verification process, Cal OES shall initiate an investigation, in accordance with the requirements of PCC §10115, et seq., and MVC §999 et seq., and follow the investigatory procedures required by 2 CCR §1896.91. Contractors found to be in violation of these provisions may be subject to suspension from doing business with the State of
California, contract termination, civil penalties, and loss of State certifications.
Note: Pursuant to Military and Veterans Code section 999 (B), only a DVBE who performs a Commercially Useful Function (CUF) relevant to the
Statement of Work included in this IFB shall qualify the Proposer or be used to qualify the Proposer for a DVBE participation and/or DVBE incentive. A certification signed under penalty perjury that the work performed by
DVBE subcontractors serves a CUF is required from the Proposer per MVC
§999.10(a)(3). Proposers must also verify each DVBE subcontractor’s certification status with OSDS to ensure DVBE participation eligibility prior to submitting bids.
b) DVBE PARTICIPATION REQUIREMENTS INSTRUCTIONS
These instructions contain information about the DVBE program requirements, Proposer responsibilities, and the DVBE Bid Incentive.
Proposers are responsible for thorough review and compliance with these instructions.
To meet the DVBE program requirements, Proposers must complete and fully document compliance with the following:
PARTICIPATION COMMITMENT
Proposers must commit to meet or exceed the DVBE participation requirement in this solicitation by either Method A1 (Proposer is a California certified DVBE) or A2 (Proposer is not a California certified DVBE). Proposers must document DVBE participation commitment by completing and submitting all forms and documentation necessary to support meeting
CUF. Forms include the Bidder Declaration (DGS PD-05105) and (DGS PD
843) DVBE Declarations, Attachment X, the Confirmation Letter/Form and
Certification of CUF Compliance (MVC 999.10(a)(3)) as described below, and any other requested documentation. Failure to complete and submit the required form(s) as instructed will render the bid non-responsive.

The written confirmation shall include, but is not limited to, the DVBE scope of work, work to be performed by the DVBE, term of intended subcontract with the DVBE, anticipated dates the DVBE will perform required work, rate and conditions of payment and total amount to be paid to the DVBE.
Failure to submit signed confirmations with the bid may render the bid non-responsive. If further verification is necessary, the State will obtain additional information to verify compliance with the above requirements.
5) DGS PD 843 DVBE Declarations form for all DVBE participants (prime or sub).
METHOD A2. NON-DVBE Proposer:

Failure to submit signed confirmations with the bid may render the bid non-responsive. If further verification is necessary, the State will obtain additional information to verify compliance with the above requirements.
5) DGS PD 843 DVBE Declarations form for all DVBE participants (prime or sub).
c) DVBE SUBSTITUTION
Proposers must use the DVBE subcontractors or suppliers proposed in the bid. Any substitutions must be requested in writing to the awarding department and approved by both the awarding department and OSDS in writing prior to the commencement of any work by the proposed
DVBE. The substitution must be to perform the same work and shall maintain the minimum level of DVBE participation stated in original bid.

d) DVBE SUBCONTRACTOR REPORTING
Proposers awarded a contract with a commitment to use DVBE subcontractors must certify, upon completion of contract that all payments have been made to the DVBE subcontractors by submitting the
Prime Contractor’s DVBE Subcontracting Report (STD 817). Cal OES will withhold $10,000 from the final payment, or the full payment if the final payment is less than $10,000 from prime contractors, until the complete and accurate STD 817 is received. Failure to submit this certification after given the opportunity to cure, will result in Cal OES permanently deducting
$10,000 from the final payment or the full payment if less than $10,000.
(MVC §999.7)
e) DVBE INCENTIVE
Pursuant to Military and Veterans Code Section 999.5, subdivision (a), an incentive will be given to a Proposer who provides DVBE participation. For evaluation purposes only, the State shall apply an incentive to bids that propose California certified DVBE participation as identified on the Bidder
Declaration DGS PD-05-105, and confirmed by the State. The DVBE
Incentive is as follows:
Confirmed DVBE Participation of: Incentive Amount

3. TARGET AREA CONTRACT PREFERENCE ACT
In accordance with California Code, Section 4530, Proposers may be eligible for a preference whenever contracts for goods or services are in excess of $100,000 and the Proposers meet certain requirements as defined in the California Administrative Code (Title 2, Section 1896 et seq.) regarding labor needed to provide the services being procured. Proposers may receive extra consideration depending on what parts of the preference they claim. Full details can be found on the STD 830 form itself. a) Preferences and incentives are used for bid tabulation purposes to determine the highest scored responsive responsible Proposer. Strict adherence to the laws and regulations to apply the preferences and incentives will be followed. If awarded the contract, the preference and/or incentive does not alter the amount of the resulting contract.
Please be aware that contracts awarded with applied preferences or incentives will be monitored throughout the life of the contract for compliance with statutory, regulatory and contractual requirements.
b) The SB preference of 5% will be applied when the highest scored proposal is from a non-certified SB or MB. The 5% will be calculated on the highest responsible proposer’s total score. That amount is then added to the score for each certified SB/MB or a NS claiming 25% SB/MB subcontracting for a new total score. (Note: NS claiming SB subcontractor preference cannot displace an award to a certified SB.)
c) The DVBE incentive points are based on the total possible available points, not including points for socioeconomic incentives or preferences. For evaluation purposes, the incentive points will be added to the total score.
If a SB is ranked number 1 after SB preference has been applied, the DVBE incentive is only calculated for Proposers certified as SBs. The incentive points cannot be used to achieve any applicable minimum point requirements and shall not displace an award to a certified SB with a non-
SB.
d) The TACPA preference will be applied after the SB preference and the
DVBE incentive.
