1. First paragraph, sixth sentence
– Will the state revise this sentence to: “All coverage, except Workers’ Compensation / Employer’s Liability, and Professional Responsibility, must be on…”
The State would agree to make that revision.
2. First paragraph, seventh sentence – We have blanket additional insured endorsements. Will the state revise this sentence to:
“Contractor agrees to name include the State…”
The State would agree to make that revision.
3. First paragraph, eighth sentence – Will the state revise this sentence to: “All policies, except Professional Liability, must contain an endorsement, or blanket endorsement, for a waiver of subrogation…”
The State would agree to add language clarifying that blanket endorsements are acceptable provided they have the same effect as would an endorsement that specifically identifies the State.
However, professional liability coverage should include a waiver of subrogation.
4. First paragraph, ninth sentence
– We are unable to revise our deductibles or self-insured retention and request deletion of this sentence.
The State would agree to the removal of this sentence.
5. Third paragraph, sixth sentence – Any subcontractors utilized are required to have insurance commensurate with the services provided by those subcontractors. Will the state revise this sentence to “Contractor shall confirm to the State that any subcontractors maintain sufficient insurance.”
The following revision would be acceptable:
“Contractor shall direct all subcontractors to maintain, and confirm in writing that all subcontractors maintain, insurance coverages appropriate to the services provided by those subcontractors.
Such coverages must contain the same endorsements, or equivalent policy language, as are required for the Contractor’s coverages.”
6. Third paragraph, last sentence
– We request deletion of this sentence our complete policies are proprietary and confidential due to them containing highly negotiated terms and language. Specific endorsements can be requested and provided, but complete policies cannot.
The requirement to provide complete policy documents can be removed and replaced with the following:
“The State reserves the right to require relevant excerpts from policy documents, including endorsements, at any time, as needed to check for

compliance with these specifications.”
7. Will the state be able to provide any estimate on fax toner usage or monthly spend, as this is outside the scope of normal pharmacy services.
The State is unable to provide any firm estimate on toner usage or monthly spend.
3. RFP Amendment Effective Date. The revisions set forth herein shall be effective upon release. All other terms and conditions of this RFP not expressly amended herein shall remain in full force and effect.
