Justice-Impacted Employment and Leadership Requirements
How will MDOC determine whether the contractor primarily employs justice-impacted individuals and whether a majority of its leadership consists of formerly incarcerated individuals? Please clarify whether owners, officers, employees, independent contractors and subcontractor personnel are included in these calculations and when compliance will be measured.
Yes, owners, officers, and employees will be required to included in the calculations. The MDOC will verify the status of justice-impacted individuals using the Law Enforcement Information Network (LEIN). The RFP states that a majority of a Contractor’s staff must be justice-impacted individuals.
May the awarded contractor use qualified subcontracted transportation providers to supplement its transportation capacity? If permitted, must each subcontractor independently satisfy the justice-impacted employment and leadership requirements, or are those requirements measured only at the prime-contractor level?
Bidders must submit a proposal which includes all subcontractors that the bidder intends to use during the contract. The State will approve or deny any proposed subcontractors. During the contract, Contractors may request to use additional subcontractors. MDOC will decide within 90 days.

The billable time begins 15 minutes before the agreed pickup time at an MDOC facility, and ends when the client is dropped off at the destination.

| The anticipated advance-notice period for transportation referrals is 2-3 weeks. Referrals made with less than 7 days notice are optional. Cancellations by the State are billable if the cancellation request is received by the bidder within one business day or less before a scheduled pickup.
