Subrogation Waiver. Contractor and Contractor’s insurance carrier shall waive any and all rights to subrogation against Galveston County regarding any suit or claim arising out of personal injury or property damage resulting from Contractor’s performance under this Agreement.
L. SCOPE OF WORK
ADULTICIDE SPECIFICATION:
The insecticide Galveston County requires for mosquito control (adulticide) is Dibrom, which contains the active ingredient Naled. The contractor may not substitute a different product unless the County or its authorized representative approves the substitution in advance.
The contractor shall apply the insecticide at the exact rate specified by the County — not above, and not below than the rate listed on the product's official label.
CONTRACTOR RESPONSIBILITIES:
The successful contractor shall meet the minimum requirements:
a. Handling the Insecticide The contractor is responsible for safely transferring the insecticide from its container into the aircraft.
b. Trained, Compliant Staff The contractor must provide enough trained personnel to handle the insecticide safely, meeting or exceeding federal (EPA), state, and local safety requirements. Staff must also be prepared to quickly and effectively respond to any spills.
c. Spray Mission Reports After every spray application, the contractor must submit a report showing: spray altitude, wind speed and temperature at release height, aircraft ground speed, date and time of application, amount of insecticide used, number of acres treated, and the full flight path showing where spraying occurred. This report is due within 48 hours of each application.
d. Availability The contractor must be reachable between 8:00 AM CST and 5:00 PM CST, seven days a week, and available whenever the County needs Aerial Application Services performed.
e. Response Time The contractor must be on-site and ready to begin spraying within 72 hours of the County requesting service.
AIRCRAFT:
The contractor must provide aircraft capable of treating at least 30,000 acres in a single evening of spraying.
All aircraft used under this contract must meet the following requirements:
FAA Certification The aircraft must be certified by the Federal Aviation Administration (FAA) and comply with all requirements under FAR Part 137 (Agricultural Operations).
Calibration
The aircraft must be calibrated to release the correct amount of insecticide, with droplet size matching what the insecticide's label requires based on operating conditions (such as swath width and airspeed).
GPS Spray Guidance System The aircraft must be equipped with either the Wingman GX aerial spray guidance system or the AG Nav Flight Master Platinum GPS guidance and mapping system. These systems must process data on board with the following accuracy:
• Wind speed accurate to less than 1 knot
• Wind direction accurate to within 2 degrees
• Temperature accurate to less than 1 degree
This level of accuracy is needed so the system can adjust spraying in real time and detect temperature inversions (weather conditions that can affect spray drift). The system must also be able to produce a printable map showing all spray activity, including exactly where spraying started and stopped.
Spray Nozzle System The aircraft must be equipped with a ULV (Ultra-Low Volume) rotary atomizer spray system. The nozzles must produce droplets certified through Malvern Laser Wind-Tunnel analysis, or use industry-approved 1-inch spinning Teflon impingers.
GPS Grid Guidance The aircraft must have GPS guidance with gridline capability, accurate to within 0 to 50 feet, and this GPS system must be used on every aerial spray mission.
APPLICATION:
The County will tell the contractor which geographical areas need to be sprayed, along with the date, time, a backup/alternate time, and the number of acres to be treated. This information will be shared through GIS software provided by the contractor.
A County representative will be on hand to monitor the spray mission and make sure procedures are followed correctly.
The County will specifically be watching:
• Landing Rate Counts (LRC), taken before and after spraying
• Surveillance trap results, taken before and after spraying
• Weather conditions (whether they're favorable or unfavorable for spraying)
• How the application is being carried out — things like spacing between flight lanes and flying altitude
The County's representative and the contractor will jointly have the authority to approve, delay, or stop a spray mission if needed.
During Each Mission The contractor must be able to:
Monitor Weather in Real Time Using an AIMMS-20 weather monitoring system, the contractor must track live weather conditions at the aircraft's release height, specifically:
• Temperature
• Wind speed
• Wind direction
• Humidity
Optimize the Spray Application Getting insecticide to land effectively — and not drift off-target — depends on many factors working together: droplet size, air turbulence created by the aircraft itself, weather at different altitudes, evaporation, where the nozzles are positioned, the aircraft's own characteristics, the product's characteristics, and how fast/high the aircraft is flying when it releases the product.
Because of this, the contractor must have equipment on board that can account for all these factors together, so the spray achieves the best possible droplet density, volume, and size over the treatment area — while keeping off-target drift to a minimum.
The onboard GPS system must also be able to alert pilots in real time if weather conditions change or if a temperature inversion develops (a condition that can cause insecticide to drift instead of settling where intended).
PILOT QUALIFICATIONS:
Pilots shall meet the following requirements:
• At least 500 logged, verifiable flight hours (total flying experience)
• At least 100 logged, verifiable hours specifically flying aerial mosquito insecticide application missions
• A current, valid certification in both the public health and aerial categories of pest control
In addition, pilots must provide copies of the following documents:
• Commercial pilot's license with a multi-engine rating
• First- or second-class medical certificate
• FCC restricted radio operator's permit
• Any other documentation required by the FAA, the State, or local agencies
M. ASSIGNMENT AND SUBLETTING
The Contractor will retain full control over this contract and will not assign or subcontract said contract without the prior written consent of the County. Failure to request consent shall be grounds for default under this Contract. The Contractor further agrees that assigning or subcontracting any portion or feature of the work shall not relieve the Contractor from its full obligations under this contract.
The successful contractor shall obtain prior approval and consent from the County prior to utilizing a subcontractor with respect to the services to be provided. These services shall be of the same professional quality as mentioned in the contract and all requirements are to remain in effect. The contractor shall warrant that each of its subcontractors providing services (if any) shall procure and maintain insurance of the types and to the limits specified herein.
If consent is granted by the County, successful contractor must take all necessary steps to assure that minority businesses, women’s business enterprises and labor surplus area firms are used when possible. Affirmative steps must include the following:
1) Placing qualified small and minority businesses and women’s business enterprises on solicitation lists;
2) Assuring that small and minority business, and women’s business enterprises are solicited whenever they are potential sources;
3) Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority business, and women’s business enterprises;
4) Establishing delivery schedules, where the requirement permits, which encourage participation by small and minority businesses, and women’s business enterprises;
5) Using the services and assistance, as appropriate, of such organizations as the Small Business Administration and the Minority Business Development Agency of the department of Commerce; and
6) Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed in paragraphs (1) through (5) of this section.
N. DIASTER AND EMERGENCY RESPONSE
The Galveston County Commissioners’ Court recognizes the vulnerability of Galveston County citizens and their communities to damage, injury, and loss of life and property resulting from disasters. Such events require 24/7 responses from emergency first responders, government employees, various elected and appointed officials, state and local representatives, and other emergency management personnel.
In an effort to satisfy cost reasonableness responsibilities and reimbursement initiatives in times of declared emergencies or disasters and their recovery efforts, the County of Galveston reserves the right to obtain additional quotes and current pricing information from the successful contractor and other contractors to perform the work as stated per the specifications listed herein and in the resultant contract. These services shall be solicited on the open market with the same specifications as listed herein and as stated in the resultant contract, however, may include scope changes due to the unknown status of the emergency. The County of Galveston reserves the right to utilize the most advantageous and cost-effective solution(s) during the duration of the declared event and recovery period in an effort to relieve the taxpaying citizens of increased burden and financial hardship.
