About this file

This Request for Proposal (RFP 26-005) is issued by the New York State Office of Mental Health (OMH) to procure qualified licensed clinicians and Strict and Intensive Supervision and Treatment (SIST) providers for sex offender treatment services throughout New York State. The solicitation seeks to identify providers who can deliver sex offense-specific treatment based on cognitive-behavioral models incorporating relapse prevention and Risk Needs Responsivity components to court-ordered individuals living in the community. Services include intake evaluations, individual therapy (one to three times weekly), group therapy (one to two times weekly), completion of assessment instruments (ACUTE-2007 monthly and STABLE-2007 semi-annually), monthly team meetings with OMH and Department of Corrections and Community Supervision (DOCCS) personnel, quarterly court progress reports, and telehealth capabilities. The solicitation was released on October 22, 2026, with an initial response review date of November 13, 2026, and proposals will be continuously reviewed on a quarterly basis thereafter. The resulting contracts are anticipated to have a five-year term from the date of approval by the New York State Office of the State Comptroller, with no specified renewal options.

All responsive and responsible offerors meeting the requirements and achieving a minimum combined score of 60 will be awarded contracts under this continuous recruitment RFP. Minority and Women-Owned Business Enterprise (MWBE) and Service-Disabled Veteran-Owned Business Enterprise (SDVOB) goals are both set at 0 percent. Proposals will be evaluated using an 80-point technical component (based on qualifications, experience, evidence-based treatment expertise, therapeutic modalities, and co-occurring condition regimens) and a 20-point cost component, with evaluation committees reviewing technical and cost proposals separately. Existing SIST contract holders will have their pricing evaluated against historical costs with justifiable increases capped at the lesser of 3 percent or the Consumer Price Index. New providers' cost proposals will be compared to regional pricing and negotiated prior to regional ranking. Prior award recipients listed include Sexual Behaviors Outreach Consultants, New Paradigm Psychological Services PLLC, Forensic Mental Health Counseling of WNY PLLC, and multiple individual practitioners and small firms. All proposers must hold current licensure in New York State (psychiatrist, psychologist, social worker, mental health counselor, or other mental health professional), possess a master's degree or higher in a clinical field, adhere to Association for the Treatment of Sexual Abusers (ATSA) standards and ethics, and provide proof of Workers' Compensation and Disability Benefits insurance coverage prior to contract execution.

5. SCOPE OF WORK

5.1. Overview and Background

In 2007, Article 10 of the New York State Mental Hygiene Law was enacted as part of the Sex Offender Management and Treatment Act (SOMTA). The legislature found that “recidivistic sex offenders pose a danger to society that should be addressed through comprehensive programs of treatment” (MHL § 10.01). At that time, existing criminal processes were enhanced, and civil measures advanced to supplement the State’s efforts to provide meaningful responses to the risks to public safety posed by certain sex offenders. The legislature determined that “the system should offer meaningful forms of treatment to sex offenders in all criminal and civil phases, including during incarceration, civil commitment and outpatient supervision” (MHL § 10.01). Article 10 provides for either confinement of certain sex offenders in an OMH secure treatment facility or management in the community under Strict and Intensive Supervision and Treatment (SIST).

Article 10 respondents have the right to a trial by jury. The jury, or court if a jury trial is waived by the respondent, must determine whether a respondent is a “detained sex offender who suffers from a mental abnormality.” The burden of proof, placed upon the Office of the Attorney General, is one of “clear and convincing evidence.” If the jury, or court if a jury trial is waived, finds that the respondent suffers from a mental abnormality, the trial judge must determine whether the respondent is a dangerous sex offender requiring confinement or could be managed in the community via Strict and Intensive Supervision and Treatment (SIST).

Solicitation number – solicitation title Page 6 of 25

The primary goal of Strict and Intensive Supervision and Treatment is to successfully manage, in the community, sex offenders who have been determined by the court to suffer from a mental abnormality (i.e., the individual has been found to be predisposed to commit sex offenses and to not have the ability to control as defined in MHL § 10.03(i)), but who are deemed by the court not to be dangerous enough to require civil confinement. SIST provides increased public protection through mandatory sex offense specific treatment and intensive supervision. When a sex offender is placed on SIST, s/he agrees to abide by specific court‐issued conditions, which are typically based upon the recommendations of the Department of Corrections and Community Supervision (DOCCS) in consultation with OMH and the designated community-based treatment provider(s). These conditions are extensive and mirror specialized conditions imposed on sex offenders subject to traditional parole supervision and often include global positioning satellite (GPS) tracking, polygraph monitoring, specification of residence, prohibiting contact with identified past or potential victims, attending and participating in treatment sessions, and other related treatment and supervision requirements.

Sex offenders placed on SIST often participate in multiple treatment programs in the community. All community-based treatment providers must work closely with OMH and DOCCS Parole Officers to ensure compliance with all SIST conditions.

All sex offense specific treatment under SIST is based upon a cognitive‐behavioral model and incorporates a relapse prevention and Risk Needs Responsivity component. Sex offense specific treatment providers who serve SIST clients must agree and adhere to a standard set of provider requisites developed by OMH and DOCCS. The treatment team seeks to assist the client in enhancing and maintaining control over criminal sexual behaviors, deviant arousal patterns, and other factors that may contribute to reoffending. Current sex offender research indicates that sexual offense specific treatment, coupled with intensive community supervision and regular use of polygraphs (this approach is commonly known as the Containment Model) is an effective method to manage high‐risk sex offenders in the community. Comprehensive sex offense specific treatment is a critical component in an overall strategy for the effective management of sex offenders. Treatment that is appropriately tailored to risk level is a key piece to successful management. Particularly when combined with appropriate supervision and offender accountability, sex offense specific treatment can substantially reduce sexual recidivism among appropriate offenders.

5.2. Services Required

Upon release from prison or an OMH Secure Treatment Facility, DOCCS transports the SIST client to the Parole Field Office responsible for their oversight in the community, to place a global positioning satellite (GPS) tracking device on their ankle and to review their Parole conditions and OMH clinical service plan. The client is then transported to the county Department of Social Services (if needed, as many are undomiciled and have little to no finances) and then to their residence.

Clients attend their scheduled appointments with sex offense specific treatment provider and other treatment providers as established by OMH/SIST Unit before their release. All treatment providers then begin to develop clinical services plans to meet the client’s individual needs.

The assigned OMH SIST Liaison monitors their case closely through the treatment providers and parole officer.

The sex offense specific treatment provider is required to complete an individualized treatment plan within 45 days of initiating treatment, using the template sent to them by OMH/SIST Unit and updated every 90 days. The sex offense specific treatment provider is also required to complete the STABLE-2007 assessment every six months.

Solicitation number – solicitation title Page 7 of 25

Monthly team meetings are facilitated and documented by the SIST Liaison to include all treatment providers and the Parole Officer to ensure all parties are aware of any concerning behaviors and/or progress.

Article 10 requires the treatment providers to provide quarterly reports to the Court, Office of the Attorney General (OAG) and DOCCS regarding the SIST client’s progress. OMH provides a template to be used, to ensure consistency in reporting among treatment providers. OMH collects the quarterly reports and forwards them to parties mentioned above.

Parole also closely monitors the SIST client’s actions and behaviors and ensures compliance with their management plan.

Parole will write an incident report or take a client into custody for serious violations of their court ordered conditions.

In accordance with Article 10, the SIST client can petition the court for discharge from civil management. OMH is ordered to conduct an evaluation to determine if the individual still has a mental abnormality. The SIST client also has an independent assessment. Both evaluations are heard and/or reviewed by the court to make the final determination.

NOTE: Clients that are currently under the care of a SIST provider per previous court approval, will remain with that provider unless there is a court mandated change, OMH initiates a transfer, or provider request. Provider request requires OMH review

5.5. OMH Responsibilities

Pursuant to Article 10 of the Mental Hygiene Law, SIST clients are mandated to have a community service plan that includes sex offender treatment developed by the Office of

Solicitation number – solicitation title Page 9 of 25

Mental Health (OMH) upon release to the community. SIST clients are court ordered to comply with this community service plan, including a regimen of sex offender treatment. It is important for clients to invest in their treatment, which includes accepting fiscal responsibility associated with treatment if they have the financial means to do so. OMH is the payee of last resort for sex offender treatment costs. In order to assess the financial contribution each SIST client can make to their sex offender treatment, each client is expected to complete a financial disclosure form prior to being released to SIST. Once in the community, OMH periodically assesses the client’s financial resources to determine if the client can contribute towards sex offender treatment.

In order to do this periodic review, the SIST Liaison will work closely with the Parole Officer and sex offense specific treatment provider to assess the client’s financial resources. The client’s employment status and financial resources should be discussed at each monthly team meeting. The SIST Liaison will document within the Monthly Discussion Guide General Update Section the status of employment and/or source(s) of income.

If it is determined that the client can financially contribute towards sex offense specific treatment (either at the time of the original SIST investigation or while in the community), a financial review will occur every three months. As such, the SIST Liaison will work with the community treatment provider to ensure a new Financial Disclosure form is completed by the SIST client. The completed form should be submitted to the SIST Director for review and appropriate action.

If the client has no financial means/resources, and is deemed unable to contribute financially to treatment sessions, the SIST Liaison is required to monitor the case and inquire each month regarding financial means/resources (i.e., receives a significant amount of money from an inheritance, back pay from SSA/SSI, becomes employed). If financial means/resources are confirmed, the SIST Liaison will request completion of the Financial Disclosure form

Solicitation number – solicitation title Page 17 of 25

OMH will be awarding multiple contracts from this RFP to all those who are qualified to deliver these services and receive a minimum combined score of 60. Proposers will be scored, ranked, and grouped into regions based upon their location in NYS (See Exhibit 5-Map of NYS Regions uploaded in Contract Reporter listing)

OMH and its partners at AG will take the ranking into account when making recommendations for placement with a provider. However, final provider assignment is court-appointed and as such work will be assigned based on judge's order.

OMH reserves all rights with respect to the award. All proposals deemed to be responsive to the requirements of this procurement will be evaluated and scored for technical qualities and cost.

Proposals failing to meet the requirements of this document may be eliminated from consideration.

Proposers may be requested by OMH to clarify the contents of their proposals. Other than to provide such information as may be requested by OMH, no Proposer will be allowed to alter its proposal or add information after the Deadline for Submission of Proposals.
