About this file

This Request for Proposals (RFP) is issued by the City of Wichita Falls, Texas, for on-call grass and weed-cutting services for vacant lots and properties within Wichita County. The City intends to select multiple contractors to perform mowing and trimming services on an as-needed basis under a one-year contract with an option to renew for one additional year if both parties agree. The scope of work includes grass and weed cutting for properties where vegetation exceeds nine inches in height, violating the City's ordinance; contractors must also remove branches, trash, litter, and debris prior to mowing. Services must be performed during normal business hours (Monday-Friday, 8:00 a.m. to 5:00 p.m., though weekend work is permitted if noise ordinances are followed) and completed within seven days of assignment. Proposals must be submitted in sealed envelopes to the City of Wichita Falls Purchasing Department by October 19, 2026, at 4:00 p.m. CST. Before and after photographs with geotagging and date/time stamps must be submitted through the City's MyGov system within three days of completion. The City will conduct property inspections within seven days of work completion.

Contractors must submit pricing for three lot size classifications: Class 1 (up to 0.25 acres at $140 City reference fee), Class 2 (0.26 to 0.99 acres at $150 reference fee), and Class 3 (1.0 to 2.99 acres at $175 reference fee), with properties of 3.0 acres or larger requiring separate estimates and City approval. A $25 mobilization fee is available if a contractor responds within seven days to find a property already mowed or not requiring service. Evaluation criteria include vendor experience (25%), references (25%), pricing (30%), and current equipment (20%). Minimum equipment requirements include a 60-inch commercial-grade mower or zero-turn mower, commercial-grade trimming equipment, and a tractor with bush hog if needed. Contractors may not subcontract mowing work and must be easily accessible during business hours for scheduling changes. The City reserves the right to reject any or all proposals and may award to the lowest responsive and responsible bidder or make separate awards to multiple vendors. Vendors must comply with Texas Government Code certifications regarding boycotts of Israel and energy companies, provide a W-9 form, submit references from similar projects, and maintain current insurance and safety equipment throughout the contract term.

The City intends to select multiple contractors to perform these services under an on-call contract. This solicitation does not imply nor guarantee a work duration, monetary value, or any work. The on-call contract will be for one (1) year.

Proposals shall be submitted in accordance with the terms and conditions of this RFP and any addenda issued hereto.

B. General Notice to Vendors

It shall be the Vendor’s responsibility to read the Instructions, the City’s terms and conditions, all relevant exhibits and attachments, and any other components made a part of this RFP and comply with all requirements and specifications herein. Vendors also are responsible for obtaining and complying with all Addenda and other changes that may be issued in connection with this RFP.

If vendors have questions, issues, or exceptions regarding any term, condition, or other component within this RFP, those must be submitted as questions in accordance with the instructions in Section II - PROPOSAL QUESTIONS. If the City determines that any changes will be made as a result of the questions asked, then such decisions will be communicated in the form of an RFP addendum. The City may also elect to leave open the possibility for later negotiation and amendment of specific provisions of the Contract that have been addressed during the question-and-answer period. Other than through this process, the City rejects and will not be required to evaluate or consider any additional or modified terms and conditions submitted with Vendor’s proposal. This applies to any language appearing in or attached to the document as part of the Vendor’s proposal that purports to vary any terms and conditions or Vendors’ instructions herein or to render the proposal non-binding or subject to further negotiation. Vendor’s proposal shall constitute a firm offer. By execution and delivery of this RFP Response, the Vendor agrees that any additional or modified terms and conditions, whether submitted purposely or inadvertently, shall have no force or effect, and will be disregarded. Noncompliance with, or any attempt to alter or delete, this paragraph shall constitute sufficient grounds to reject Vendor’s proposal as nonresponsive.

Contact with anyone working for or with the City regarding this RFP other than the City Purchasing Manager named on the face page of this RFP in the manner specified by this RFP shall constitute grounds for rejection of said Vendor’s offer, at the City’s election.

This Request for Proposal serves two functions: (1) to advise potential Vendors of the parameters of the solution being sought by the Department; and (2) to provide (together with other specified documents) the terms of the Contract resulting from this procurement. As such, all terms in the Request for Proposal shall be enforceable as contract terms in accordance with the General Contract Terms and Conditions.

The use of phrases such as “shall,” “must,” and “requirements” are intended to create enforceable contract conditions. In determining whether proposals should be evaluated or rejected, the Department will take into consideration the degree to which Vendors have proposed or failed to propose solutions that will satisfy the Department’s needs as described in the Request for Proposal. Except as specifically

RFP No. 07-26 stated in the Request for Proposal, no one requirement shall automatically disqualify a Vendor from consideration. However, failure to comply with any single requirement may result in the Department exercising its discretion to reject a proposal in its entirety.

RFP No. 07-26

VIII. SCOPE OF WORK

A. GENERAL

The general scope of work for this contract is mowing and trimming. However, the contractor shall pick up branches, trash, litter, and debris on the property prior to mowing. Trash, litter, and debris removed from a property prior to mowing may be bagged and delivered to the City Landfill at 10984 Wiley Rd., Iowa Park, TX 76367 at no charge to the contractor. In such cases, the contractor shall not bill the City for the transportation of this trash/litter.

Services shall be performed during normal business hours Monday – Friday, 8:00 a.m. - 5:00 p.m. Services shall be completed within 7 days of notice, before and after photos, marked with the property address, shall be provided to the City representative within 3 days. Properties shall be inspected by the City within 7 days. Contractors must use the City's MyGov system to update each abatement job. Required updates include marking the job complete and uploading clear before and after photos for every property before the job will be considered complete. Photographs must be geotagged and include a date and time stamp.

A project will not be considered complete, nor eligible for final acceptance or payment, until all required documentation has been submitted through MyGov.

B. SPECIFIC SCOPE

When the weeds and grass on residential or commercial properties have grown to more than 9 inches in height, it violates the City of Wichita Falls’ Weeds, Rubbish, and Unsanitary Matter ordinance. Upon identification of a property in violation, the City’s Code Compliance Division mails a Courtesy Notice to the property owner. This notice serves as a notification to bring the property into compliance with the ordinance within 10 days. If the property owner fails to address the violation within the specified time frame, the City will direct a contractor to perform the necessary weeds and grass abatement.

Most residential lots within the City are approximately .25 acres or less, with some nearing .50 acres.

Properties subject to mowing may include vacant lots or lots with vacant dwellings. For properties exceeding 3 acres in size, the City’s agent will negotiate a price with the contractors based on the mowing area involved, rather than the overall size of the property. This approach is taken due to there may be large structures or other features occupying a significant portion of the acreage.

Once a property is identified as a violation, the City will select the most suitable contractor based on various factors including cost, availability, and past work performance.

The following terms and conditions apply to the cutting of grass/weeds and violation of the public nuisance- weeds ordinance for the City Wichita Falls:

a) The City's agent shall approve the contractor's equipment to be used to fulfill the terms and conditions of this contract.

b) Assignments for work are disseminated by the City's agent based on the needs of the City.

c) Every mowing assignment will also require edging on curbsides, gutters, and sidewalks.

d) The use of weed trimming equipment will be required around buildings, trees, bushes, curbs, fences, sidewalks, utility poles, etc.

e) Grass clippings and other debris shall be removed from sidewalks, driveways, curbs, gutters, and other paved surfaces upon completion of mowing. Contractors may use a blower or broom for

RFP No. 07-26 cleanup; however, grass clippings, leaves, and debris shall not be blown into or left in the street, gutter, storm drain, or on neighboring properties. All debris shall be collected or directed back onto the property for proper disposal.

1. Minimum equipment recommended:

a. PTO-driven 60 commercial grade mower or 60" commercial grade zero-turn mower

b. Acceptable commercial grade trimming equipment with steel blade compatibility

c. Tractor and bush-hog must be available if required

d. Other standard lawn maintenance equipment shall be available as needed.

2. Before the bid award, the City reserves the right to inspect all equipment to be used during the performance of this contract. All equipment must have any and all safety devices in operating condition for the duration of the contract. If the contractor or his/her employees are found to be operating unsafe equipment they will be directed to stop work until the equipment is repaired to a safe operating condition.

3. The general scope of work for this contract is mowing and trimming. However, the contractor shall pick up all limbs, branches, trash, litter and debris on the property prior to mowing.

Trash, litter and debris removed from a property prior to mowing may be bagged and delivered to the City Landfill at no charge to the contractor. In such cases, the contractor shall not bill the city for transportation of materials to the City Landfill.

4. Under normal conditions, all work on the properties listed is to be completed no later than 7 days from the assignment date. Allowances for inclement weather or other unusual circumstances will be determined by the City's agent.

5. Priorities will be assigned by the City's agent and work scheduled accordingly based upon factors such as seasonal growth rate and weather. The City reserves the right to change work assignments and priorities at any time. For this reason, it is imperative the contractor or his/her representative are easily accessible during working hours in the event scheduling changes are necessary.

6. The contractor will submit a single invoice in the amount of the contracted price upon completion of work and verification by the City’s agent.

C. TASK/DELIVERABLES

• Contractors shall have a strict deadline of seven (7) days to mow the properties assigned to them each week. It is essential to complete the mowing within this timeframe to ensure our mowing schedule remains manageable and efficient. Allowances for inclement weather or other unusual circumstances will be determined by the City’s agent or representative.

• Contractors are not permitted to subcontract the mowing work to third parties. All mowing tasks shall be completed by the contracted individual or team.

• The contractor shall ensure that no grass/weed clippings are mowed into the roadway, where they may become clogged in the storm drain system.

RFP No. 07-26

• Contractors are required to mow the right of way within the boundary lines of the property.

• Trimming is required for each mow (trees, shrubs, buildings, utility poles, right of way, etc.)

• It is the responsibility of the contractor to identify any hazards to equipment, (i.e. mowing obstacles, or other conditions) that may damage equipment or injure personnel. The City is not responsible for damage to the contractor’s equipment.

• The contractor or his representative shall be easily accessible during normal business hours of 8:00 a.m. to 5:00 p.m.

IX. CONTRACT ADMINISTRATION

A. PROJECT MANAGER AND CUSTOMER SERVICE

The Vendor shall designate and make available to the City a project manager. The project manager shall be the City’s point of contact for contract related issues and issues concerning performance, progress review, scheduling and service.

B. DISPUTE RESOLUTION

The parties agree that it is in their mutual interest to resolve disputes informally. A claim by the Vendor shall be submitted in writing to the City’s Contract Lead for resolution. A claim by the City shall be submitted in writing to the Vendor’s Project Manager for resolution. The Parties shall negotiate in good faith and use all reasonable efforts to resolve such dispute(s). During the time the Parties are attempting to resolve any dispute, each shall proceed diligently to perform their respective duties and responsibilities under this Contract. If a dispute cannot be resolved between the Parties within thirty (30) days after delivery of notice, either Party may elect to exercise any other remedies available under this Contract, or at law. This term shall not constitute an agreement by either party to mediate or arbitrate any dispute.

C. CONTRACT CHANGES

Contract changes, if any, over the life of the contract shall be implemented by contract amendments agreed to in writing by the City and Vendor.

D. CITY’S RIGHTS AND OPTIONS

The City reserves the following rights, which may be exercised at the City’s sole discretion:

• To supplement, amend, substitute or otherwise modify this RFP at any time;

FAQs

Q1: The proposal states all work would need to be done during business hours on Monday-Friday. Is this set-in stone? We do a lot of our mowing after hours and on weekends.

A1: Weekends are fine as long as you follow the noise ordinance.

Q2: If the City intends to select multiple contractors how do you plan on scheduling the work?

A2: We anticipate creating a list and assigning work in a rotation. If a contractor is not able to take a job it will be offered to the next one on the list and so forth.

Q3: Do the references need to be commercial or can they be residential clients?

A3: Either one is fine as long as the work provided was similar to the size and scope of those outlined in the proposal.

Q4: Is there an estimated frequency that the lots would need to be serviced?

A4: Each lot would be mowed one time. We anticipate the list to change constantly with the removal of those that have been completed and the addition of those needing to be serviced.

Q5: I have read the body a few times as to what is required with the submission but am still unclear on the cover letter, execution pages and pricing. I don’t find a place to list experience, equipment, etc.

A5: The cover letter should briefly introduce your company, highlight your qualifications and give any other pertinent information not specifically requested in the bid packet (ex: list of equipment).

The execution pages are sections with legal and contractual elements, signature pages, submission details, insurance requirements, etc. When in doubt consider it as the bid packet with any supplemental information requested. This includes any addendums that have been issued as they are to be signed and returned with the submission
