About this file
This Request for Information (RFI) is issued by the Virginia Department of Behavioral Health and Developmental Services (DBHDS) to gather market information regarding nursing home beds and skilled in-home medical care services for Sexually Violent Predators (SVPs) who have been found suitable for conditional release and reside in the community. The RFI seeks information about available resources, costs, procedures, and challenges associated with providing these services to SVP individuals under Va. Code Section 37.2-900 et seq. The RFI was issued on September 18, 2026, with responses due by October 22, 2026, at 2:00 PM local time, and questions about the solicitation must be submitted by October 20, 2026, at 5:00 PM local time. This is an informational solicitation only and does not constitute a commitment to procure services, nor is responding a prerequisite for future procurement opportunities. Responses must be submitted electronically through the eVA platform in Adobe PDF format with a maximum of 30 pages and should be separated into sections covering services, infrastructure and costs, and answers to specific questions.
The RFI addresses a current situation where an increasing number of SVP individuals on conditional release and those civilly committed are experiencing severe, debilitating medical conditions, with anticipation that this population will grow as the SVP census increases and the current population ages. Many of these individuals are expected to be eligible for Medicare and Medicaid reimbursement, with DBHDS seeking to minimize Commonwealth costs through insurance coverage. Respondents must describe their agency's experience providing skilled medical treatment, facility modifications needed to accommodate SVP individuals with estimated renovation costs, average treatment costs, Medicaid billing experience, staffing structure, admission requirements, and typical length of stay. All responses become the property of DBHDS and will be subject to the Virginia Freedom of Information Act. The Commonwealth will not be liable for any costs incurred by respondents, and no costs submitted will be used for evaluation purposes.

I. Introduction
This Request for Information (RFI) is to gather information; it is not a solicitation for services. The information received will be informative and may assist in planning. Nothing in this RFI should be construed as intent, commitment or promise to solicit or procure a solution. DBHDS is not at this time seeking proposals and will not accept unsolicited proposals. Any response to this RFI shall not be considered a pre-requisite to submitting a proposal for any subsequent procurement.
DBHDS will not be liable for any costs incurred by responding to this RFI. Respondents should not provide any confidential or proprietary information. Information submitted in response to this RFI will become the property of the DBHDS.
Respondent is asked to provide estimated cost within their response for such services described in their RFI response. However, such cost will in no way be used for evaluation or considered as a proposal of a solicitation. Following receipt of responses to this RFI, DBHDS may contact some respondents to schedule clarification meetings to gain additional understanding.
II. Purpose
To gather information to assist the Commonwealth in effectively analyzing the available resources, cost, procedures and challenges to obtain nursing home services or in home skilled medical care for individuals found to meet the criteria as Sexually Violent Predators (SVPs) pursuant to Va. Code Section 37.2-900 et.
seq. who have been found suitable by the court of jurisdiction for conditional release and reside in the community.
The RFI should:
1. Discover community-based resources that may be able to meet the needs of this population.
2. Determine details of these resources including length of stay, level of treatment provided, location where treatment will be provided (home-based versus facility based) and physical adjustments to facilities that may be needed (i.e. locked doors).
3. Project cost (if any) to obtain those services as well as determine Medicaid eligibility.
III. Present Situation
The Commonwealth, led by the Department of Behavioral Health and Developmental Services in the Office of the Secretary of Health and Human Services, must assess the impact and cost of issuing a contract to provide skilled medical care to individuals found to meet SVP criteria and who have been placed by the court of jurisdiction on conditional release in the community or who are pending conditional release. The information received from RFI respondents will help in the development of the Commonwealth’s strategy for addressing these needs.
While some SVP individuals require intensive sex offender treatment in a secure facility operated by DBHDS called the Virginia Center for Behavioral Rehabilitation (VCBR), others whose risk of reoffending the courts determine can be managed in the community, are placed on conditional release with GPS and, through a contract between DBHDS and the DOC, are under the supervision of the Department of Corrections (DOC) supervising officers. SVP individuals on conditional release live and work in the community and comply with the requirements of the Virginia Sex Offender Registry. There are currently a number of SVP individuals both on conditional release and civilly committed who have severe, debilitating medical conditions. As the SVP census increases and the current population ages, we anticipate the number of individuals meeting these criteria will increase. These medical conditions are chronic, at times terminal, and often have rendered the individual so impaired that their risk of sexual re-offending is considered minimal. DBHDS is in need of skilled medical services to address the concerns of this population. Many of these individuals will be eligible for Medicare and Medicaid reimbursement. DBHDS is also interested in the potential for these services to be covered by Medicaid, thus minimizing or eliminating any costs to the Commonwealth.
Any vendor selected to provide skilled medical services to this population shall work closely with the VA DBHDS Office of Sexually Violent Predator Services. The actual number of individuals referred for treatment in any given year is dependent upon client populations, needs, and available funding.
Desired Criteria for Substance Abuse Treatment
1. The provider shall ensure staff provide services that follow applicable state and federal statutes and regulations as established by the Centers for Medicare and Medicaid Services (CMS) and Virginia Department of Health including but not limited to any requirements for licensure and/or certification.
2. The provider shall ensure that any facility where services are being provided maintains compliance with all federal, state and local regulations. The facility shall be located within the Commonwealth of Virginia.
3. The provider shall agree to work closely with DBHDS and DOC staff to ensure that the individual can adhere to the conditions of supervision and their SVP conditional release plan when applicable.
4. The provider shall maintain a system of data collection and management mechanisms for clear reporting to DBHDS.
