About this file

This document is a "Response to Offeror Questions" for a Community Development Block Grant Disaster Recovery Administration procurement issued by the South Dakota Governor's Office of Economic Development (GOED). The document addresses six specific questions from potential vendors regarding proposal submission requirements, including clarifications on expense reimbursement, cost proposal structure, key staff resume submissions, potential contract term exceptions, intellectual property considerations, and attachment requirements.

The document indicates that GOED will reimburse direct expenses at cost when approved in advance, requires vendors to include estimated time to complete the engagement in their cost proposal, and expects comprehensive team qualifications alongside individual staff resumes. GOED maintains flexibility in reviewing proposed contract exceptions while reserving the right to reject modifications. The procurement is related to administering a $15,375,000 HUD Community Development Block Grant Disaster Recovery (CDBG-DR) fund, awarded in response to a summer 2024 flood, with the state seeking a qualified vendor to provide full-service administrative support for managing these federal disaster recovery funds.

1 Section 7.5.2 states that "Hourly rates should not include expenses. Expenses will be reimbursed at cost."

Section 2.4 states "The State will not pay Contractor's expenses as a separate item." Please confirm that GOED will adjust the resulting state standard contract terms to allow for reimbursing expenses at cost.

Answer: GOED will reimburse at cost direct expenses made pursuant to the contract, when such expenses are approved in advance by the agency.

Section 7.5.2 and Sample Terms (2.4)

2 Please confirm that in Section 7 Cost Proposal we can submit a table with multiple fixed hourly rates to correspond with the labor categories needed to do this work and that we do not need to include estimated level of effort or specific expenses at this time.

Answer: The Cost Proposal may include a table with multiple fixed hourly rates, but the Cost Proposal must also include vendor’s estimated time to complete the engagement in order to provide a responsive bid.

Section 7

3 Can resumes for Key Staff be submitted as an appendix/attachment to demonstrate the qualifications of the personnel proposed?

Answer: Resumes may be submitted in an appendix, but vendor’s response should discuss the proposed team’s qualifications and experience holistically before referring to the appendix for information on individual personnel.

Section 6.7

4 Will the State accept proposed exceptions to the RFP terms and conditions?

Answer: GOED will consider proposed exceptions, but reserves the right to reject any and all such proposals as part of its review process prior to awarding the winning bid.

Section 2.0

5 Will the State be willing to modify section 2.15 upon award to account for pre-existing IP from the Contractor?

Answer: GOED would consider the proposed modification, but reserves the right to reject it and/or require documentation evidencing vendor’s prior IP in conjunction with such a modification. Any IP developed or evolved during the contract term would remain subject to section 2.15.

Section 2.15

6 Please confirm Attachment E is not required during proposal submittal and can be provided after award.

Answer: Attachment E is a substantive part of GOED’s review of the vendor’s qualifications and ability to perform and must be provided at proposal submittal. Attachment E
