Dear Mr. Taylor:
I refer to request for Nationwide Permit (NWP) eligibility verification, first received in this office August 5, 2022 regarding the proposed FR 209-02 Red Run Structure Replacement Project. The project consists of replacing the existing deteriorating arch culvert to maintain recreational access along the Shavers Fork River. The site is located at the confluence of Red Run and Shavers Fork of the Cheat River in Monongahela National Forest-Greenbrier District in Randolph County, West Virginia (coordinates: 38.631456, -79.880432). The proposal describes removal of the existing culvert and construction of a new replacement bridge 75 feet upstream of the culvert.
The replacement bridge is a single-lane, prestressed concrete box beam bridge with concrete abutments. For bank stabilization of the replacement bridge, riprap will be laid along the banks of Red Run. The project is estimated to permanently impact 93 linear feet of Red Run to temporarily impact 52 linear stream feet. Erosion and sediment control will be in place, according to West Virginia best management practices.
Activities associated with projects of this type are authorized by Nationwide
Permit (NWP) No. 14, Linear Transportation Projects. This NWP was previously issued by the Corps of Engineers, for purposes of Section 404 of the Clean Water Act. The West Virginia Department of Environmental Protection (WVDEP) granted a general Section 401 Water Quality Certification (WQC), with conditions, for this NWP. These NWPs were published in the December 27, 2021, issue of the Federal Register. The NWP and WQC conditions can be found at:

This project has been verified to comply with all applicable regional conditions.
Adherence to these conditions will permit you to proceed with the proposed project.
Please note, the enclosed Compliance Certification Form must be signed and returned to this office upon completion of the proposed work.

The verification of this NWP is valid until March 14, 2026, unless the NWPs are modified, suspended, or revoked. If project specifications are changed or work has not been initiated before March 14, 2026, please contact this office for further verification, and refer to permit number LRP-2022-0309.
The verification of this NWP will not relieve you of the responsibility to obtain any other required state, local, or Federal authorizations.
