1. Justification for other than full and open competition:

To exercise a seven (7) year renewal option at the current location, Aquia II Commerce Center, 2723 Jefferson Davis Highway, Stafford, VA. The lease renewal will be for 26,415 ANSI/BOMA Office Area (ABOA) square feet.

2. Nature and/or description of the action being approved.

FBI CIRG (Critical Incident Response Group) currently occupies 26,415 ANSI/BOMA Office Area (ABOA) square feet or 30,377 rentable square feet (RSF) of office space under Lease Number GS-03B-80549. The lease term is December 15, 1999 through December 14, 2009. The lease has an unpriced seven year renewal option incorporated into it, however, the Lessor provided rental rates for the renewal on September 18, 2009. GSA has negotiated the rental rates with the Lessor.

The current lease was negotiated through GSA’s National Capital Region (NCR). After a review of their leases, NCR discovered that this lease currently resides in the Mid-Atlantic Region. The lease was officially transferred to Region 3 on March 1, 2009. Since that time, GSA has been working with FBI CIRG to finalize their future requirements for this lease. FBI CIRG finalized their requirements on June 11, 2009. The FBI CIRG requested to exercise the renewal option to continue continuity of their operations as well to maintain their close proximity to the adjoining building, which is also occupied by the same division. The adjoining building, Aquia I Commerce Center, 2721 Jefferson Davis Highway, Stafford, VA, expires January 20, 2011. FBI CIRG has submitted initial requirements for this location, which GSA is still finalizing with FBI CIRG.

At the same time, FBI CIRG submitted a program of requirements that requested the Lessor to verify if the current building met FBI current building standards as well as requesting the Lessor to make several security upgrades and standard alterations to the building that would be paid for through an RWA. GSA is working with FBI CIRG to finalize this alterations work. This work will be treated independently from the renewal option and a separate justification will be written for this work. The alterations project is estimated to be approximately <REDACTED>.

GSA will utilize the existing lease renewal option in the contract to maintain the occupancy of the current location.

3. Description of the supplies or services required.

GSA will exercise a seven year renewal option at the current location of Aquia II Commerce Center, 2723 Jefferson Davis Highway, Stafford, VA. The FBI CIRG occupies 26,415 ANSI/BOMA Office Area square feet or 30,377 rentable square feet of space at the above referenced location. The lease renewal will expire December 14, 2016. All other terms and conditions of the lease will apply including the ninety days notice to terminate the lease.

The lease renewal rate has been negotiated with the Lessor. The annual rental rate will be <REDACTED> for years 1 through 3 and <REDACTED> for years 4 through 7. The rate per rentable square foot is <REDACTED> for years 1 through 3 and <REDACTED> for years 4 through 7. The total contract value is <REDACTED>.

4. Identification of the statutory authority

· 41 U.S.C. 253 (c) (1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires use of the authority cited.

At this time, there are no buildings in the Stafford County area that can meet the agency’s square footage requirements of 26,415 ABOA/ 30,377 RSF. In addition, the FBI CIRG must be co-located with the adjacent facility at Aquia I Commerce Center, 2721 Jefferson Davis Highway, Stafford, VA.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable

An advertisement was placed on fedbizzopps on October 13, 2009. The ad was posted for one week. Two inquiries were made. <REDACTED> A survey was conducted on Co-Star for available space in Stafford County. Information regarding this survey is in the attached “Market Analysis”.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The rental rate was found to be fair and reasonable as described in the attached procurement sensitive document, “Market Analysis”.

8. Description of the market research conducted

A market survey was not conducted, however, GSA was able to utilize co-star to conduct a telephone market survey to obtain the rates of comparable office buildings in the Stafford market. This information as well as the cost benefit analysis can be found in the attached document “Market Analysis”.

9. Other facts supporting the use of other than full and open competition

Since the lease was transferred to GSA Region 3 on March 1, 2009, GSA had a very short amount of time to work with the agency on future requirements. FBI CIRG requested to utilize an existing renewal in the contract to continue the agency’s operations. In order to continue the lease contract and avoid a holdover or potentially expensive lease extension, GSA proceeded to work with the existing renewal option in the lease contract.

In addition, GSA completed a cost benefit analysis and demonstrated that the agency would save a significant amount of money by staying in place. The cost benefit analysis is attached.
