PART 1 GENERAL

1.1 GEOTECHNICAL DATA

This Document is made available for Bidders' convenience and information.

This Document and its attachments are not part of the Contract Documents.

Because subsurface conditions indicated by the soil borings are a sampling in relation to the entire construction area, and for other reasons, the Owner, the Architect, the Architect's consultants, and the firm reporting the subsurface conditions do not warranty the conditions below the depths of the borings or that the strata logged from the borings are necessarily typical of the entire site. Any party using the information described in the soil borings and geotechnical report shall accept full responsibility for its use.

SECTION 01 11 00

SUMMARY OF WORK

PART 1 GENERAL

1.1 SUBMITTALS

Government approval is required for submittals with a "G" or "S" classification. Submittals not having a "G" or "S" classification are for information only. When used, a code following the "G" classification identifies the office that will review the submittal for the Government.

Submit the following in accordance with Section 01 33 00 SUBMITTAL

PROCEDURES:

1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 Project Description

The Work will construct a new two story, 124,730 square foot (maximum), 21st Century Unit School. The school will have a design population of 448 students and is programmed to provide 21st century learning studios for the pre-K through 12th grade students with a staffing authorization of 61.

Program requirements are based upon the authorized Program for Design (PFD) dated September 23, 2016 and the DoDEA 21st Century Educational Specifications (V5.0) for Elementary, Middle and High schools.

The project site improvements will include a 1,976 SF (approx.) field house, vehicle, and pedestrian circulation with 124 car parking spaces and 11 school bus parking spaces. Athletic improvements will consist of a sports field complex with a 6-lane track, a soccer field, softball field, as well as competition and practice areas for the long jump, discus, and shot-put field events. Outdoor play area improvements will consist of two paved hard surface courts, a play lot, two playgrounds and open turf play areas in accordance with the DoDEA Educational Specifications. Additional improvements include but are not limited to signage, fencing, landscaping, exterior lighting, and utilities.

The Work will require the demolition of the existing Ramey Unit School (approximately 20 structures and associated infrastructure plus site features.) for a total of 122,792 square feet. Demolition also includes removal of the salvage material and equipment to be reused by the owner.

All environmental remediation/abatement required prior to demolition shall be included in the Work. Additionally, the facility will require testing for Cadmium, Chromium and Chlordane prior to the demolition to assess the need for any remediation of these materials. The contractor will test for cadmium and chromium on the protective coatings on structural steel, tanks, piping, and other metal building components. Coating samples will be scrapped to represent each type of metal coating present, for a total of approximately 100 samples prior to demolition or otherwise removal of the metal components. Use laboratories that are fully accredited by the EPA NLLAP. Local applicable regulations shall be observed concerning threshold concentrations for handling and disposal of metal components.

The contractor will test for chlordane and other pesticides in the soil under the slab. Drive sample borings will be collected prior to slab demolition in a grid pattern, each to represent approximately 3,000 square

SECTION 01 11 00 Page 1 feet of slab, for a total of approximately 50 samples. Use laboratories that are fully accredited by the EPA NLLAP and rated proficient in the National Institute for Occupational Safety and Health. Local applicable regulations shall be observed concerning disposal of soils exceeding threshold concentrations. All hazardous wastes generated from the demolition activities of the existing school will be transported off property through a permitted contractor for disposal in an off-property landfill. All contractor personnel should adhere to the present AHERA report guidelines for tracking and reporting requirements.

The existing school will remain in operation during construction of the new school and shall be separated from the construction site by a temporary perimeter fencing. A temporary Entry Control Point will also be constructed to maintain access control to the existing school during construction. Work also includes relocation of the temporary Entry Control Point and associated infrastructure to the permanent position at the end of the new school construction. These temporary construction features are included in the Work.

Facilities will be constructed in accordance with ABA Accessibility Standard for Department of Defense Facilities, National Fire Protection Association (NFPA) Life Safety Code, and Standards of Seismic Safety for Federally Owned Buildings, International Building Codes, applicable Unified Facilities Criteria and energy and water conservation standards.

The work shall include certification of the facility to a silver level in accordance with Leadership in Energy and Environmental Design (LEED) 2009 for Schools criteria.

The work shall be constructed in the following phases as outlined below and on the contract documents.

Phase One - Construction Prep: construct / prepare temporary access control points and associated infrastructure, construct temporary perimeter barrier / construction fencing/construct temporary parking areas and temporary access roads.

Phase Two - School Construction: construct of the new school building and associated infrastructure and site improvements south of the temporary barrier.

Phase Three - Demolition: Perform remediation and abatement of hazardous materials and perform additional testing for Cadmium, Chromium and Chlordane prior to the demolition to assess the need for any remediation of these materials. Demolish existing unit school and associated infrastructure and site features, temporary access road, temporary access control points and associated infrastructure and site improvements.

Phase Four - North Site work: construct site improvements north of temporary barrier.

Construction milestones for the phasing of the project shall be as indicated in the Construction Milestones Schedule included in this section.

Utilities on the installation are mostly public. The Puerto Rico Aqueduct and Sewer Authority (PRASA) is the provider of water and sanitary services.

LUMA is the new provider of electrical power, thus references to PREPA throughout the contract documents refer to LUMA. The Puerto Rico

Telecommunications Board (PRTCB) is the provider of telecommunications services. Natural gas is not available on the site.

The Contractor shall be responsible for the coordination / oversight and payment for all work associated with and provided by private utility providers.

The Contractor shall be responsible for obtaining all necessary permits required to construct this project and pay all permit fees. This includes, but is not limited to construction stormwater registration with the United States Environmental Protection Agency (USEPA) and in accordance with the local Puerto Rico Planning Board, PREPA (electrical), JRTPR (telecommunications), and any other required permits as needed to complete the work. All permits must be in hand prior to construction.

The gravity framing system consists of conventionally reinforced load bearing walls and columns. Horizontal construction will be comprised of reinforced concrete slab on gravel capillary water barrier on compacted grade and floor and roof framing consisting of one-way concrete pan joists spanning between concrete beams supported on the walls and columns. Large spans at the gymnasium, performance space, and music room and information center are conventional slab and deep beam construction supported on walls and columns. The high roof at the commons area is a conventionally reinforced two-way flat slab with drop plates supported on conventionally reinforced concrete columns. Foundations are conventional shallow foundation system consisting of strip footings beneath load bearing walls and simple pad footings under columns. The foundations are expected bear on weathered limestone. The structure is required to meet wind, seismic and blast loading.

Exterior walls receive various treatments of the structural concrete walls including the use of smooth forming, form liners and formed reveals.

Finishes of the exterior walls consists of direct applied textured finish on smooth formed walls and integral color at walls with form liner and formed reveals. All exterior walls have a minimum 1" thick coating of closed cell spray applied insulation on the interior surface.

Exterior fenestration consists of aluminum glazed curtainwall assemblies with energy efficient, laminated insulated glazing/spandrel panels.

Exterior entrances will consist of aluminum-glazed entrance systems integrated into the curtainwall or hollow metal doors and frames as indicated in the contract documents. Exterior fenestration is required to meet wind, seismic and blast loading.

Roof construction consists of a 3-ply modified bituminous roofing system installed over lightweight insulating concrete system with a minimum continuous R-value of R-20. Roof drainage is a combination of external integral concrete gutters with aluminum tube downspouts and internal roof drains. All roof drainage is connected to the underground storm system.

Interior spaces in the facility include learning studios, learning hubs, staff collaboration areas, one-to-one and group learning spaces, computing center, art studio, music studio, science and STEM learning spaces, commons, performance space, gymnasium and support spaces, kitchen and serving area with support spaces, administrative offices, guidance and special education support spaces, central storage and maintenance support spaces, restrooms, mechanical rooms, electrical rooms, telecom rooms, custodial rooms and other required areas for a fully functioning unit school.

Interior construction consists of a combination of cast in place concrete

SECTION 01 11 00 Page 3 walls, metal stud and gypsum board partitions and glazed and opaque operable wall systems. Interior fenestration will consist of aluminum-glazed storefront windows and entrances and hollow metal frames with solid core wood or metal doors. Windows and glazed doors into normally occupied spaces will be required to meet a 1-minute time of delay in accordance with ASTM F1233-08.

Interior wall finishes for most spaces consist of low VOC paint with high impact wall treatment in high traffic areas. Corner guards protect exposed gypsum board walls. Interior floor finishes consist of resilient flooring in most educational spaces, Terrazzo in high traffic areas, ceramic or porcelain tile in restroom and food service locations and epoxy paint in service locations. The gymnasium floor will be a high-performance rubber sports floor.

Interior ceilings are primarily suspended lay-in acoustical ceilings or clouds with gypsum board on metal studs in select locations. The performance space ceiling consists of suspended concave reflective acoustical panels below exposed concrete structure. Areas of exposed structure exposed to view are dry-fall painted.

Built-in casework is plastic laminate on phenolic board construction.

Countertops are solid surface countertops at all locations except science labs, which will receive epoxy resin counters with integral sinks.

Other miscellaneous built in items include but are not limited to signage, dry erase marker boards, tack boards, fire extinguisher cabinets and brackets, roller shades, roof access hatches and ladders, cubicle curtains and tracks, vented athletic lockers, metal storage lockers, gym divider curtain, electronic scoreboards, motor operated basketball backstops and locker room benches.

Lighting in the facility is with LED energy efficient light fixtures including recessed, lay-in, surface mounted and pendant-hung fixtures.

Fire protection in the facility includes an automatic, wet pipe sprinkler system with a diesel engine driven fire pump and water storage tank. An intelligent, addressable fire alarm and mass notification system is included in the work.

Support buildings included in the work are a conventionally constructed field house and one pre-engineered, prefabricated guardhouse and one pre-engineered, prefabricated guard booth. Since the school is located on a site with its own controlled perimeter fence and required to meet a Low Level of Protection (LLOP), both Explosive Weight I (EW-I) and Explosive Weight II (EW-II) was considered for the blast design of these structures.

Access control points include motor operated drop arms and motor operated sliding security gates.

The project includes related infrastructure such as site and traffic signage, fencing (chain-link and architectural), paving (driveways, parking, sidewalks & hardscape), landscaping, covered walkways (canopies), mechanical and dumpster enclosures, emergency generator, photo-voltaic solar array, exterior lighting, utilities, playgrounds, play lots and storm water management areas.

The facility is designed to meet LEED Silver Certification in accordance with the LEED for School 2009 rating system.

1.2.2 Location

The site is bounded by West Parade Road to the East, Crown Road to the North and West, and Ing. Orlando Alarcon Avenue to the South. The existing site is currently developed with multiple school buildings, ancillary support buildings, multiple parking lots, playgrounds, a basketball court, and a softball field.

1.3 OCCUPANCY OF PREMISES

Building(s) will be occupied during performance of work under this Contract. Occupancy notifications will be posted in a prominent location in the work area.

Before work is started, arrange with the Contracting Officer a sequence of procedure, means of access, space for storage of materials and equipment, and use of approaches, corridors, and stairways.

1.4 EXISTING WORK

In addition to FAR 52.236-9 Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.

1.5 LOCATION OF UNDERGROUND UTILITIES

Obtain digging permits prior to start of excavation. Contact the Centro de Coordination de Excavations y Demolitions with the Public Service Commission at minimum 2 weeks ahead of scheduled work. Local Utilities are given 48 hours' notice to mark their asset before start of construction.

If utility company fail to mark asset. Contractor is responsible for scanning the construction site with electromagnetic or sonic equipment, and mark the surface of the ground, where existing underground utilities are discovered. Verify the elevations of existing piping, utilities, and any type of underground or encased obstruction not indicated to be specified or removed but indicated or discovered during scanning in locations to be traversed by piping, ducts, and other work to be conducted or installed. Verify elevations before installing new work closer than nearest manhole or other structure at which an adjustment in grade can be made. Notify the Contracting Officer at least 15 days prior to starting excavation work.

1.3 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK

Refer to FAR 52.211-10 "Commencement, Prosecution, and Completion of Work" in Section 00 70 00 for a notification of significant contract dates.

1.3.1 Additional Requirements/Clarifications of Work Included Within the Contract

a. The time stated in FAR 52.211-10 "Commencement, Prosecution, and Completion of Work" in Section 00700 for completion shall include installation of Government-furnished furniture as well as as-built drawings, O&M manuals, operational tests/reports/training/instructions, equipment lists.

b. Those areas of the building receiving Government-furnished furniture and IT/Telecom equipment shall be made available for Government installation to begin no less than 60 calendar days prior to the contractor's accepted scheduled Construction Completion Date updated in accordance with FAR 52.211-10 "Commencement, Prosecution, and Completion of Work" in Section 00700. The Contractor shall participate in a Furniture Pre-Installation Building Inspection, Daily Furniture Installation Building Inspections, and a Final Furniture Installation Building Inspection along with the furniture installation supervisor and a Government representative.

c. If the Contractor fails to meet the Requirements for Completion of Designated Areas Prior to Furniture Installation, specified in Paragraph 1.3.2, by the Contractor's accepted scheduled Furniture Installation Start Date, the Contractor shall pay liquidated damages to the Government in the amount of $1,115 for calendar day of the delay until the requirement is fulfilled. The liquidated damages contained in this paragraph are independent of and in addition to those references in FAR 52.211-12 "Liquidated Damages - Construction".

Changes to the Contractor's Scheduled Furniture Installation Start Date and Construction Completion Date must be received and accepted no later than 49 calendar days prior to the Contractor's current Scheduled Furniture Installation Start Date in order to avoid liquidated damages associated with the furniture installation.

Commencement of furniture installation on or after the Contractor's scheduled Furniture Installation Start Date prior to the fulfillment of these requirements do not relieve the Contractor of their liquidated damages obligation.

1.3.2 Requirements for Completion of Designated Areas Prior to Furniture Installation

The Contractor is responsible for access to the building, security and ownership during the furniture and IT/Telecom equipment installation.

Facility operation and maintenance during the furniture and IT/Telecom equipment installation is the responsibility of the Contractor.

The Government will be installing IT/Telecom equipment, including the telephone switch and individual telephone sets, during the furniture installation period.

The Contractor shall be responsible for coordination with its subcontractors and the Government furniture and IT/Telecom installation contractors, as necessary, to accommodate the furniture and IT/Telecom equipment installation.

The exterior roads, parking areas, walks, and building entrances shall be sufficiently complete to support the delivery of furniture products by semi-tractor trailers and made available for use to the Government furniture and IT/Telecom installation contractors.

All interior building finishes of areas receiving furniture, including all furniture entries, pathways, staging, and storage areas shall be complete.

Completed building finishes shall include all flooring materials and base, interior walls, ceilings, lighting, HVAC systems and controls, doors, doorframes, and trim. All areas are to be cleaned, vacuumed, and an initial waxing applied as appropriate for the installation of furniture.

All utilities and systems serving the building shall be fully operational.

The HVAC system(s) must be in operation, fully balanced and commissioned.

The elevator(s) shall be operable and certified for use by the approving agency prior to the delivery of the furniture package and must be made available, at no additional cost, for use by the furniture and IT/Telecom equipment installation contractors.

The pre-final building punch inspections shall be performed and punch list items corrected by the Contractor prior to the Government Furniture and IT/Telecom installations.

During installation of the furniture and IT/Telecom, the Contractor shall participate in inspections as noted above in paragraph "Additional Requirements/Clarifications of Work Included Within the Contract"(b).

Repairs to any damaged areas shall be performed at no additional cost to the Government by the appropriate party as determined by the Government during these inspections.

The Contractor shall be responsible for the electrical hookup of the power feed(s) and phone/data wiring to-as well as providing all data/com faceplates and jacks for-all powered modular systems furniture. This work may be coordinated with the Government Furniture and IT/Telecom installation contractors to occur while they continue their installations.

The Contractor shall perform the final buffing and waxing of areas after the furniture and IT/Telecom installation contractors have indicated either installation in those areas is complete or that the final buffing and waxing should be performed in certain areas prior to the placement of furniture. The final buffing and waxing of corridors shall be performed by the Contractor after the furniture and IT/Telecom installation contractors

SECTION 01 14 00 Page 3 have indicated installation is complete for the building.

After furniture and IT/Telecom installation by the Government, the Contractor shall perform a complete final cleaning in all impacted areas.

Final Inspection and Acceptance may occur only after all furniture and IT/Telecom installation by the Government is complete.

1.4 CONTRACTOR ACCESS AND USE OF PREMISES

1.4.1 Activity Regulations

Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear personal protective equipment in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. All Contractors must conspicuously mark equipment and establish color codes for safety vests, t-shirts, and long sleeve shirts used for all Contractor and Sub-Contractor personnel in the field for easy identification. To minimize traffic congestion, delivery of materials shall be outside of peak traffic hours (6:30 to 8:00 a.m. and 1:30 to 3:00 p.m.) unless otherwise approved by the Contracting Officer.

1.4.1.1 Subcontractors and Personnel Contacts

Five (5) working days prior to commencement of work, provide a list of contact personnel list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.4.1.2 Site and Building Security and Vehicle Identification a..Provide security for the areas within the contract limits. When the Government takes possession of certain areas, provide security for areas remaining under Contractor control.

b. Wherever there are fence disruptions due to the construction of this project, continually monitor and maintain the fence.

c. Furnish an identification to each employee in accordance with paragraph titled IDENTIFICATION OF EMPLOYEES AND ACCESS PROCEDURES.

d. Require each employee engaged on the work to display such identification as may be approved and directed by the Contracting Officer. Immediately deliver all prescribed identification to the Contracting Officer for cancellation upon release of any employees.

When required by the Contracting Officer, obtain and submit fingerprints of all persons employed or to be employed on the project.

e. Contractors/Subcontractors and their employees requiring access to the installation will be required to comply with the installation access control policy/procedures. The Government will not be responsible for damages due to delay/stoppages caused by failure to comply.

f. All vehicles and personnel are subject to search and seizure of contraband and/or unauthorized Government property. Contractor vehicles (Contractor-owned and personal), Contractor personnel, and their personal property shall be subject to searches upon entering of

SECTION 01 14 00 Page 4 leaving the installation. The search and to seizure provisions of AR 190-22 shall apply to Contractor personnel entering or leaving the facilities.

1.4.1.3 No Smoking Policy

Smoking is prohibited within and outside of all buildings except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.

1.4.2 Working Hours

Regular working hours are to begin no earlier than 0700 hours and end no later than 1700 hours, Monday through Friday, excluding Government holidays. Government holidays are not regular work hours/days.

1.4.3 Work Outside Regular Hours

Work outside regular working hours and days requires Contracting Officer approval. Submit application, in writing, 15 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work shall be lighted in a manner approved by the Contracting Officer. Make utility cutovers after normal working hours or on Saturdays, Sundays, and Government holidays unless directed otherwise in coordination with DoDEA personnel and in accordance with DoDEA requirements (permits, plans, etc.).

1.4.4 Conduct and Dress

The Contractor and his subcontractors are firmly reminded that this is a school in a family housing area with younger children nearby.

Inappropriate attire including slogans, imagery and the like with regard to their content and appearance will not be tolerated.

Additionally, Contractor language and actions that are inappropriate around families with children will likewise not be tolerated and individuals that are noted in violation or have complaints filed against them will be removed from the premises with no adjustment of time, compensation or other accommodations to the contractor and/or his subcontractors.

1.4.5 Utility Cutovers and Interruptions

a. Make utility cutovers after normal working hours or on Saturdays, Sundays, and Government holidays. Conform to procedures required in the paragraph "WORK OUTSIDE REGULAR HOURS".

b. All utility cutovers and interruptions must be coordinated with DoDEA personnel. Submit application to the Contracting Officer, in writing, 30 calendar days in advance before initiate the work related to this activity. If DoDEA requires to follow specific format or additional information to the required notification, it shall be submitted as per their guidance as an enclosure to the written notification to the

Contracting Officer.

c. Ensure that new utility lines are complete, except for the connection, before interrupting existing service.

d. Interruption to water, sanitary sewer, storm sewer, telephone service, electric service, air conditioning, heating, fire alarm and chill water shall be considered utility cutovers pursuant to the paragraph entitled "WORK OUTSIDE REGULAR HOURS". Such interruption shall be further limited to nonwork/school hours. This time limit includes time for deactivation and reactivation.

e. Operation of Station Utilities: Do not operate nor disturb the setting of control devices in the station utilities system, including water, sewer, electrical, and steam services. The Government will operate the control devices as required for normal conduct of the work. Notify the Contracting Officer giving reasonable advance notice when such operation is required.

1.4.6 Working Conditions

a. Open trenches or road restrictions will not be permitted without the approval of the Contracting Officer.

b. Access ways shall be fully usable.

c. All cost for conformance with the above stated requirements must be included with the job contract amount and no claim for extra cost will be considered.

1.5 SECURITY REQUIREMENTS

1.5.1 Installation Access

Contractor employees, including subcontractors, must comply with applicable Installation and facility access security policies and procedures, including FAR clause 52.204-2, Security Requirements and Alternate II.

1.6 IDENTIFICATION OF EMPLOYEES AND ACCESS PROCEDURES

Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress.

Identification badge will be required at all times to contractor and sub-contractor' personnel. Wear personal protective equipment in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. The Contractor's equipment shall be conspicuously marked for identification.

1.7 NO ASBESTOS - CONTAINING MATERIAL (ACM) CERTIFICATION

1.7.1 Construction Phase

Before final payment to the Contractor, the Contractor's project engineer/manager will sign and submit to the Government, on the contracting firm's letterhead, a dated ACM Certification containing the

I hereby certify that to the best of my knowledge no asbestos-containing material (ACM) was used as a building material during this project.

I understand that the building owner presumes that all materials marked "May Contain mineral fibers" are considered asbestos unless I either:

a. Have on file and have submitted to the Government the manufacturer's certification that the material does not contain asbestos, or

b. Have supplied to the Government documentation to show that the material has been microscopically examined by an AIHA- or NVLAP-certified laboratory and the lab has determined that it does not contain asbestos.

1.8 LABOR LAWS

a. The Davis-Bacon is not applicable to contract work performed in the Commonwealth of Puerto Rico or the U.S. Virgin Islands and the Service Contract has been held not to apply to construction contracts.

b. If a DOL wage determination is included in this contract, the Contractor shall pay not less than the wages and fringe benefits specified in the wage determination.

c. In accordance with the Permits and Responsibilities clause of this contract, the Contractor shall be responsible for complying with any local labor laws, codes and regulations that apply to the work performed under this contract.

d. If work under this contract is performed in the Commonwealth of Puerto Rico, the Contractor is advised to consult with the Commonwealth's Department of Labor for the purpose of reviewing applicable labor laws which may contain specific rules for computing overtime and the amount of overtime pay laborers and mechanics must be paid. Any such applicable local labor law imposing stricter overtime rules than those contained in the Contract Work Hours and Safety Standards Act - Overtime Compensation clause of this contract (i.e. provides greater benefits to laborers and mechanics) may apply in lieu of the rules contained in that clause.

e. If this contract is a NAFI contract and includes DA form 4075-R the clauses that relate to the implementation of the Davis-Bacon Act (e.g., I-22, I-23, I-37, I-38, I-59, I-60, I-63, I-64, I-65 and I-66) are hereby deleted from the form and the contract.

1.9 INTERFERENCE WITH TRAFFIC AND PUBLIC AND PRIVATE PROPERTY

a. At all times, dispose plant and conduct the work in such manner as to cause as little interference as possible with private and public travel. Damage (other than that resulting from normal wear and tear) to roads, shall be repaired to as good a condition as they were prior to the beginning of work and to the satisfaction of the Contracting Officer.

b. Provide and maintain as may be required by the Commonwealth of Puerto

Rico, Department of Transportation. Provide proper barricades, fences, danger signals and lights, a sufficient number of watchmen, and take such other precautions may be necessary to protect life, property and structures, and be liable for and hold the Government free and harmless from all damages occasioned in any way by his/her act or neglect, or that of his agents, employees, or workmen.

c. Contractor personnel shall park only in areas authorized by the Contracting Officer.

1.10 NOTICE OF FEDERAL, STATE AND LOCAL TAXES - CONTRACTS PERFORMED IN

PUERTO RICO

This contract includes one of the following clauses: FAR 52.229-3 (48 CFR 52.229-3, Federal, State and Local Taxes; FAR 52.229-4 (48 CFR 52.229-4) - Federal, State and Local Taxes (Noncompetitive Contract); or FAR 52.212-4 (48 CFR 52.212-4) - Contract Terms and Conditions - Commercial Items.

These clauses place responsibility for taxes on the Contractor. Offerors are hereby strongly advised to check with the various Puerto Rican taxing authorities to determine which, if any, local taxes they will have to pay.

The Government is aware that each municipality in Puerto Rico has the authority to assess a tax on Government contractors working within the municipality. The tax rate varies from municipality to municipality. The tax rate is believed to be about 1.5% to 5% the value of the contract.

Additionally, the Government is aware that the Commonwealth imposes a tax on equipment brought onto the island. In some cases, the Commonwealth may waive this tax upon receipt of a letter from the Government verifying that the equipment will be used on a Government contract and will be removed from the island upon completion of the contract. For this project, the Government will not provide or issue tax waiver letters. This notice is intended to advise offerors that local taxes may be imposed. The two examples cited are not intended to be a comprehensive list - they are merely examples. Questions concerning taxes must be directed to Puerto Rico taxing authorities. The Government does not have the ability to answer question regarding local taxes.

MUNICIPAL TAX: Pursuant municipality local regulations and taxes may apply with each award of the base and options under this contract. See Paragraph 999.229-1 in this solicitation. The contract price will be adjusted to compensate the Contractor for the amount of construction taxes. No mark-ups will be allowed in this line item. The Contractor will be paid on the basis of proof of payment from the appropriate Commonwealth of Puerto Rico or Municipal authorities.

1.11 LABOR, EQUIPMENT, AND MATERIAL REPORT

Submit a daily report of all Contractor-owned or rented equipment at the jobsite. A similar report is required for all subcontractor equipment.

The subcontractor's report may be separate or included with the Contractor's report provided the equipment is adequately identified as to ownership. The required equipment report shall include each item of equipment (hand-operated small tools or equipment excluded) on the job and shall specifically identify each item as to whether it is Contractor-owned or rented, shifts, hours of usage, down time for repairs, and standby time. Identification of the equipment shall include make, model and plant number of all items. Separate identification by a key sheet providing these data may be utilized with the daily report indicating the type of equipment and the equipment plant numbers. The format of the daily equipment report will be as approved by the Government in the field.

Labor, Equipment, and Material Report for Extra Work/Cost. A Report shall also be submitted by the Contractor listing any labor, equipment and materials expended on and/or impacted by any change order directed by the Government and for which total price/time agreement has not been reached.

These requirements also apply to subcontractors at any tier. The same Report is required at any time the Contractor claims or intends to claim for extra costs whether or not there is Government recognition (constructive changes). This requirement is in addition to any Contractor "Notice" or "Reservation of Rights".
