B.1 PRICE SCHEDULE

(a) Offers will be considered for award on the following Price Schedule, but no offer will be considered for award on only a part of the Price Schedule.

(b) Offers are subject to the terms and conditions of this solicitation.

(c) Price Schedule – Consist of both lump sum and estimated quantities. Estimated quantity line items (2, 3, 4 and 5) will be used for measurement and payment for those items. See the appropriate measurement and payment sections of the specification. The estimated quantity line items shall be paid in accordance with FAR Clause 52.211-18 Variation in Estimated Quantities.

(e) Definitions:

(1) CLIN – Contract Line Item Number.

SECTION 31 02 30

DUST PALLIATIVE

PART 1 GENERAL

1.01 MEASUREMENT AND PAYMENT

A. Dust Palliative Application:

1. Measurement: The quantities of dust palliative treatment will be measured on the area basis, measured along the lines and grades of the area actually treated.

a. Approximate extents of treatment are as shown in the Project drawings - length of road to be treated with dust palliative is 3.75 Miles (See Sheet 3 of 4 & 4 of 4).

2. Payment: Square yard price offered in the schedule

B. Dust Palliative Material

1. Measurement: The quantities of dust palliative treatment material measured on the dry weight basis. Packaged materials will be accepted at the net weight shown by the manufacturer, subject to periodic verification and approval. Provide a certificate with each shipment together with a certified copy of the weight of each delivery. Measurement of stabilizing material will not include any, which is lost, displaced, used in reworking, used in restoration work or used contrary to direction.

2. Payment: Ton price offered in the schedule

C. Payment for bid items will be in full for furnishing and placing all materials and furnishing all equipment, labor, and incidentals necessary to complete the work specified. No separate or additional payment will be made for any other item incidental to the work required.

1.02 SUBMITTALS

A. Submit the following in accordance with Section 01 33 00 - Submittals

1. Dust Palliative furnished meets specified chemical, physical, and manufacturing requirements

PART 2 PRODUCTS

2.01 MAGNESIUM CHLORIDE

A. The contractor shall use dust palliative equivalent to “Dust-Off” road treatment, no substitutes.

B. The following salient characteristics will be used to determine if other than the brand name are equal to the item that meets USBR requirements:

1. Material meets US EPA and relevant state requirements for soil stabilizers.

2. Magnesium Chloride content (25 to 35%),

3. Sulfate Content as magnesium sulfate (4% max),

4. Potassium content as potassium chloride (0.5%),

5. pH with 5% solution (7.0 to 9.0),

6. Specific Gravity (1.29 to 1.33),

7. Dust Palliative must be miscible in water.

PART 3 EXECUTION

3.01 PREPARATION

A. Road surface preparation:

1. Shape and grade road surface.

2. Loosen roadway surface with rock rake or blade grader to depth of 1 to 2 inches.

3. Provide a minimum of two (4,000 gal) water trucks to moisture condition surface until visibly wet.

4. In areas without surfacing materials: Do not disturb subgrade, moisten only.

3.02 APPLICATION

A. Equipment: Designed for uniform application on variable widths at predetermined rates.

B. Location: Dust palliative shall be applied on the gravel roads to be used for hauling and the roads to be repaired (see map or sheet 3 of 4).

C. Time:

1. Not during rain.

2. Not if rain is anticipated within four hours following treatment.

3. Do not apply to frozen ground.

D. Application rate: 0.5 gallons per square yard or as required by product label.

1. If material runs off during application, make repeated passes at lesser rates.

E. Compaction: By equipment travel.

1. Keep traffic off treated surface until dust palliative has penetrated and cured enough to prevent excessive pickup under traffic.

SUMMARY OF WORK
A. The roads to be improved are located in the Tule Lake Lease Lands, approximately 5 miles south of the town of Tulelake, California in Siskiyou and Modoc Counties.
A. Apply “Dust Off” or equivalent dust palliative to specific haul roads to minimize dust. Using a water trucks at all times, apply water for dust control on roads used that did not receive dust palliative.
B. Prepare and grade existing roads prior to placing base and aggregate.
C. Haul government supplied base and aggregate rock to the Tule Lake Lease Land roads.
D. Place and compact base and aggregate per the locations and thicknesses specified.
E. Perform final grading of roads.
A. Requirements in Division 1, General Requirements, apply to Divisions 2 through 53.
B. Imperative statements in these specifications are Contractor requirements, unless otherwise stated.
A. When the specifications use a word or term defined in the Federal Acquisition Regulations (FAR), the definition of the word or term shall be in accordance with FAR sections in effect at the time this solicitation was issued.

A. Where shown on drawings, government land may be used for required construction facilities.
B. When private land is used for construction facilities or other construction purposes, make necessary arrangements associated with use of private land.
C. Location, construction, operation, maintenance, and removal of construction facilities on Government land will be subject to approval of the COR.
D. Do not interfere with work of other contractors or the Government in vicinity, or with reservations made by the Government for use of such land.
E. During the months of September and October, trucks use the Tule Lake Lease Land roads to haul harvested produce. Access to roads for hauling and repair under this contract will be limited during these months. The contractor must receive Government ...
F. The contractor shall observe the following speed limits when operating vehicles in the Tule Lake Lease Lands:
1. 35 mph for gravel roads,

2. Prepare schedule based on required sequence and interdependence of activities.

A. Submit only checked submittals. Submittals without evidence of Contractor's approval will be returned for resubmission.
B. Submit complete sets of required materials for each RSN as specified in “Submittals Required” column in Table 01 33 00A - List of Submittals. A complete set includes all listed items for RSNs with multiple parts.
C. Submit number of sets specified in “No. of sets to be sent to:” columns in Table 01 33 00A - List of Submittals.
D. Include the following information in transmittal letters:
1. Contract number and title.
2. RSN for each attached submittal.
3. Responsible code.
4. Number of sets for each RSN.
5. Identify submittal as initial or resubmittal.
E. Resubmittal of submittals not approved:
1. Mark changes such that they are readily identifiable and show revision date.
2. Describe reasons for significant changes in transmittal letter.
3. Resubmit returned submittals within 14 days after receiving the comments, unless otherwise directed.
4. Requirements for initial submittals apply to resubmittals.
F. More than one RSN may be submitted under a transmittal letter, provided the responsible code is the same.
A. Time Required:
1. Submittal review will require 14 days for review of each submittal or resubmittal, unless otherwise specified.
2. Time required for review of each submittal or resubmittal begins when complete sets of materials required for a particular RSN are received and extends through return mailing postmark date.
B. Time in Excess of Specified:
1. The CO may extend the contract completion date to allow additional time for completing work affected by excess review time.
a. The time extension will be to the extent that excess review time caused delay to the contract completion date.
b. The time extension will not exceed the time used in excess of the specified number of days for review of submittals or resubmittals.
c. Concurrent days of excess review time resulting from review of two or more separate submittals or resubmittals will be counted only once in extending the contract completion date.
2. No time extension will be allowed if the Contractor fails to make complete action submittals in sequence and within time periods specified.
3. Adjustment for delay will be made only to the extent that:
a. Approval was required under the contract, and
b. Requests for approval were properly and timely submitted and were approved.
4. Adjustment will be subject to terms of paragraphs (b) and (c) of the clause at FAR 52.242-14, Suspension of Work, however, no such delay shall be deemed to be a “suspension order” as the term is used in that clause.
C. Return of Submittals:
1. Action Submittals: One set of submittals required for action will be returned either approved, approved subject to identified changes, or not approved.
a. Revise and resubmit submittals not approved.
b. Do not change designs without approval of the CO after drawings, documentation, and technical data have been approved.
2. Informational Submittals: The Government will acknowledge Informational submittals.
a. Informational submittals will not be returned when they comply with the specifications.
b. Informational submittals that do not comply with the specifications may be returned for resubmittal or additional information may be requested.

7. A generic Company Safety Plan is not acceptable. The Safety Program shall be site specific for this contract.
C. RSN 01 35 20-2, Monthly accident summary report:
1. Form 7-2218 or other acceptable form in accordance with paragraph 3.8 of RSHS.
A. Comply with RSHS and any Federal, State, and Local regulations that apply.
B. Do not require anyone employed in performance of the contract (including subcontractor) to work under conditions which are unsanitary, hazardous, or dangerous to the employee’s health or safety.
C. Under no circumstances will onsite work, including mobilization, be permitted until the Safety Program has been considered acceptable by the COR.
D. Fully participate in a Contractor Safety Program Review meeting, according to RSHS Section 3.4.1, prior to mobilization. Include subcontractor management representatives.
E. Develop Job Hazard Analyses for each distinct phase of work under the contract.
1. Work will not begin on the phase of work until a JHA is acceptable to COR.
2. Activities involving hazardous materials shall have the appropriate Material Safety Data Sheet(s) attached to the JHA.
F. In addition to requirements in the clause entitled “Accident Prevention”, fully comply with RSHS.

The errata apply to work under this contract.
G. Be cognizant of and ensure compliance with requirements set forth in paragraphs above.
1. Contractor’s responsibility applies to all operations, including those of the Contractor’s Subcontractors.
2. When violations of safety and health requirements contained in these specifications or referenced standards are called to the Contractor’s attention by the CO or COR immediately correct the condition to which attention has been directed.
3. Either oral or written notice shall be deemed sufficient.
H. When the Contractor fails or refuses to promptly correct a compliance directive, the CO or COR may issue an order to stop all or any part of the work.
1. When satisfactory corrective action is taken, an order to resume work will be issued.
2. The Contractor shall not be entitled to extension of time, or to claim for damage or to additional compensation by reason of either the directive or the stop order.
3. Failure of the CO or COR to order discontinuance of any or all of the Contractor’s operations shall not relieve the Contractor of the responsibility for the safety of personnel and property.

K. Provide and maintain a work environment and procedures that will:
1. Safeguard the public and Government's personnel exposed to Contractor operations and activities.
2. Avoid interruptions of site operations and delays in project completion dates.
3. Control costs in contract performance.
L. Provide appropriate safety barricades, signs, and signal lights.
A. The contractor shall prepare and submit for review by the COR, detailed Job Hazard Analyses (JHA), and an Accident Prevention Plan (Health and Safety Plan) in accordance with Reclamation Safety and Health Standards (RSHS).
1. JHA:
a. Required for each phase of the project.
b. Contractor shall submit to COR list of proposed JHA construction phases of the job.
B. Forms for the plan may be obtained at http://www.usbr.gov/ssle/safety/RSHS/rshs.html.
1. The plan shall be submitted and accepted by Reclamation prior to any construction activities at the site.

A. Submit the following in accordance with Section 01 33 00 - Submittals.

1. Contractor’s Onsite Safety Representative
C. RSN 01 35 30-2, Safety Inspection Reports:
1. List noted deficiencies, their abatement dates, and follow-up action for jobsite activities.
2. Base inspection report on findings of jobsite walk-through with Government personnel.
A. Contractor’s Onsite Safety Representative:
1. Competent supervisory employee with appropriate level of safety related training and experience.
A. Designate an employee as the Contractor’s Onsite Safety Representative prior to start of construction.
B. Contractor’s Onsite Safety Representative authorities, duties, and responsibilities:
1. Review and approve the Contractor’s Safety Program prior to submittal.
2. Responsible for effectively implementing the Contractor’s Safety Program
3. Full authorization to correct unsafe acts on the spot.
4. Prepare safety inspection reports.
5. Onsite during construction activities.
A. Contractor’s Onsite Safety Representative:
1. The effectiveness of the Contractor’s Onsite Safety Representative in prosecuting the safety program will be subject to continued review and approval by the CO.
2. Should the Contractor’s safety effort be considered inadequate, the CO has the option to require the Contractor to employ a qualified Safety Professional.
B. Safety Program:
1. The effectiveness of the Contractor’s Safety Program will be subject to continued review and approval by the CO.

A. The Contractor shall place line and grade stakes along the existing roads to receive gravel, based on the contract drawings. Obtain COR approval of layout/stakes prior to commencing roadwork.
