3.01 EARTHFILL SOURCE

A. Obtain Zone 2 Sand Filter material from processed materials in Borrow Areas or approved commercial sources.

C. Borrow Areas:

3.02 EXCAVATION

A. Archeological Monitor shall observe excavation from Borrow Areas.

1. Report new archeological findings in accordance with Section 01 57 90 - Preservation of Historical and Archeological Data.

2. For known historical resources, coordinate with COR prior to work in accordance with Section 01 57 90 - Preservation of Historical and Archeological Data.

B. Excavation from borrow for Zone 1 Impervious Fill material and Zone 4 Miscellaneous Fill material can be accomplished by common methods.

1. If borrow comes from sources below water table, remove water in accordance with Section 31 03 33 - Removal of Water from Excavation.

C. Excavation from the borrow for Riprap, Rockfill, and gravel surfacing materials may be accomplished by common methods.

1. Rockfill and gravel surfacing may be produced from riprap processing.

D. Do not operate outside of Borrow Areas boundaries shown on drawings.

E. Clear and grub in accordance with Section 31 11 00 - Clearing and Grubbing and strip in accordance with Section 31 14 10 - Stripping.

F. Selectively excavate materials suitable for use. Waste unsuitable materials in separate stockpiles within or adjacent to Borrow Areas, at locations approved by COR.

G. Excavation Slope Limits: Temporary slopes shall be no steeper than 2H:1V slopes, unless approved by COR.

3.03 HAUL ROUTES

A. In accordance with Section 01 55 00 - Vehicular Access and Parking and Section 01 55 20 - Traffic Control.

3.04 DISPOSAL OF EXCAVATED MATERIALS

A. Dispose of excavated materials which are unsuitable for or are in excess of embankment, backfill, or other earthwork requirements, as determined by COR, as provided in Section 31 23 39 - Disposal of Excavated Materials.

3.05 RESTORATION

A. Borrow Areas:

1. Replace unsuitable materials not used for embankments in Borrow Areas.

2. Reclaim Borrow Areas:

a. Grade surfaces within Borrow Areas to drain.

1) Minimum slope: 2 percent.

2) Maximum slope: 4H:1V.

b. Protect reclaimed Borrow Areas from erosion as approved by COR.

3. Spread stockpiled topsoil over reclaimed surfaces in accordance with Section 32 91 19 - Placing Topsoil.

4. Reseed reclaimed surfaces in accordance with Section 32 92 20 - Seeding, Sod and Soil Supplements.

B. Rock Borrow Areas:

1. Rock slopes:

a. No greater than 20 feet in height.

b. No steeper than 1/4:1:

1) In competent rock, W5 or better (as defined on page 67, figure 4-6, USBR Engineering Geology Field Manual).

2. Grade unsuitable material within Borrow Areas to drain.

3. No boulders or larger size material allowed within 2 feet of the top of a rock slope.

4. Bench width: At least 10 feet.

5. Slope benches to back of cut.

a. Construct a drainage ditch or similar feature the back of the bench to limit erosion and safely collect and convey drainage.

SECTION 53 00 05

BASELINE CONDITIONS

PART 1 BASELINE CONDITIONS

1.01 BASELINE CONDITIONS

A. The following Baseline Conditions are provided for bidding purposes and shall have contractual precedence over all geologic and geotechnical supporting documentation in this solicitation:

1. A combination of any 3 of the 6 Borrow Areas identified on the drawings as 1A, 1B, 1C, 2, 3A, and 3B will have sufficient quantities of Zone 1 impervious fill and Zone 4 miscellaneous fill materials. There is limited exploration information available for Borrow areas 4 and 5. In accordance with Section 31 23 32 – Excavation from Borrow, if the Contractor selects to include either or both Borrow Areas 4 and 5 in the three borrow areas selected, the Contractor is required to perform investigations of the selected Borrow Areas 4 and 5. The results of the investigations shall meet the submittal requirements of Section 31 23 32 – Excavation from Borrow for the material to be used in the embankment construction.

2. Excavation at Borrow Areas 1A, 1B, and 1C is expected to encounter bedrock at an average depth of 7 feet. Three feet of sand overburden is assumed to be encountered in the upper portion of excavations.

3. Portions of Borrow Areas 1A, 1B, and 1C are below conservation pool. During periods when the reservoir is nearly full (top of conservation pool elevation 1559), there is a high probability that groundwater will be encountered above the bedrock elevation in the borrow site.

4. The Rock Borrow Areas identified on the drawings have sufficient quantities of Zone 5 Rockfill, riprap, and gravel surfacing materials that can be extracted with mechanical methods and without blasting. To produce the required gradations, the extracted materials will require processing such as sorting, screening, and mixing.

5. Granite blocks will be encountered at various locations along the full length of North Dike on both upstream and downstream sides of the crest. Width between the upstream and downstream blocks will vary. Granite blocks will be encountered at various locations along the full length of Lugert Dike, but only on the downstream side of the crest. The tops of these blocks (both at Lugert Dike and North Dike) are expected to be within one foot of elevation 1571. These blocks are historical artifacts and must remain where they exist. They can be covered, but not removed or relocated.

6. Excavation and subsequent construction at Auxiliary Dike will not be impacted by the reservoir water if that work is performed between September 1 and

October 31. Excavation for all the other dike raises will not encounter ground water at any time of the year.

7. It is anticipated water from reservoir seepage along the length of the trenches will be encountered in accordance with table 53 00 05A - Estimated Seepage Rates.

This anticipated seepage does not include water encountered from surface runoff.

The Lugert Trench seepage rates shown do not include seepage from unwatering at the East Trench that may be conveyed into the Lugert Trench by the connection trench.

SECTION F -- DELIVERIES OR PERFORMANCE

F.1 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF

WORK

APR 1984

The Contractor shall be required to: (a) Commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) Prosecute the work diligently, and (c) Complete the entire work ready for use not later than 800 calendar days after the date the Contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.

F.2 52.211-12 LIQUIDATED DAMAGES—CONSTRUCTION SEPTEMBER 2000

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $8,800 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

F.3 52.211-13 TIME EXTENSIONS SEPTEMBER 2000

Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.

F.4 52.211-18 VARIATION IN ESTIMATED QUANTITY APR 1984

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.

F.5 52.242-14 SUSPENSION OF WORK APR 1984

(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed -

(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and

(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

(j) Preservation of prime-subcontractor rights - Except as provided in paragraph (i) of this clause, this clause shall not limit or impair any contractual, administrative, or judicial remedies otherwise available to the Contractor or a subcontractor in the event of a dispute involving late payment or nonpayment by the Contractor or deficient subcontract performance or nonperformance by a subcontractor.

(k) Non-recourse for prime contractor interest penalty - The Contractor’s obligation to pay an interest penalty to a subcontractor pursuant to the clauses included in a subcontract under paragraph (c) of this clause shall not be construed to be an obligation of the Government for such interest penalty. A cost-reimbursement claim may not include any amount for reimbursement of such interest penalty.

(l) Overpayments - If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall—

(1) Remit the overpayment amount to the payment office cited in the contract along with a description of the overpayment including the—

(i) Circumstances of the overpayment (e.g., duplicate payment, erroneous payment, liquidation errors, date(s) of overpayment);

(ii) Affected contract number and delivery order number if applicable;

(iii) Affected contract line item or subline item, if applicable; and

(vi) Contractor point of contact.

(2) Provide a copy of the remittance and supporting documentation to the Contracting Officer.

I.13 52.236-01 PERFORMANCE OF WORK BY THE CONTRACTOR APR 1984

The Contractor shall perform on the site, and with its own organization, work equivalent to at least 15% percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

I.14 52.236-04 PHYSICAL DATA APR 1984

Data and information furnished or referred to below is for the Contractor’s information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations including auger and core borings, test pits, laboratory analysis, topographic surveys and geologic field reconnaissance.

I.15 52.236-21 SPECIFICATIONS AND DRAWINGS FOR CONSTRUCTION –

(a) The Contractor shall keep on the work site a copy of the drawings and specifications and shall at all times give the Contracting Officer access thereto. Anything mentioned in the specifications and not shown on the drawings, or shown on the drawings and not mentioned in the specifications, shall be of like effect as if shown or mentioned in both. In case of difference between drawings and specifications, the specifications shall govern. In case of discrepancy in the figures, in the drawings, or in the specifications, the matter shall be promptly submitted to the Contracting Officer, who shall promptly make a determination in writing. Any adjustment by the Contractor without such a determination shall be at its own risk and expense. The Contracting Officer shall furnish from time to time such detailed drawings and other information as considered necessary, unless otherwise provided.
