Amendment 03 8(a) STARS II Solicitation QTA609MCA0010

1. Change the Date for Receipt of Offers:

The date specified for receipt of offers is extended/changed to September 16, 2009. The time and location for receipt of offers remains unchanged. This extension provides an opportunity for offerors to adjust to this amendment and for the Government to publish responses to Frequently Asked Questions.

2. Add the following information to Evaluation Subsection 15.2.:

Each 8(a) joint-venture offeror must include its joint-venture agreement (see related requirements at Evaluation Section 11) in the CAP folder for each Constellation on which it proposes. Each 8(a) joint-venture based upon an SBA approved Mentor-Protégé arrangement must include clear and convincing evidence of its SBA approved Mentor-Protégé arrangement (see related requirements at Evaluation Section 12) in the CAP folder for each Constellation on which it proposes. Joint-Venture agreements and Mentor-Protégé agreements don’t count against the CAP maximum page limitation.

3. In Evaluation Subsection 15.4.:

Change the word “suppose” to “supposed”.

4. Replace Evaluation Subsection B.6.3. with the following text:

B.6.3. “Designated industry credentials” are those identified in Evaluation Subsection B.6.1. above. The Government has a significant interest in assuring each Constellation II awardee brings the benefits of a designated industry credential to its promised performance. Accordingly, each Constellation II offeror must demonstrate clear and convincing proof that it possesses at least one of the designated industry credentials at the time of initial offer submission including pricing. For a designated CMMI credential, the Appraisal Disclosure Statement resulting from a SCAMPI A appraisal (not SCAMPI B or C) is required as proof and demonstration of credentialing and must be submitted with the offer. For a designated ISO credential, the ISO Certification of Conformity is required as proof and demonstration of credentialing and must be submitted with the offer. Self-declaration of credentialing does not demonstrate sufficient proof of credentialing.

There are additional credential related requirements depending upon if the offeror is, or is not, an 8(a) joint venture as enumerated below in the balance of Evaluation Section B.6. All such requirements apply at the time of initial offer submission including pricing.

5. Replace Evaluation Subsection B.6.4. with the following text:

B.6.4. Regarding each 8(a) offeror that is not proposing as a joint-venture (non-JV 8(a) offerors) and in addition to Evaluation Subsection B.6.3.: Some degree of outsourced/subcontracted work is expected to apply to every Constellation II awardee’s performance. Therefore, each non-JV 8(a) offeror must satisfactorily represent to the Government that all outsourced/subcontracted Constellation II work will be controlled in accordance with the standards of its operative designated industry credential. For instance, designated CMMI credentials entail, among many other standards, Supplier Agreement Management [ML 2], which is shared by the CMMI for Development and CMMI for Services. Similarly, designated ISO credentials entail, among many other standards, ISO clauses 4.1 and 7.4. A satisfactory representation must be on a document which is signed by the offeror that is submitted in accordance with Evaluation Subsection B.6.6. The representation must state that the offeror “intends to control all outsourced/subcontracted Constellation II work in accordance with the standards of our operative designated industry credential.” For instance, if the offeror’s name is ABC Co., Inc., the representation would state “ABC Co., Inc. intends to control all outsourced/subcontracted Constellation II work in accordance with the standards of our operative designated industry credential.” It is the offeror’s responsibility to ensure that the organization named in the proof and demonstration of a designated industry credential is clearly and convincingly identifiable as that of the non-JV 8(a) offeror. Failure of the offeror to sign and submit the representation will summarily result in the offer being unacceptable for award without recourse. Regardless of how many of the four Constellation II functional areas each non-JV 8(a) offers for, only one such representation per offeror is required.

6. Add the following text to Evaluation Section B.6.:

B.6.5. Regarding each 8(a) joint-venture offeror (8(a) mentor-protégé or not) and in relation to Evaluation Subsection B.6.3.: Each 8(a) joint-venture offeror (8(a) mentor-protégé or not) must demonstrate the clear and convincing proof specified in Evaluation Subsection B.6.3. In this regard, at least one constituent organization of the 8(a) joint-venture must possess at least one of the designated industry credentials. Additionally, the 8(a) joint-venture offeror must make two additional representations described in B.6.5.1 and B.6.5.2. below. It is the offeror’s responsibility to ensure that the organization named in the proof and demonstration of a designated industry credential is clearly and convincingly identifiable as that of a constituent member of the 8(a) joint-venture in the 8(a) joint-venture agreement. It is not necessary that the 8(a) managing venturer of an 8(a) joint-venture offeror itself be the credentialed organization.

B.6.5.1. Each 8(a) joint-venture offeror (8(a) mentor-protégé or not) must satisfactorily represent to the Government that the combined 8(a) joint-venture will perform all Constellation II work in accordance with the standards of its operative designated industry credential maintained by one of its constituent organizations. For instance, designated CMMI credentials entail, among many other standards, Supplier Agreement Management [ML 2], which is shared by the CMMI for Development and CMMI for Services. Similarly, designated ISO credentials entail, among many other standards, ISO clauses 4.1 and 7.4. A satisfactory representation must be on a document which is signed by every constituent member of the 8(a) joint-venture offeror that is submitted in accordance with Evaluation Subsection B.6.6. The representation must state that the 8(a) joint-venture offeror “intends to perform all Constellation II work in accordance with the standards of our operative designated industry credential maintained by a constituent member of the 8(a) joint-venture.” For instance, if the 8(a) joint-venture offeror’s name is XYZ JV Amalgamated, the representation would state “XYZ JV Amalgamated intends to perform all Constellation II work in accordance with the standards of our operative designated industry credential maintained by a constituent member of the 8(a) joint-venture.” Failure of even a single constituent member of the 8(a) joint-venture to sign the representation or the 8(a) joint-venture offeror’s failure to submit the signed representation will summarily result in the offer being unacceptable for award without recourse. Regardless of how many of the four Constellation II functional areas each 8(a) joint-venture offers for, only one such representation per offeror is required.

B.6.6. All industry credential documentation and related representation(s) described in Amendment 03 must be included in the industry credential folder on the disc identified in Evaluation Subsection 15.2.

B.6.7. Specific requirements in this amendment take precedence over general statements on the same subject matter in Evaluation Sections 11 and 12.
