About this file

This document outlines the "Public Work" Project Bidding Requirements established by the Illinois Emergency Management Agency and Office of Homeland Security for public works construction projects conducted within the state of Illinois. The requirements apply to all vendors seeking to be considered responsible bidders for such solicitations and must demonstrate compliance to the issuing agencies.

The bidding requirements impose four primary conditions on vendors and their subcontractors: (1) compliance with the Illinois Prevailing Wage Act (820 ILCS 130/.01 et seq.), which mandates payment of prevailing wage rates for laborers, workers, and mechanics performing services on public works projects in the county where work is performed, with rates published and regularly updated by the Illinois Department of Labor; (2) maintenance of a valid Certificate of Insurance naming the State as an additional insured, including General Commercial Liability coverage of $1,000,000 per occurrence with $2,000,000 annual aggregate, Auto Liability of $1,000,000 per occurrence, and Worker's Compensation Insurance as required by law; (3) participation in apprenticeship and training programs approved and registered with the U.S. Department of Labor's Bureau of Apprenticeship and Training in the same trades in which work is performed; and (4) certification that the vendor will maintain an Illinois office as the primary place of employment for all persons employed on the construction project. Vendors must execute a certification attesting to compliance with all four requirements.

"Public Work" Project Bidding Requirements

To be considered a responsible vendor for the purpose of this solicitation, the vendor must comply with all of the following requirements and must present satisfactory evidence of that compliance to the Illinois Emergency Management Agency and Office of Homeland Security.

1) This contract [or agreement] calls for the construction of a “public work,” within the meaning of the Illinois Prevailing Wage Act, 820 ILCS 130/.01 et seq. (“the Act”). The Act requires contractors and subcontractors to pay laborers, workers and mechanics performing services on public works projects no less than the current “prevailing rate of wages” (hourly cash wages plus amount for fringe benefits) in the county where the work is performed. The Illinois Department of Labor (IDOL) publishes the prevailing wage rates on its website at http://labor.illinois.gov/. IDOL revises the prevailing wage rates and the contractor/subcontractor has an obligation to check the IDOL’s web site for revisions to prevailing wage rates. For information regarding current prevailing wage rates, please refer to IDOL’s website. All contractors and subcontractors rendering services under this contract must comply with all requirements of the Act, including but not limited to, all wage requirements and notice and record keeping duties.

2) The vendor must have a valid certificate of insurance showing the following coverages:

general liability, professional liability, product liability, workers' compensation, completed operations, hazardous occupation, and automobile. Vendor shall, at all times during the term of this contract and any renewals or extensions, maintain and provide a Certificate of Insurance naming the State as an additional insured for all required bonds and insurance.

Certificates may not be modified or canceled until at least thirty (30) days' notice has been provided to the State. Contractor shall provide: (a} General Commercial Liability insurance in the amount of $1,000,000 per occurrence {Combined Single Limit Bodily Injury and Property Damage) and $2,000,000 Annual Aggregate; (b) Auto Liability, including Hired Auto and Non-owned Auto (Combined Single Limit Bodily Injury and Property Damage), in amount of $1,000,000 per occurrence; and (c} Worker's Compensation Insurance in the amount required by low.

Insurance shall not limit Vendor’s obligation to indemnify, defend, or settle any claims.

3) The vendor and all vendor's subcontractors must participate in applicable apprenticeship and training programs approved by and registered with the United States Department of Labor's Bureau of Apprenticeship and Training. Contractor and all subcontractors must be participants in apprenticeship and training programs that are both approved by and registered with the U.S. Department of Labor's Bureau of Apprenticeship and Training. The program(s) must be in the same trade(s) in which the contractor or subcontractor performs work. For information on how to participate in or set up a program, contractors may call the U.S. Department of Labor at 312/596-5508 or visit their website http://www.doleta.gov/atels_bat/.

4) The vendor must certify that the vendor will maintain an Illinois office as the primary place of employment for persons employed in the construction authorized by the contract.
