About this file
This document is a Public Records clause for the City of New Smyrna Beach, Florida, detailing the requirements for handling public records in connection with municipal contracts. The document outlines the city's rights regarding materials submitted in response to solicitations, including that all submitted materials become city property and may be reviewed by the public ten days after the public opening. The city reserves the right to use any information submitted, and disqualification of a consultant does not negate this right.
The document specifically requires contractors to comply with Florida Statutes Chapter 119 by: maintaining public records required to perform services, providing records upon request, ensuring exempt or confidential records are not disclosed, and transferring or maintaining public records upon contract completion. Contractors must provide records in a format compatible with the city's information technology systems and may be required to destroy duplicate records. For questions about public records requirements, contractors are instructed to contact the City Clerk at 386/410-2630 or CLERK@CITYOFNSB.COM.

1. Keep and maintain public records required by the public agency to perform the service.
