About this file

This document is a U.S. Preference form for procurement of products manufactured in the United States, applicable under Louisiana Revised Statute (R.S.) 39:1604.7. The form provides guidelines for bidders claiming a five percent price preference for products manufactured entirely within the United States, with specific conditions for consideration. Bidders must complete the entire document prior to bid opening, detailing the line items for which they are claiming preference and the specific U.S. location of manufacturing.

The preference applies when products manufactured in the United States are equal in quality to other items, with key conditions including: (1) the cost cannot exceed non-U.S. manufactured items by more than five percent, (2) the vendor must agree to sell at the lowest bid price, and (3) if multiple U.S. manufacturers bid within five percent of the lowest price, the lowest bidder can accept that price. Vendors claiming the preference must certify the items are manufactured in the United States, which is defined as a process where manufacturing, assembly, processing, packaging, testing, and value-adding activities occur within U.S. jurisdiction.
