About this file

This is a Louisiana Preference Note to Bidder document issued by the State of Louisiana Department of Transportation and Development (DOTD) for a rebid on aluminum flat products. The document establishes the framework for bidders to claim preference eligibility under Louisiana R.S. 39:1604(H) & (I), which allows for preferential consideration of products produced, manufactured, or assembled within Louisiana. Bidders must complete and submit the preference form prior to bid opening to be considered for the preference. The preference applies to products that are equal in quality to competing alternatives and originate from vendors whose Louisiana workforce comprises at least fifty percent Louisiana residents.

The Louisiana preference permits a cost differential of up to ten percent above the lowest bid price for qualifying Louisiana products, provided the vendor agrees to match the lowest bid price. In cases where multiple bidders offer Louisiana products within the ten percent threshold, the bidder with the lowest bid on Louisiana items is entitled to accept the lowest overall bid price. The document requires bidders claiming preference to identify specific line items subject to the claim, confirm their workforce composition meets the fifty percent Louisiana resident requirement, and specify the Louisiana location(s) where products are produced, manufactured, or assembled. Preference eligibility does not apply to mere reassembly of pre-packaged components and requires verification of manufacturing, processing, production, or assembly activities performed within Louisiana's territorial borders.
