GENERAL SERVICES ADMINISTRATION (GSA)
OFFICE OF FEDERAL HIGH PERFORMANCE GREEN BUILDINGS
Justification and Approval (J&A) Other than Full and Open Competition
GSA Energy Savings Research
I. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY
Agency: General Services Administration Office of the Chief 1800 F Street NW Washington, DC 204050
Contracting Activity: General Services Administration Internal Acquisition Division 1800 F Street, NW Washington DC, 20405
II. NATURE AND DESCRIPTION OF ACTION BEING APPROVED
The proposed contract action will provide research services required to accurately document and categorize the key areas of operational and capital investment that produced US General Services Administration (GSA) 30 percent reduction in energy intensity. GSA’s actions in this area are driven by the Energy Independence and Security Act of 2007 (EISA) which requires federal agencies to reduce energy intensity by 3 percent per year, or 30 percent by FY 2015. U.S. Federal buildings consume $6.5 Billion in utilities each year.
GSA seeks to leverage non-biased and independent expertise to perform analysis and then develop a business case review of GSA energy efficiency efforts over the last ten years for GSA owned buildings. The proposed contractor will first qualify the savings categorically then quantify the energy savings by category across the GSA owned portfolio and include an analysis of the last ten year historical data and other relevant data and associated meta-data.
III. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY'S NEEDS
Description of Service: Academic Research Services
Period of Performance: P e r i o d o f 1 2 m o n t h s ( n o o p t i o n s ) Estimated Cost $149,900 Expertise required:
o 25 years plus of building systems academic research o Experience in measuring energy use intensity in office buildings o Experience in identifying how energy savings are achieve in buildings, including the contribution of newly implemented technologies, operational strategies, occupancy patterns, building operator expertise, and other factors that influence energy use in buildings o Experience in conducting field research of building performance in multiple buildings and geographical areas o Experience in validating building performance outcomes o Experience in using computer simulation and modeling to test and evaluate hypotheses and comparing modeled to actual building energy use intensity o Experience in working with multi-disciplinary teams
IV. IDENTIFICATION OF STATUTORY AUTHORITY
41 U.S.C. 3304 authorizes civilian agencies, under certain conditions and circumstances, to award contracts without providing for full and open competition. The seven statutory exceptions to full and open competition are implemented in FAR Subpart 6.3, including when an agency wishes to establish an essential engineering, research or developmental capability with an educational or other nonprofit institution [FAR 6.302-3(a)(2)(ii)]. Pursuant to FAR 6.302- 3(b)(2), the use of this authority is appropriate when the capabilities required of the educational or nonprofit organization include theoretical analyses, exploratory studies, and experiments in any field of science or technology, as well as engineering or developmental work calling for the practical application of investigative findings in scientific and technical fields and supplies or services necessary incident to the activities outlined above [FAR Subpart 6.302-3(b)(2)(i)-(iii)].
V. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTABLE
FAR 6.302-3(a)(2)(ii) permits agencies to establish or maintain an essential engineering, research or developmental capability with an educational or other non-profit institution when such services (in this case, engineering or developmental work calling for the practical application of investigative findings in scientific and technical fields) are required to meet agency objectives. In addition, FAR 6.302-3(b)(2)(iii) provides that an agency may acquire supplies or services on a non-competitive basis when necessary to maintain the capabilities noted FAR 6.302-3(b)(2)(ii) and which are critical to the agency’s mission objectives. This exception to the use full and open competition does not require GSA to seek other sources for this procurement [see FAR 6.302-3(c)] Pursuant to FAR 6.305, GSA will post a copy of this justification to the GPE within 14 days after contract award.
VI. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND
REASONABLE
GSA has conducted and is conducting a series of academic research projects in the past which have similar academic research related labor categories and rates. The rates of Principal Investigator, Co-Principle Investigator, Research Scientist, Research Tech Specialist and, Graduate Research Assistant have been found to be similar to associated rates of categories found on the GSA schedule for private industry energy auditing firms and have been found fair and reasonable
VII. DESCRIPTION OF MARKET SURVEY CONDUCTED.
A search of the GSA schedule did not reveal any specific schedule contract which contained an entity that had the capabilities required of an educational or non-profit organization which included theoretical analyses, exploratory studies, and experiments in any field of science or technology, as well as engineering or developmental work calling for the practical application of investigative findings in scientific and technical fields. The services of CMU will be acquired for the purposes described herein on a one-time basis. Pursuant to FAR 6.305, GSA will post a copy of this justification to the GPE within 14 days after contract award. Feedback resulting from this posting will be considered in the event GSA requires similar services at a future point.
VIII. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION.

IX. LIST OF SOURCES THAT EXPRESSED AN INTEREST IN THE ACQUISITION.

X. STATEMENT OF ACTIONS TO OVERCOME THE BARRIERS TO COMPETITION
GSA expects that this contract will be a one-time event. Pursuant to FAR 6.305, GSA will post a copy of this justification to the GPE within 14 days after contract award. Feedback resulting from this posting will be considered in the event GSA requires similar services at a future point.
