§303.124 Da t a co lle ct ion .
(a ) Each sta tewide system m ust include a system for com piling and reporting tim e ly and accura te da ta tha t m ee ts the requirem ents in pa ragraph (b) of th is section and §§303.700 through 303.702 and 303.720 through 303.724.
(b) The da ta system requ ired in pa ragraph (a ) of th is section m ust include a descrip tion of the process tha t the Sta te uses, or will use , to com pile da ta on infan ts or toddle rs with d isab ilitie s rece iving ea rly in te rvention se rvices under th is pa rt, includ ing a descrip tion of the Sta te 's sam pling m ethods, if sam pling is used , for reporting the da ta required by the Secre ta ry unde r sections 616 and 618 of the Act and §§303.700 through 303.707 and 303.720 through 303.724.

§303.700 St a t e m on it o r in g a n d e n fo rce m e n t .
(a ) The lead agency m ust—
(1) Monitor the im plem enta tion of th is part;
(2) Make de te rm ina tions annua lly about the pe rform ance of each EIS program using the ca tegories iden tified in §303.703(b);
(3) Enforce th is pa rt consisten t with §303.704, using appropria te en forcem ent m echan ism s, which m ust include , if applicab le , the enforcem ent m echanism s iden tified in §303.704(a)(1) (technica l assistance) and §303.704(a)(2) (im posing conditions on the lead agency's funding of an EIS program or, if the lead agency does not p rovide part C funds to the EIS program , an EIS p rovider), §303.704(b)(2)(i) (corrective action or im provem ent p lan ) and §303.704(b)(2)(iv) (withhold ing of funds, in whole or in part by the lead agency), and §303.704(c)(2) (withhold ing of funds, in whole or in pa rt by the lead agency); and
(4) Report annually on the pe rform ance of the Sta te and of each EIS program unde r th is part as p rovided in §303.702.
(b) The p rim ary focus of the Sta te 's m onitoring activitie s m ust be on—
(1) Im proving early in te rvention resu lts and functiona l ou tcom es for a ll in fan ts and toddle rs with d isab ilitie s; and
(2) Ensuring tha t EIS program s m ee t the program requ irem ents under part C of the Act, with a pa rticu la r em phasis on those requirem ents tha t a re m ost close ly re la ted to im proving early in te rvention resu lts for in fan ts and todd le rs with d isab ilitie s.
(c) As a pa rt of its re sponsib ilitie s under paragraph (a ) of th is section , the Sta te m ust use quantifiab le ind ica tors and such qua lita tive ind ica tors as a re needed to adequate ly m easure pe rform ance in the priority a reas iden tified in paragraph (d) of th is section , and the ind ica tors e stab lished by the Secre ta ry for the Sta te pe rform ance p lans.
(d ) The lead agency m ust m onitor each EIS program loca ted in the Sta te , using quantifiab le ind ica tors in each of the fo llowing priority a reas, and using such qua lita tive ind ica tors as a re needed to adequate ly m easure pe rform ance in those a reas:
(1) Early in te rvention se rvices in na tu ra l environm ents.
(2) Sta te exe rcise of genera l supervision , including ch ild find , e ffective m onitoring, the use of re solu tion sessions (if the Sta te adopts part B due process hearing procedures under §303.430(d)(2)), m edia tion , and a system of transition se rvices as de fined in section 637(a)(9) of the Act.
(e ) In exercising its m onitoring responsib ilitie s under paragraph (d) of th is section , the Sta te m ust ensure tha t when it iden tifie s noncom pliance with the requirem ents of th is part by EIS program s and providers, the noncom pliance is corrected as soon as possib le and in no case la te r than one year a fte r the Sta te 's iden tifica tion of the noncom pliance .

§303.701 St a t e p e r fo rm a n ce p la n s a n d d a t a co lle ct ion .
(a ) Genera l. Each Sta te m ust have in p lace a pe rform ance p lan tha t m ee ts the requ irem ents described in section 616 of the Act; is approved by the Secre ta ry; and includes an eva lua tion of the Sta te 's e fforts to im plem ent the requirem ents and purposes of part C of the Act, a descrip tion of how the Sta te will im prove im plem enta tion , and m easurab le and rigorous ta rge ts for the ind ica tors e stab lished by the Secre ta ry unde r the priority a reas described in §303.700(d).
(b ) Review of Sta te performance plan. Each Sta te m ust review its Sta te pe rform ance p lan a t least once every six yea rs and subm it any am endm ents to the Secre ta ry.

(c) Da ta collection. (1) Each Sta te m ust collect va lid and re liab le in form ation as needed to report annually to the Secre ta ry under §303.702(b)(2) on the ind ica tors e stab lished by the Secre ta ry for the Sta te pe rform ance p lans.
(2) If the Secre ta ry pe rm its Sta tes to collect da ta on specific ind ica tors th rough Sta te m onitoring or sam pling, and the Sta te collects da ta for a pa rticu la r ind ica tor th rough Sta te m onitoring or sam pling, the Sta te m ust collect and report da ta on those ind ica tors for each EIS program a t least once during the six-year pe riod of a Sta te pe rform ance p lan .
(3) Noth ing in pa rt C of the Act or these regula tions m ay be construed to au thorize the deve lopm ent of a na tionwide da tabase of pe rsonally iden tifiab le in form ation on ind ividua ls involved in stud ies or o the r collections of da ta under pa rt C of the Act.

§303.702 St a t e u se o f t a rge t s a n d r e p or t in g.
(a ) Genera l. Each Sta te m ust use the ta rge ts e stab lished in the Sta te 's pe rform ance p lan unde r §303.701 and the priority a reas described in §303.700(d) to ana lyze the pe rform ance of each EIS program in im plem enting part C of the Act.
(b ) Public reporting and privacy. (1) Public report. (i) Subject to paragraph (b)(1)(ii) of th is section , the Sta te m ust—
(A) Report annually to the public on the pe rform ance of each EIS program loca ted in the Sta te on the ta rge ts in the Sta te 's pe rform ance p lan as soon as p racticab le bu t no la te r than 120 days fo llowing the Sta te 's subm ission of its annual pe rform ance report to the Secre ta ry unde r paragraph (b)(2) of th is section ; and
(B) Make the Sta te 's pe rform ance p lan unde r §303.701(a), annual pe rform ance reports unde r paragraph (b)(2) of th is section , and the Sta te 's annua l reports on the pe rform ance of each EIS program unde r paragraph (b)(1)(i)(A) of th is section ava ilab le th rough public m eans, including by posting on the Web site of the lead agency, d istribu tion to the m edia , and d istribu tion to EIS program s.
(ii) If the Sta te , in m ee ting the requ irem ents of paragraph (b)(1)(i)(A) of th is section , collects da ta th rough Sta te m onitoring or sam pling, the Sta te m ust include in its pub lic report on EIS program s under pa ragraph (b)(1)(i)(A) of th is section the m ost recently ava ilab le pe rform ance da ta on each EIS program and the da te the da ta were collected .

The Sta te m ust not report to the public or the Secre ta ry any inform ation on pe rform ance tha t would resu lt in the d isclosure of pe rsonally iden tifiab le in form ation about ind ividua l ch ild ren , or where the ava ilab le da ta a re insufficien t to yie ld sta tistica lly re liab le in form ation .

§303.720 Da t a r e q u ir e m e n t s—ge n e ra l.

§303.721 An n u a l r e p o r t o f ch ild r e n se rve d —re p or t r e q u ir e m e n t .
(a ) For the purposes of the annual report required by section 618 of the Act and §303.720, the lead agency m ust count and report the num ber of in fan ts and todd le rs rece iving early in te rvention se rvices on any da te be tween October 1 and Decem ber 1 of each yea r. The report m ust include—
(1) The num ber and pe rcentage of in fan ts and toddle rs with d isab ilitie s in the Sta te , by race , gende r, and e thn icity, who a re rece iving ea rly in te rvention se rvices (and include in th is num ber any ch ildren reported to it by tribes, triba l organiza tions, and consortia under §303.731(e )(1));
(2) The num ber and pe rcentage of in fan ts and toddle rs with d isab ilitie s, by race , gender, and e thn icity, who, from b irth th rough age two, stopped rece iving early in te rvention se rvices because of p rogram com ple tion or for o the r reasons; and
(3) The num ber and pe rcentage of a t-risk in fan ts and toddle rs (as de fined in section 632(1) of the Act), by race and e thn icity, who are rece iving ea rly in te rvention se rvices under part C of the Act.

(b) If a Sta te adopts the op tion unde r section 635(c) of the Act and §303.211 to m ake se rvices under th is part ava ilab le to ch ild ren ages th ree and olde r, the Sta te m ust subm it to the Secre ta ry a report on the num ber and pe rcen tage of ch ild ren with d isab ilitie s who a re e ligib le for se rvices unde r section 619 of the Act bu t whose paren ts choose for those ch ild ren to continue to rece ive ea rly in te rvention se rvices.
(c) The num ber of due p rocess com pla in ts filed unde r section 615 of the Act, the num ber of hea rings conducted and the num ber of m edia tions he ld , and the num ber of se ttlem ent agreem ents reached through such m edia tions.

(b ) Sampling. The Secre ta ry m ay pe rm it Sta tes and outlying a reas to ob ta in da ta in section 618(a) of the Act th rough sam pling.

In add ition to m ee ting the requ irem ents of §§303.721 through 303.723, the lead agency m ust conduct its own ch ild count or use EIS p roviders to com ple te its ch ild count. If the lead agency uses EIS p rovide rs to com ple te its ch ild count, then the lead agency m ust—
(a) Estab lish procedures to be used by EIS p roviders in counting the num ber of ch ild ren with d isab ilitie s rece iving early in te rvention se rvices;
(b) Estab lish da tes by which those EIS provide rs m ust report to the lead agency to ensure tha t the Sta te com plies with §303.721(a);
(c) Obta in ce rtifica tion from each EIS provide r tha t an undup lica ted and accura te count has been m ade ;
(d) Aggrega te the da ta from the count ob ta ined from each EIS provide r and p repare the report requ ired under §§303.721 through 303.723; and
(e ) Ensure tha t docum enta tion is m ain ta ined to enable the Sta te and the Secre ta ry to audit the accuracy of the count.
