PHA-WIDE SNOW REMOVAL

SERVICES Spec No. 2026-100-013

SECTION I – BACKGROUND

1.01 Detroit Housing Commission

The Detroit Housing Commission (DHC) is a Michigan public body corporate organized as a housing agency and operating under the Michigan Housing Facilities Act, MCL 125.653 et seq. Prior to August 2004, DHC was a department of the City of Detroit.

Its mission is to provide quality, affordable housing for low- to moderate-income families, and to make public housing in Detroit a “housing of choice.” DHC is currently comprised of approximately 3800 units of public housing, 144 units of Modernization Rehabilitation over 5 sites, and approximately 6,000 Housing Choice Vouchers under the Housing Choice Voucher (HCV) program.

A five-person Board of Commissioners, authorized by State law, is responsible for the development of housing policy and the authorization of expenditures. Operations and recommendations regarding planning strategies made to the Board of Commissioners and the mayor are the responsibility of the Executive Director of DHC.

DHC currently employs approximately 125 employees, most of whom are unionized. These employees provide clerical, facilities management, maintenance, inspection, design, and support services for approximately 10,000 residents and participants of our public housing and Housing Choice Voucher program.

All questions regarding this Request for Proposal should be directed to:

The contract will be for a term of 1 year, with 4 additional one-year extension options to renew for subject to the necessary approvals. The initial term is anticipated to commence from the date of the Notice to Proceed Letter. The successful Firm will be granted the right to perform the Services described in Section II (Scope of Services) for the specified contract period.

SECTION II - SCOPE OF SERVICES

Firms must clearly and unambiguously specify the cost of the services in their proposals. Any reimbursable fees should be identified separately.

Any other taxes, fees, or commissions applicable to the proposed contract are the responsibility and liability of the proposer, who must include these costs in the price of the goods and services.

3.05 Small/Minority/Women/Disadvantaged Business

It is the policy of DHC to encourage its contractors to understand the agency’s policies to expand access to business opportunities for small business enterprises (SBE), women-owned business enterprises (WBE), minority owned business enterprises (MBE), and/or disadvantaged business enterprises (DBE). Each Proposer must provide a brief policy statement on these matters, including any plans to create equal access to opportunities on its own team and project expenditures. This should include a specific list of intended and/or potential consultants and/or sub-consultants for each category referenced above, and the percentage of work that will be performed by each consultant and/or sub-consultant. The Contractor, while performing Services on DHC property, agrees to comply with applicable OSHA requirements and all applicable state and local health and safety requirements applicable to the Services to be provided under this Contract. This obligation includes, but is not limited to, measures to mitigate the spread of the coronavirus.

Specifically, the Contractor shall develop procedures to screen its employees for COVID- 19 symptoms and to ensure its employees engage in social distancing, wear face coverings, and stay home when sick. To the extent DHC’s health and safety procedures are more stringent than the Contractor’s, the Contractor shall comply with DHC’s procedures. The Contractor is responsible for providing its employees, at its expense, with any required personal protective equipment (“PPE”).

Contractor is to report to the front desk/security booth of the assigned property before any work is initiated. A health screen is required before entering the property.

SECTION IV - EVALUATION

4.01 Evaluation Criteria

Proposals will be evaluated by DHC against the following criteria.

1. Experience of the Firm in Sec. 3.02 0-35 points

2. Capacity of the Staff as addressed in Sec. 3.03 0-30 points

3. Cost/Fees in Sec. 3.04 0-20 points

4. Small/Minority/Women/Disadvantaged Business in Sec. 3.05 0-10 points

5. Section 3 Compliance in Section 3.06 0-5 points

TOTAL 100

points

Proposals will be scored on a one-hundred-point (100) scale by an evaluation committee scoring the technical criteria in accordance with the evaluation criteria set forth above. Each Respondent must indicate its fees in accordance with section 3.04.

Fees must be reasonable and justifiable and must reflect the proposed approach/work plan. DHC will award the responsive and responsible Respondent(s) whose proposal conforms to this RFP and whose combined scores under this section provide the best value. Notwithstanding anything contained herein, DHC reserves the right to make an award based on any other relevant considerations and in the best interest of DHC.

For this RFP, DHC will use the ration method for scoring proposed fees. Under this method, the lowest prices receive the maximum points allowed. All other proposals will receive a percentage of points available based on their proposed prices’ relationship to the lowest, using the following formula: [Ration method is not the only method to score price. Contracting Officer may use alternative quantifiable scoring methods.]

(A/B) x C = D

A = Lowest proposed price B = Other respondents’ proposed price C = Maximum number of price points available D = Score

(Lowest proposed price, divided by other respondents’ price, times the maximum points allowed equals score.)

Example: The lowest proposed price is $100,000. The next lowest proposed price is $125,000. The maximum total points available for price is 10. The lowest proposed price of $100,000 will receive the maximum of 10 points. The next lowest proposed price of $125,000 will receive 8 points ($100,000/$125,000 = .080) x 10 = 8.

DHC reserves the right to make an award decision based solely on the electronically submitted proposals without any request for presentations, formal interviews, negotiations, or further discussions.

Following the submissions, the evaluation committee will evaluate and summarize their findings for each firm that participates (in a competitive range) and will submit scores to the Procurement Officer. DHC will award the responsive and responsible Respondent(s) whose proposal conforms to this RFP and whose combined total score for price, compliance, technical factors, and oral presentations (if applicable) provides the best value to DHC. Notwithstanding anything contained herein, DHC reserves the right to make an award based on any other relevant considerations and in the best interest of

DHC.

The DHC reserves the right to reject any and all proposals and may secure services solicited by this RFP by means of non-competitive proposals in accordance with 2 CFR

200.320 (f)(4), or to resolicit competitive proposals.

4.02 Process for Award

Without limitation and at its sole option, DHC reserves the right to accept or reject any or all proposals, to take exception to these RFP specifications, to negotiate with finalists, or to waive any informality. Firms may be excluded from further consideration for failure to fully comply with the specifications of this RFP. DHC may decide to reject all proposals and/or to reissue this RFP with modifications.

DHC will not award contracts to proposers that are debarred, suspended, or otherwise determined ineligible by HUD or other government agencies, nor to proposers that DHC has determined to be non-responsible.

DHC reserves the right to make an award based solely on the original proposals received or to negotiate further with proposers. The proposer selected for the award will be chosen on the basis of an assessment of the greatest benefit to DHC, not necessarily on the basis of the lowest price. DHC also reserves the right to negotiate and award any element of this RFP, make multiple awards, reject any or all proposals, or waive any minor irregularities or technicalities in proposals received as the best interest of DHC may require.

The mistake and the intended correct offer are clearly evident on the face of the proposal.

The Firm submits written evidence which clearly and convincingly demonstrates both the existing offer, and such a correction would not be contrary to the fair and equal treatment of other Firms.

SECTION VI - CONTRACT PROVISIONS

6.01 Conflict of Interest

a. The Firm warrants that to the best of its knowledge and belief and except as otherwise disclosed, it does not have any organizational conflict of interest. Conflict of interest is defined as a situation in which the nature of work under this contract and the Firm's organizational, financial, contractual, or other interests are such that:

1. Award of the contract may result in an unfair competitive advantage; or

2. The Firm’s objective in performing the contract work may be impaired. In the event the Firm has an organizational conflict of interest as defined herein, the Firm shall disclose such conflict of interest fully in the proposal submission.

b. The Firm agrees that if, after award, he or she discovers an organizational conflict of interest with respect to this contract, he or she shall make an immediate and full disclosure in writing to the General Manager-Purchasing, which shall include a description of the action which the Firm has taken or intends to take to eliminate or neutralize the conflict. DHC may, however, terminate the contract if it is in its best interest.

c. In the event the Firm was aware of an organizational conflict of interest before the award of this contract and intentionally did not disclose the conflict to the General Manager-Purchasing, DHC may terminate the contract for default.

d. The provisions of this clause shall be included in all subcontracts and consulting agreements wherein the work to be performed is like the service provided by the Firm. The Firm shall include in such subcontracts and consulting agreements any necessary provisions to eliminate or neutralize conflicts of interest.

e. No member of or delegate to the U.S. Congress or Resident Commissioner shall be allowed to any share or part of this contract or to any benefit to arise. This provision shall be construed to extend to this contract if made with a corporation for its general benefit.

f. No member, officer, or employee of DHC, no member of the governing body of the locality in which the project is situated, no member of the governing body in which DHC was activated, and no other public official of such locality or localities who exercises any functions or responsibilities with respect to the project, shall, during his or her tenure, or for one year thereafter, have any interest, direct or indirect, in this contract or the proceeds thereof.

g. No member, officer, or employee of the firm selected to perform the services described above shall, during the term of their contract, or for one year thereafter, have any interest, direct or indirect, in any contract that they are responsible for procuring, managing, or overseeing in the proceeds of any such contract.

A self-addressed, stamped envelope must be included with the written request. Each unsuccessful vendor will be notified in writing promptly upon award. The notice shall identify the successful Firm.

6.04 Form of Purchase

The acceptance of the proposed Firm’s offer for the services specified herein will be made by issuance of a duly authorized contract or purchase order prepared by DHC. Vendors are cautioned to make no assumptions or accept any representations by any employee, member, officer, or representative of DHC concerning the award until a contract agreement is executed.

6.05 Government Restrictions

In the event any governmental restrictions may be imposed which would necessitate alteration of the material, quality, workmanship, or performance of the goods or services offered, it shall be the responsibility of the successful Firm to immediately notify DHC in writing specifying the regulation which requires alteration. DHC reserves the right to accept any such alteration, including any reasonable price adjustments occasioned thereby, or to cancel the contract at no expense to DHC.

6.06 Nonconformance to Conditions/Specifications/Scope of Services

Services will be inspected for compliance with specifications. Services not conforming to specifications may not be accepted at the Firm’s expense. Services not provided in accordance with the Scope of Services may result in the Firm being found in default. In the event of default, all procurement costs may be charged against the Firm. Any violations of these stipulations may result in the Firm’s name being removed from DHC’s proposal mailing list.

6.07 Assignment or Transfer

The successful Firm shall not assign or transfer any interest in the contract, in whole or in part, without the written approval of DHC.
