About this file

This is a Performance Bond document required by the County of Orange, California for contractors entering into a service contract with the County. The bond serves as a faithful performance guarantee, obligating the contractor and surety to ensure complete and proper execution of the contract work in accordance with all specified terms, conditions, and agreements. The bond amount is penal in nature, meaning the surety becomes jointly and severally liable for the full contract amount plus any costs, reasonable expenses, and fees incurred by the County in enforcing the bond obligation. The contractor and surety are bound to indemnify, defend, and hold harmless the County, its officers, and agents throughout the contract term. The surety waives notice of any changes, extensions of time, alterations, or additions to the contract terms and specifications.

The Performance Bond requires notarized signatures from the surety representative and typed or stamped identification of the surety company above the signature line. Approval authority rests with both the County's CEO/Risk Management division and the Office of the County Counsel. For corporate signatories, California Corporations Code Section 313 requires either two authorized officers (one from executive leadership and one from finance/administrative roles) or a single officer with documented corporate authority through resolution. The bond premium is calculated at a specified rate per thousand dollars of the contract price, with the exact premium amount and rate to be determined based on the final contract value. This bond applies to the County's Pre-Hospital Paramedic Continuing Education Courses procurement, for which bids are submitted exclusively through the County's electronic eProcurement Portal.
