About this file
This is a Performance Bond template issued by the County of Orange, California, for use in county contracts. The bond serves as a guarantee of faithful performance by contractors engaged to complete work for the Sheriff-Coroner's Video Down-Link System project. The bond requires contractors to provide a surety company authorized to conduct business in California that will guarantee performance of all contractual obligations, including adherence to specifications, timelines, and conditions outlined in the primary contract. The principal and surety are jointly and severally liable for the penal sum specified in the bond document, which is calculated based on the contract price at a predetermined rate per thousand dollars.
The bond document establishes that the surety waives notice of any changes, extensions, alterations, or additions to the contract terms and remains obligated regardless of such modifications. The County of Orange is authorized to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation, which may be taxed as costs and included in any judgment rendered against the principal or surety. The bond requires notarization of the surety representative's signature with an attached certificate of notarization, typed or stamped identification of the surety company name above the signature line, and approval from both the County's CEO/Risk Management office and the Orange County Counsel's office. Corporate signatories must comply with California Corporations Code section 313 requirements, which mandate either signatures from two specified corporate officers or a single officer's signature accompanied by written evidence of binding authority, typically a corporate resolution.
