About this file
This is a Faithful Performance Bond template document issued by the County of Orange, California, establishing the bonding requirements for contractors entering into service agreements with Orange County Public Works. The bond serves as a guarantee of faithful performance of contract obligations and requires contractors to obtain surety company bonds in an amount to be determined based on the contract price. The bond obligates the principal contractor and surety to indemnify and defend the County against losses resulting from the contractor's failure to perform contract terms, conditions, and specifications. The bond document includes provisions requiring notarization of the surety representative's signature and mandates that the surety company name be typed or stamped above the signature line.
The bond premium is calculated at a specified rate per thousand dollars of the contract price, with the total premium amount to be inserted into the document. The bond remains in full force regardless of any changes, extensions, alterations, or additions to the underlying contract terms, work scope, or specifications, with the surety waiving notice of such modifications. The document requires approval by both the County's CEO or Risk Management office and the County Counsel's office prior to execution. Pursuant to California Corporations Code section 313, contractor signature requirements vary based on corporate structure: either two authorized corporate officers (board chairman/president/vice president paired with secretary/assistant secretary/CFO/assistant treasurer) must sign, or a single officer may sign if accompanied by evidence of authority such as a corporate resolution.
